uk:target="true"><num>43</num><heading>Expanding the scope of regulation</heading><subsection eId="section-43-1"><num>(1)</num><content><p>The <ref eId="c00497" href="https://www.legislation.gov.uk/ukpga/2008/25/contents">Education and Skills Act 2008</ref> is amended as follows.</p></content></subsection><subsection eId="section-43-2"><num>(2)</num><content><p><mod>For <ref eId="c00498" href="https://www.legislation.gov.uk/ukpga/2008/25/section/92">section 92</ref> (meaning of “<term refersTo="#term-independent-educational-institution" eId="term-independent-educational-institution">independent educational institution</term>”) substitute—<quotedStructure startQuote="“" endQuote="”" uk:context="body" uk:docName="ukpga" ukl:TargetClass="primary" ukl:TargetSubClass="unknown" ukl:Context="main" ukl:Format="double"><section eId="d25e100"><num>92</num><heading>Independent educational institutions in England</heading><subsection eId="d25e104"><num>(1)</num><intro><p>The following are independent educational institutions for the purposes of this Chapter—</p></intro><level class="para1"><num>(a)</num><content><p>independent schools in England;</p></content></level><level class="para1" eId="d25e116"><num>(b)</num><intro><p>institutions in England, other than independent schools and excepted institutions, that provide full-time education for—</p></intro><level class="para2"><num>(i)</num><content><p>at least five children of compulsory school age, or</p></content></level><level class="para2"><num>(ii)</num><content><p>at least one child of compulsory school age who is looked after by a local authority or has special educational needs.</p></content></level></level></subsection><subsection><num>(2)</num><content><p>The following subsections apply for the purposes of <ref href="#d25e104">subsection (1)</ref><ref href="#d25e116">(b)</ref> (and see section 138(1A) for provision about the meaning of an institution providing education).</p></content></subsection><subsection eId="d25e145"><num>(3)</num><intro><p>Regulations may—</p></intro><level class="para1" eId="d25e151"><num>(a)</num><content><p>specify that an amount of time is or is not to be treated as “full-time” by reference to a number of hours in, or a proportion of, a week or other period, or in any other way;</p></content></level><level class="para1" eId="d25e157"><num>(b)</num><content><p>provide that time spent on a specified activity or on an activity of a specified description is or is not to be treated as time during which education is being provided;</p></content></level><level class="para1"><num>(c)</num><content><p>amend <ref href="#d25e181">subsection (4)</ref> so as to add, remove or amend factors;</p></content></level><level class="para1"><num>(d)</num><content><p>amend this section so as to add, remove or amend provision about the interpretation of the factors in <ref href="#d25e181">subsection (4)</ref>.</p></content></level></subsection><subsection eId="d25e181"><num>(4)</num><intro><p>If, or to the extent that, the question of whether an institution provides full-time education for a child is not determined by regulations under <ref href="#d25e145">subsection (3)</ref><ref href="#d25e151">(a)</ref> or <ref href="#d25e157">(b)</ref>, the factors relevant to determining that question include—</p></intro><level class="para1"><num>(a)</num><intro><p>the number of hours per week that—</p></intro><level class="para2"><num>(i)</num><content><p>education is provided to children by the institution;</p></content></level><level class="para2"><num>(ii)</num><content><p>activities incidental to that education (such as breaks and independent study time) are provided;</p></content></level></level><level class="para1"><num>(b)</num><content><p>the number of weeks in an academic year that education is provided;</p></content></level><level class="para1"><num>(c)</num><content><p>the time of day that education is provided.</p></content></level></subsection><subsection><num>(5)</num><content><p>An academic year means a period of 12 months ending with 31 August.</p></content></subsection><subsection><num>(6)</num><content><p>A child has special educational needs if an EHC plan or an individual development plan is maintained for the child (see <ref eId="c00499" href="https://www.legislation.gov.uk/ukpga/1996/56/section/579">section 579</ref><ref eId="c00500" href="https://www.legislation.gov.uk/ukpga/1996/56/section/579">(1)</ref> of the <ref eId="c00501" href="https://www.legislation.gov.uk/ukpga/1996/56/contents">Education Act 1996</ref> for the meaning of “EHC plan” and “individual development plan”).</p></content></subsection><subsection><num>(7)</num><intro><p>A reference to a child who is looked after by a local authority is to be read—</p></intro><level class="para1"><num>(a)</num><content><p>in relation to a local authority in England, in accordance with <ref eId="c00502" href="https://www.legislation.gov.uk/ukpga/1989/41/section/22">section 22</ref> of the <ref eId="c00503" href="https://www.legislation.gov.uk/ukpga/1989/41/contents">Children Act 1989</ref>;</p></content></level><level class="para1"><num>(b)</num><content><p>in relation to a local authority in Wales, in accordance with <ref eId="c00504" href="https://www.legislation.gov.uk/anaw/2014/4/section/74">section 74</ref> of the <ref eId="c00505" href="https://www.legislation.gov.uk/anaw/2014/4/contents">Social Services and Well-being (Wales) Act 2014 (anaw 4)</ref>.</p></content></level></subsection><subsection><num>(8)</num><intro><p>The following are excepted institutions—</p></intro><level class="para1"><num>(a)</num><content><p>an institution that provides only early years provision;</p></content></level><level class="para1"><num>(b)</num><content><p>a school maintained by a local authority;</p></content></level><level class="para1"><num>(c)</num><content><p>a school approved under <ref eId="c00506" href="https://www.legislation.gov.uk/ukpga/1996/56/section/342">section 342</ref> of the <ref eId="c00507" href="https://www.legislation.gov.uk/ukpga/1996/56/contents">Education Act 1996</ref> (approval of non-maintained special schools);</p></content></level><level class="para1"><num>(d)</num><content><p>a 16 to 19 Academy;</p></content></level><level class="para1"><num>(e)</num><content><p>an institution that is within the further education sector or the wider higher education sector;</p></content></level><level class="para1"><num>(f)</num><content><p>a secure college, secure training centre or young offender institution;</p></content></level><level class="para1"><num>(g)</num><content><p>an institution of a description specified in regulations.</p></content></level></subsection><subsection><num>(9)</num><content><p>For provision regulating independent schools in Wales, see <ref eId="c00508" href="https://www.legislation.gov.uk/ukpga/2002/32/part/10/chapter/1">Chapter 1</ref> of <ref eId="c00509" class="para1"><num>(b)</num><content><p>a person for whom part-time education suitable to the requirements of persons of any age over compulsory school age is provided;</p></content></level></hcontainer></quotedStructure><inline name="appendText">;</inline></mod></p></content></level><level class="para1" eId="section-43-8-b"><num>(b)</num><content><p><mod>after <ref eId="c00527" href="https://www.legislation.gov.uk/ukpga/2008/25/section/138">subsection (1)</ref> insert—<quotedStructure startQuote="“" endQuote="”" uk:context="body" uk:docName="ukpga" ukl:TargetClass="primary" ukl:TargetSubClass="unknown" ukl:Context="main" ukl:Format="double"><subsection><num>(1A)</num><content><p>For the purposes of this Chapter, education is provided at an institution if the institution provides instruction or guidance on any matter (and for this purpose it does not matter whether, or by whom, students
