uk:target="true"><num>4</num><heading>Information sharing and consistent identifiers</heading><content><p><mod>After <ref eId="c00035" href="https://www.legislation.gov.uk/ukpga/2004/31/section/16L">section 16L</ref> of the <ref eId="c00036" href="https://www.legislation.gov.uk/ukpga/2004/31/contents">Children Act 2004</ref> (safeguarding partners for local authority areas) insert—<quotedStructure startQuote="“" endQuote="”" uk:context="body" uk:docName="ukpga" ukl:TargetClass="primary" ukl:TargetSubClass="unknown" ukl:Context="main" ukl:Format="double"><hcontainer name="crossheading" ukl:Name="Pblock"><heading>Continuity of information for safeguarding and welfare purposes</heading><section eId="d28e90"><num>16LA</num><heading>Duty to share information</heading><subsection><num>(1)</num><intro><p>This section applies where a person to whom subsection <ref href="#d28e170">(4)</ref> applies (“<term refersTo="#term-the-relevant-person">the relevant person</term>”)—</p></intro><level class="para1"><num>(a)</num><content><p>holds information about a child or information about another individual that relates to the child, and</p></content></level><level class="para1"><num>(b)</num><content><p>considers that the information is relevant to safeguarding or promoting the welfare of the child.</p></content></level></subsection><subsection eId="d28e118"><num>(2)</num><intro><p>The relevant person must ensure that the information is disclosed to another person to whom subsection <ref href="#d28e170">(4)</ref> applies (“<term refersTo="#term-the-recipient">the recipient</term>”) if and only so far as the relevant person considers that the disclosure may facilitate—</p></intro><level class="para1"><num>(a)</num><content><p>where the recipient is within subsection <ref href="#d28e170">(4)</ref><ref href="#d28e176">(a)</ref> or <ref href="#d28e182">(b)</ref>, the exercise by the recipient of any of its relevant functions, or</p></content></level><level class="para1"><num>(b)</num><content><p>where the recipient is within subsection (4)<ref href="#d28e188">(c)</ref>, the provision of services by the recipient pursuant to arrangements made by a person within subsection <ref href="#d28e170">(4)</ref><ref href="#d28e176">(a)</ref> or <ref href="#d28e182">(b)</ref> in connection with the exercise of any of that person’s relevant functions.</p></content></level></subsection><subsection eId="d28e161"><num>(3)</num><content><p>But the duty imposed by subsection <ref href="#d28e118">(2)</ref> does not apply if the relevant person considers that the disclosure would be more detrimental to the child than not disclosing the information.</p></content></subsection><subsection eId="d28e170"><num>(4)</num><intro><p>This subsection applies to—</p></intro><level class="para1" eId="d28e176"><num>(a)</num><content><p>a person listed in section 11(1) (persons and bodies under a duty to make arrangements to safeguard and promote welfare),</p></content></level><level class="para1" eId="d28e182"><num>(b)</num><content><p>a person who is a designated childcare or education agency for the purposes of section 16E (local arrangements for safeguarding and promoting welfare of children), and</p></content></level><level class="para1" eId="d28e188"><num>(c)</num><content><p>a person who provides services pursuant to arrangements made by a person within paragraph <ref href="#d28e176">(a)</ref> or <ref href="#d28e182">(b)</ref> in connection with the exercise of any of that person’s relevant functions.</p></content></level></subsection><subsection><num>(5)</num><content><p>The duty imposed by subsection <ref href="#d28e118">(2)</ref> (as qualified by subsection <ref href="#d28e161">(3)</ref>) also applies where a relevant person receives a request for the information from another person to whom subsection <ref href="#d28e170">(4)</ref> applies.</p></content></subsection><subsection><num>(6)</num><content><p>The relevant person must, in discharging any duty imposed on it by this section, have regard to guidance issued by the Secretary of State.</p></content></subsection><subsection><num>(7)</num><content><p>A disclosure of information under this section does not breach any obligation of confidence owed by the person making the disclosure.</p></content></subsection><subsection><num>(8)</num><content><p>This section does not permit the relevant person to do anything which is prohibited by <ref eId="c00037" href="https://www.legislation.gov.uk/ukpga/2016/25/part/1">Parts 1 to 7</ref> or <ref eId="c00038" href="https://www.legislation.gov.uk/ukpga/2016/25/part/9/chapter/1">Chapter 1</ref> of <ref eId="c00039" href="https://www.legislation.gov.uk/ukpga/2016/25/part/9">Part 9</ref> of the <ref eId="c00040" href="https://www.legislation.gov.uk/ukpga/2016/25/contents">Investigatory Powers Act 2016</ref>.</p></content></subsection><subsection><num>(9)</num><content><p>In this section, “<term refersTo="#term-relevant-function">relevant function</term>” means a function relating to safeguarding or promoting the welfare of children.</p></content></subsection></section><section><num>16LB</num><heading>Information standards</heading><subsection eId="d28e261"><num>(1)</num><content><p>The Secretary of State may prepare an information standard.</p></content></subsection><subsection eId="d28e267"><num>(2)</num><content><p>For the purposes of this section, “an information standard” is a standard in relation to the processing of information for the purposes of safeguarding or promoting the welfare of children.</p></content></subsection><subsection><num>(3)</num><content><p>An information standard must specify to whom it applies.</p></content></subsection><subsection><num>(4)</num><content><p>An information standard may only apply to one or more persons falling within <ref href="#d28e90">section 16LA</ref><ref href="#d28e170">(4)</ref>.</p></content></subsection><subsection><num>(5)</num><content><p>A person to whom an information standard applies must have regard to the standard when processing information for the purposes of safeguarding or promoting the welfare of children.</p></content></subsection><subsection><num>(6)</num><content><p>For the purposes of <ref href="#d28e261">subsection (1)</ref>, the Secretary of State may adopt all or part of any other information standard prepared or published under any other enactment or for a different purpose from the purpose mentioned in <ref href="#d28e267">subsection (2)</ref>.</p></content></subsection><subsection><num>(7)</num><content><p>The Secretary of State may revise an information standard from time to time.</p></content></subsection><subsection><num>(8)</num><content><p>The Secretary of State must publish the current version of each information standard prepared under this section.</p></content></subsection><subsection><num>(9)</num><content><p>Before publishing an information standard under this section, the Secretary of State must consult such persons (if any) as the Secretary of State considers appropriate.</p></content></subsection><subsection><num>(10)</num><content><p>In this section, “<term refersTo="#term-processing">processing</term>” has the same meaning as in <ref eId="c00041" href="https://www.legislation.gov.uk/ukpga/2018/12/part/5">Parts 5 to 7</ref> of the <ref eId="c00042" href="https://www.legislation.gov.uk/ukpga/2018/12/contents">Data Protection Act 2018</ref> (see section 3(4) and (14) of that Act).</p></content></subsection></section><section eId="d28e344"><num>16LC</num><heading>Consistent identifiers for children</heading><subsection eId="d28e348"><num>(1)</num><intro><p>The Secretary of State may by regulations make provision for or in connection with—</p></intro><level class="para1"><num>(a)</num><content><p>specifying a description of consistent identifier for the purposes of this section;</p></content></level><level class="para1"><num>(b)</num><content><p>requiring or authorising the disclosure of the consistent identifier to a designated person for the purpose of enabling the designated person to comply with <ref href="#d28e423">subsection (5)</ref>.</p></content></level></subsection><subsection><num>(2)</num><content><p>A disclosure required or authorised by the regulations does not breach any obligation of confidence owed by the person disclosing the identifier.</p></content></subsection><subsection><num>(3)</num><intro><p>“<term refersTo="#term-consistent-identifier">Consistent identifier</term>” means any identifier (such as, for example, a number or code used for identification purposes) that—</p></intro><level class="para1"><num>(a)</num><content><p>relates to a child, and</p></content></level><level class="para1"><num>(b)</num><content><p>forms part of a set of similar identifiers that is of general application.</p></content></level></subsection><subsection><num>(4)</num><intro><p>Subsection <ref href="#d28e423">(5)</ref> applies if—</p></intro><level class="para1"><num>(a)</num><content><p>a designated person (see subsection <ref href="#d28e483">(10)</ref>) processes information about a child, and</p></content></level><level class="para1"><num>(b)</num><content><p>the child is one to whom a consistent identifier of the description specified under subsection <ref href="#d28e348">(1)</ref> relates.</p></content></level></subsection><subsection eId="d28e423"><num>(5)</num><content><p>If this subsection applies the designated person must include the consistent identifier in the information processed (but this is subject to subsections <ref href="#d28e435">(6)</ref> to <ref href="#d28e453">(8)</ref>).</p></content></subsection><subsection eId="d28e435"><num>(6)</num><content><p>Subsection <ref href="#d28e423">(5)</ref> applies only so far as the designated person considers that the inclusion of the consistent identifier is likely to facilitate the exercise by any person of a function of that person that relates to safeguarding or promoting the welfare of children.</p></content></subsection><subsection><num>(7)</num><content><p>Subsection <ref href="#d28e423">(5)</ref> does not apply if the designated person considers that including the consistent identifier in the information processed would be more detrimental to the child than not including it.</p></content></subsection><subsection eId="d28e453"><num>(8)</num><intro><p>The designated person need not comply with subsection <ref href="#d28e423">(5)</ref> if—</p></intro><level class="para1"><num>(a)</num><content><p>it does not know the consistent identifier, and</p></content></level><level class="para1"><num>(b)</num><content><p>it reasonably considers that finding it out would cause unreasonable delay to the processing of the information.</p></content></level></subsection><subsection><num>(9)</num><content><p>A designated person’s compliance with subsection <ref href="#d28e423">(5)</ref> does not breach any obligation of confidence owed by the designated person.</p></content></subsection><subsection eId="d28e483"><num>(10)</num><content><p>In this section “<term refersTo="#term-designated-person">designated person</term>” means a person designated for the purposes of this section in regulations made by the Secretary of State.</p></content></subsection><subsection><num>(11)</num><intro><p>A person may be designated as mentioned in subsection <ref href="#d28e483">(10)</ref> only if the person is—</p></intro><level class="para1"><num>(a)</num><content><p>a person listed in section 11(1) (persons and bodies under a duty to make arrangements to safeguard and promote welfare), or</p></content></level><level class="para1"><num>(b)</num><content><p>a person who is a designated childcare or education agency for the purposes of section 16E (local arrangements for safeguarding and promoting welfare of children).</p></content></level></subsection><subsection><num>(12)</num><content><p>A designated person must, in discharging any duty imposed on it by this section, have regard to guidance issued by the Secretary of State.</p></content></subsection><subsection eId="d28e520"><num>(13)</num><content><p>Where a person (a “service provider”) provides services pursuant to arrangements made by a designated person in connection with the exercise of any function of the designated person that relates to safeguarding or promoting the welfare of children, this section applies to the service provider as it applies to the designated person.</p></content></subsection><subsection><num>(14)</num><content><p>The reference in subsection <ref href="#d28e435">(6)</ref> to the inclusion of a consistent identifier being likely to facilitate the exercise of a function is to it being likely to facilitate that exercise directly (rather than by means of a trial, study, audit or any other indirect means).</p></content></subsection><subsection><num>(15)</num><content><p>In this section, “processes”, “processed” and “processing” are to be read in accordance with the meaning of “processing” in <ref eId="c00043" href="https://www.legislation.gov.uk/ukpga/2018/12/part/5">Parts 5 to 7</ref> of the <ref eId="c00044" href="https://www.legislation.gov.uk/ukpga/2018/12/contents">Data Protection Act 2018</ref> (see section 3(4) and (14) of that Act).</p></content></subsection></section><section><num>16LD</num><heading>Consistent identifiers for children: code of practice</heading><subsection><num>(1)</num><intro><p>The Secretary of State may issue a code of practice for—</p></intro><level class="para1"><num>(a)</num><content><p>persons who are designated persons within the meaning of section <ref href="#d28e344">16LC</ref><ref href="#d28e483">(10)</ref> for the purposes of the duty in section <ref href="#d28e344">16LC</ref><ref href="#d28e423">(5)</ref>, and</p></content></level><level class="para1"><num>(b)</num><content><p>persons who are service providers within the meaning of section <ref href="#d28e344">16LC</ref><ref href="#d28e520">(13)</ref>.</p></content></level></subsection><subsection><num>(2)</num><content><p>Those persons must have regard to the code of practice when discharging their duties under section <ref href="#d28e344">16LC</ref>.</p></content></subsection><subsection><num>(3)</num><content><p>The Secretary of State may revise the code from time to time.</p></content></subsection><subsection><num>(4)</num><content><p>The Secretary of State must publish the current version of the code.</p></content></subsection><subsection><num>(5)</num><content><p>Before publishing the code, the Secretary of State must consult such persons (if any) as the Secretary of State considers
