eId="section-39-1"><num>(1)</num><content><p>The <ref eId="c00465" href="https://www.legislation.gov.uk/ukpga/1996/56/contents">Education Act 1996</ref> is amended as follows.</p></content></subsection><subsection eId="section-39-2"><num>(2)</num><content><p><mod>After <ref href="#">section 436G</ref> (as inserted by <ref href="#">section 38</ref>) insert—<quotedStructure startQuote="“" endQuote="”" uk:context="body" uk:docName="ukpga" ukl:TargetClass="primary" ukl:TargetSubClass="unknown" ukl:Context="main" ukl:Format="double"><hcontainer name="crossheading" ukl:Name="Pblock"><heading>School attendance orders</heading><section eId="d25e96"><num>436H</num><heading>Preliminary notice for school attendance order</heading><subsection eId="d25e100"><num>(1)</num><intro><p>A local authority must serve a preliminary notice on a child’s parent in relation to a child for whom the authority is responsible if it appears to the authority that—</p></intro><level class="para1"><num>(a)</num><content><p>the child is of compulsory school age, and</p></content></level><level class="para1"><num>(b)</num><content><p>either condition A or condition B is met.</p></content></level></subsection><subsection eId="d25e118"><num>(2)</num><content><p>A local authority may serve a preliminary notice on a child’s parent if it appears to the authority that either condition C or condition D is met.</p></content></subsection><subsection><num>(3)</num><intro><p>A “<term refersTo="#term-preliminary-notice">preliminary notice</term>” means a notice requiring the child’s parent on whom the notice is served to satisfy the local authority that—</p></intro><level class="para1"><num>(a)</num><content><p>the child is receiving suitable education, where condition A, C or D is relied on to serve the notice;</p></content></level><level class="para1"><num>(b)</num><content><p>the child is receiving education that is in their best interests, where condition B is relied on to serve the notice.</p></content></level></subsection><subsection><num>(4)</num><content><p>Condition A is that the child is not receiving suitable education, either by regular attendance at school or otherwise.</p></content></subsection><subsection eId="d25e151"><num>(5)</num><intro><p>Condition B is that—</p></intro><level class="para1" eId="d25e157"><num>(a)</num><intro><p>the local authority or another local authority is—</p></intro><level class="para2"><num>(i)</num><content><p>conducting enquiries in respect of the child under <ref eId="c00466" href="https://www.legislation.gov.uk/ukpga/1989/41/section/47">section 47</ref> of the <ref eId="c00467" href="https://www.legislation.gov.uk/ukpga/1989/41/contents">Children Act 1989</ref> (duty to investigate), or</p></content></level><level class="para2"><num>(ii)</num><content><p>taking action under <ref eId="c00468" href="https://www.legislation.gov.uk/ukpga/1989/41/section/47">section 47</ref><ref eId="c00469" href="https://www.legislation.gov.uk/ukpga/1989/41/section/47">(8)</ref> of <ref eId="c00470" href="https://www.legislation.gov.uk/ukpga/1989/41/contents">that Act</ref> to safeguard or promote the child’s welfare, in a case where the enquiries mentioned in sub-paragraph (i) have led the local authority to conclude that the child is suffering, or is likely to suffer, significant harm (within the meaning of <ref eId="c00471" href="https://www.legislation.gov.uk/ukpga/1989/41/section/31">section 31</ref><ref eId="c00472" href="https://www.legislation.gov.uk/ukpga/1989/41/section/31">(9)</ref> and <ref eId="c00473" href="https://www.legislation.gov.uk/ukpga/1989/41/section/31">(10)</ref> of <ref eId="c00474" href="https://www.legislation.gov.uk/ukpga/1989/41/contents">that Act</ref>), or has taken such action during the period of five years ending with the date on which a preliminary notice is to be served under subsection <ref href="#d25e100">(1)</ref>,</p></content></level></level><level class="para1"><num>(b)</num><content><p>the child is not regularly attending school, and</p></content></level><level class="para1"><num>(c)</num><content><p>it would be in the child’s best interests to receive education by regular attendance at school.</p></content></level></subsection><subsection><num>(6)</num><intro><p>Condition C is that—</p></intro><level class="para1"><num>(a)</num><content><p>the child is eligible to be registered by the local authority under <ref href="#">section 436B</ref>,</p></content></level><level class="para1"><num>(b)</num><content><p>the authority has asked the child’s parent for information under section <ref href="#">436D</ref><ref href="#">(1)</ref>, and</p></content></level><level class="para1"><num>(c)</num><content><p>the child’s parent has not provided that information before the end of the relevant period (as defined in <ref href="#">section 436D</ref><ref href="#">(5)</ref><ref href="#">(a)</ref>), or has provided incorrect information.</p></content></level></subsection><subsection><num>(7)</num><intro><p>Condition D is that the child’s parent is under a duty to provide information to the local authority under section <ref href="#">436D</ref><ref href="#">(2)</ref><ref href="#">(a)</ref>, <ref href="#">(b)</ref> or <ref href="#">(c)</ref> in relation to the child and—</p></intro><level class="para1"><num>(a)</num><content><p>has not provided the information before the end of the relevant period (as defined in <ref href="#">section 436D</ref><ref href="#">(5)</ref>), or</p></content></level><level class="para1"><num>(b)</num><content><p>has provided incorrect information.</p></content></level></subsection><subsection eId="d25e291"><num>(8)</num><intro><p>For the purpose of determining whether a preliminary notice must or may be served under this section in respect of a child, the local authority—</p></intro><level class="para1"><num>(a)</num><content><p>must consider the settings where the child is being educated that the local authority knows about and where the child lives, and</p></content></level><level class="para1" eId="d25e303"><num>(b)</num><content><p>may request the child’s parent on whom the preliminary notice would be served to allow the local authority to visit the child inside any of the homes in which the child lives.</p></content></level></subsection><subsection><num>(9)</num><content><p>If a request under <ref href="#d25e291">subsection (8)</ref><ref href="#d25e303">(b)</ref> is refused by the person to whom it is made, the local authority must consider that to be a relevant factor in determining whether to serve a preliminary notice.</p></content></subsection><subsection><num>(10)</num><intro><p>A preliminary notice must—</p></intro><level class="para1"><num>(a)</num><content><p>state which of conditions A to D are relied on to serve the notice,</p></content></level><level class="para1"><num>(b)</num><content><p>be served without delay, and in any event before the end of the period of five days beginning with the day on which it appears to the local authority that the requirements of <ref href="#d25e100">subsection (1)</ref> or <ref href="#d25e118">(2)</ref> are met, and</p></content></level><level class="para1"><num>(c)</num><content><p>specify the period within which the person must respond to the notice, which must be not less than 15 days beginning with the day on which the notice is served.</p></content></level></subsection></section><section eId="d25e353"><num>436I</num><heading>School attendance orders</heading><subsection eId="d25e357"><num>(1)</num><intro><p>A local authority must serve an order under this section on a child’s parent if—</p></intro><level class="para1"><num>(a)</num><content><p>the authority has served a preliminary notice on the child’s parent under section <ref href="#d25e96">436H</ref>
<i>,</i></p></content></level><level class="para1" eId="d25e374"><num>(b)</num><intro><p>the child’s parent fails to satisfy the local authority, within the period specified in the notice, that—</p></intro><level class="para2" eId="d25e380"><num>(i)</num><content><p>the child is receiving suitable education, in a case where condition A, C or D is cited in the notice<i>,</i></p></content></level><level class="para2" eId="d25e388"><num>(ii)</num><content><p>it is in the best interests of the child to receive education otherwise than by regular attendance at school, in a case where condition B is cited in the notice, and</p></content></level></level><level class="para1"><num>(c)</num><content><p>in the opinion of the authority it is expedient that the child should attend school.</p></content></level></subsection><subsection><num>(2)</num><intro><p>But a local authority must not serve an order under this section on a child’s parent if—</p></intro><level class="para1"><num>(a)</num><intro><p>either—</p></intro><level class="para2"><num>(i)</num><content><p>condition B was the only condition cited in the preliminary notice served under section <ref href="#d25e96">436H</ref> in relation to the child, or</p></content></level><level class="para2"><num>(ii)</num><content><p>condition B and another condition were cited in that preliminary notice, but the child’s parent has satisfied the local authority that the child is receiving suitable education,</p></content></level></level><level class="para1"><num>(b)</num><content><p>the local authority is no longer conducting enquiries or taking action in respect of the child as mentioned in section <ref href="#d25e96">436H</ref><ref href="#d25e151">(5)</ref><ref href="#d25e157">(a)</ref>, and</p></content></level><level class="para1"><num>(c)</num><content><p>the local authority is not aware of any other enquiries being made under <ref eId="c00475" href="https://www.legislation.gov.uk/ukpga/1989/41/section/47">section 47</ref> of the <ref eId="c00476" href="https://www.legislation.gov.uk/ukpga/1989/41/contents">Children Act 1989</ref> or of any other action being taken under <ref eId="c00477" href="https://www.legislation.gov.uk/ukpga/1989/41/section/47">section 47</ref><ref eId="c00478" href="https://www.legislation.gov.uk/ukpga/1989/41/section/47">(8)</ref> of <ref eId="c00479" href="https://www.legislation.gov.uk/ukpga/1989/41/contents">that Act</ref>, or which has been taken during the period of five years ending with the date that the order would be made, in respect of the child.</p></content></level></subsection><subsection eId="d25e460"><num>(3)</num><intro><p>For the purpose of determining whether an order must be served under this section in respect of a child, the local authority—</p></intro><level class="para1"><num>(a)</num><content><p>must consider the settings where the child is being educated that the local authority knows about and where the child lives,</p></content></level><level class="para1"><num>(b)</num><content><p>must consider how the child is being educated and what the child is learning, so far as is relevant in the particular case, and</p></content></level><level class="para1" eId="d25e478"><num>(c)</num><content><p>may request the child’s parent on whom the preliminary notice has been served under section <ref href="#d25e96">436H</ref> to allow the local authority to visit the child inside any of the homes in which the child lives.</p></content></level></subsection><subsection><num>(4)</num><content><p>If a request under subsection <ref href="#d25e460">(3)</ref><ref href="#d25e478">(c)</ref> is refused by the person to whom it is made, the local authority must consider that to be a relevant factor in deciding whether the child’s parent has failed to satisfy the local authority as mentioned in <ref href="#d25e357">subsection (1)</ref><ref href="#d25e374">(b)</ref><ref href="#d25e380">(i)</ref> or <ref href="#d25e388">(ii)</ref>.</p></content></subsection><subsection><num>(5)</num><content><p>An order under this section (a “school attendance order”) is an order requiring the person on whom it is served to cause the child to become a registered pupil at a school named in the order.</p></content></subsection><subsection eId="d25e514"><num>(6)</num><intro><p>A school attendance order under this section—</p></intro><level class="para1" eId="d25e520"><num>(a)</num><content><p>must be served without delay, and in any event before the end of the period of five days beginning with the day on which the authority determines which school is to be named in the order, and</p></content></level><level class="para1"><num>(b)</num><content><p>must be in the prescribed form.</p></content></level></subsection><subsection><num>(7)</num><intro><p>A school attendance order under this section continues in force (subject to any amendment made by the local authority) for so long as the child is of compulsory school age, unless—</p></intro><level class="para1"><num>(a)</num><content><p>it is revoked by the authority, or</p></content></level><level class="para1"><num>(b)</num><content><p>a direction is made in respect of it under <ref href="#d25e1599">section 436Q</ref><ref href="#d25e1744">(6)</ref> or 447(5).</p></content></level></subsection><subsection eId="d25e555"><num>(8)</num><intro><p>Where a maintained school is named in a school attendance order under this section—</p></intro><level class="para1"><num>(a)</num><content><p>the local authority must without delay, and in any event before the end of the period of five days referred to in subsection <ref href="#d25e514">(6)</ref><ref href="#d25e520">(a)</ref> inform the governing body and the head teacher, and</p></content></level><level class="para1"><num>(b)</num><content><p>the governing body and the local authority must admit the child to the school.</p></content></level></subsection><subsection eId="d25e578"><num>(9)</num><intro><p>Where an Academy school or alternative provision Academy is named in a school attendance order under this section—</p></intro><level class="para1"><num>(a)</num><content><p>the local authority must without delay, and in any event before the end of the period of five days referred to in subsection <ref href="#d25e514">(6)</ref><ref href="#d25e520">(a)</ref> inform the proprietor and the principal, and</p></content></level><level class="para1"><num>(b)</num><content><p>the proprietor must admit the child to the school.</p></content></level></subsection><subsection><num>(10)</num><content><p>Subsections <ref href="#d25e555">(8)</ref> and <ref href="#d25e578">(9)</ref> do not affect any power to exclude from a school a pupil who is already a registered pupil there.</p></content></subsection></section><section eId="d25e616"><num>436J</num><heading>School attendance order for child with EHC plan (England)</heading><subsection><num>(1)</num><content><p>Subsections <ref href="#d25e635">(2)</ref> and <ref href="#d25e641">(3)</ref> apply where a local authority in England is required to serve a school attendance order under section <ref href="#d25e353">436I</ref> in respect of a child for whom the authority maintains an EHC plan.</p></content></subsection><subsection eId="d25e635"><num>(2)</num><content><p>Where the EHC plan specifies the name of a school, that school must be named in the order.</p></content></subsection><subsection eId="d25e641"><num>(3)</num><intro><p>Where the EHC plan does not specify the name of a school—</p></intro><level class="para1" eId="d25e647"><num>(a)</num><content><p>the authority must amend the plan so that it specifies the name of a school, and</p></content></level><level class="para1"><num>(b)</num><content><p>that school must then be named in the order.</p></content></level></subsection><subsection><num>(4)</num><content><p>An amendment to an EHC plan required to be made under subsection <ref href="#d25e641">(3)</ref><ref href="#d25e647">(a)</ref> is to be treated as if it were an amendment made following a review under <ref eId="c00480" href="https://www.legislation.gov.uk/ukpga/2014/6/section/44">section 44</ref> of the <ref eId="c00481" href="https://www.legislation.gov.uk/ukpga/2014/6/contents">Children and Families Act 2014</ref>, and <ref eId="c00482" href="https://www.legislation.gov.uk/ukpga/2014/6/section/44">that section</ref> and regulations made under it apply accordingly.</p></content></subsection><subsection><num>(5)</num><intro><p>Where—</p></intro><level class="para1"><num>(a)</num><content><p>a school attendance order is in force in respect of a child for whom the local authority maintain an EHC plan, and</p></content></level><level class="para1"><num>(b)</num><content><p>the name of the school specified in the plan is changed,</p></content></level><wrapUp><p>the local authority must amend the order accordingly.</p></wrapUp></subsection><subsection><num>(6)</num><content><p>Where a school attendance order is in force in respect of a child who subsequently becomes a child for whom the local authority maintain an EHC plan which specifies the name of a school, the local authority must ensure that school is named in the order.</p></content></subsection></section><section eId="d25e708"><num>436K</num><heading>School attendance order for child with individual development plan (Wales)</heading><subsection><num>(1)</num><content><p>Where a local authority in Wales is required to serve a school attendance order under section <ref href="#d25e353">436I</ref> in respect of a child for whom an individual development plan is maintained in which a particular school is named, that school must be named in the order.</p></content></subsection><subsection><num>(2)</num><intro><p>Where—</p></intro><level class="para1"><num>(a)</num><content><p>a school attendance order is in force in respect of a child for whom an individual development plan is maintained in which a particular school is named, and</p></content></level><level class="para1"><num>(b)</num><content><p>the name of the school specified in the plan is changed,</p></content></level><wrapUp><p>the local authority must amend the order accordingly.</p></wrapUp></subsection><subsection><num>(3)</num><content><p>Where a school attendance order is in force in respect of a child who subsequently becomes a child for whom an individual development plan is maintained in which a particular school is named, the local authority must ensure that school is named in the order.</p></content></subsection></section><section eId="d25e750"><num>436L</num><heading>School nomination notice for school attendance order</heading><subsection><num>(1)</num><content><p>Before a local authority serves a school attendance order under section <ref href="#d25e353">436I</ref> on a person in respect of a child, other than a child for whom the authority maintains an EHC plan or a child for whom an individual development plan is maintained in which a particular school is named, the authority must serve a notice on the person under this section (a “school nomination notice”).</p></content></subsection><subsection><num>(2)</num><intro><p>A school nomination notice is a notice in writing—</p></intro><level class="para1"><num>(a)</num><content><p>informing the person of the local authority’s intention to serve the order,</p></content></level><level class="para1"><num>(b)</num><content><p>specifying the school which the authority intends to name in the order and, if the authority considers it fit, one or more other schools which it regards as suitable alternatives, and</p></content></level><level class="para1"><num>(c)</num><content><p>stating the effect of subsections <ref href="#d25e804">(3)</ref> to <ref href="#d25e868">(6)</ref>.</p></content></level><wrapUp><p>For periods within which the school nomination notice must be served, see section <ref href="#d25e1012">436N</ref><ref href="#d25e1148">(6)</ref> and <ref href="#d25e1166">(7)</ref>.</p></wrapUp></subsection><subsection eId="d25e804"><num>(3)</num><content><p>If the school nomination notice specifies one or more alternative schools and the person selects one of them before the end of the period of 15 days beginning with the day on which the notice is served, the school selected by the person must be named in the order.</p></content></subsection><subsection eId="d25e810"><num>(4)</num><intro><p>If—</p></intro><level class="para1"><num>(a)</num><intro><p>within the period mentioned in subsection <ref href="#d25e804">(3)</ref> the person—</p></intro><level class="para2"><num>(i)</num><content><p>applies for the child to be admitted to a school which is an Academy school or alternative provision Academy and notifies the local authority which served the notice of the application, or</p></content></level><level class="para2"><num>(ii)</num><content><p>applies for the child to be admitted to a school maintained by a local authority and, where that authority is not the local authority which served the notice, notifies the latter authority of the application, and</p></content></level></level><level class="para1"><num>(b)</num><content><p>the child is offered a place at the school as a result of the application,</p></content></level><wrapUp><p>that school must be named in the school attendance order.</p></wrapUp></subsection><subsection eId="d25e845"><num>(5)</num><intro><p>If—</p></intro><level class="para1"><num>(a)</num><content><p>within the period mentioned in subsection <ref href="#d25e804">(3)</ref> the person applies to the local authority by whom the notice was served for education to be provided at a school which is not a school maintained by a local authority, an Academy school or alternative provision Academy, and</p></content></level><level class="para1"><num>(b)</num><content><p>the child is offered a place at the school under arrangements made by the authority under which the fees payable in respect of the education provided at the school are to be paid by them under section 517,</p></content></level><wrapUp><p>that school must be named in the school attendance order.</p></wrapUp></subsection><subsection eId="d25e868"><num>(6)</num><intro><p>If, within the period mentioned in subsection <ref href="#d25e804">(3)</ref>—</p></intro><level class="para1"><num>(a)</num><intro><p>the person—</p></intro><level class="para2"><num>(i)</num><content><p>applies for the child to be admitted to a school which is not maintained by a local authority, an Academy school or an alternative provision Academy and in respect of which no application is made under subsection <ref href="#d25e845">(5)</ref>, and</p></content></level><level class="para2"><num>(ii)</num><content><p>notifies the local authority by whom the notice was served of the application,</p></content></level></level><level class="para1"><num>(b)</num><content><p>the child is offered a place at the school as a result of the application, and</p></content></level><level class="para1"><num>(c)</num><content><p>the school is suitable to the child’s age, ability and aptitude and to any special educational needs the child may have,</p></content></level><wrapUp><p>that school must be named in the school attendance order.</p></wrapUp></subsection></section><section eId="d25e915"><num>436M</num><heading>School nomination notice: restrictions</heading><subsection><num>(1)</num><content><p>A local authority may not specify a school in a school nomination notice if the child is permanently excluded from it.</p></content></subsection><subsection><num>(2)</num><content><p>A local authority may not specify a maintained school or Academy school in a school nomination notice if the admission of the child would, because of the need to take measures to avoid failing to comply with any duty applicable to the school in relation to class sizes, prejudice the provision of efficient education or the efficient use of resources.</p></content></subsection><subsection eId="d25e931"><num>(3)</num><content><p>A local authority may not specify a maintained school or Academy school in a school nomination notice if, were the child concerned admitted to the school in accordance with a school attendance order resulting from the notice, the number of pupils at the school in the child’s age group would exceed the relevant number.</p></content></subsection><subsection><num>(4)</num><intro><p>The relevant number is—</p></intro><level class="para1"><num>(a)</num><content><p>in the case of a maintained school, the number determined in accordance with <ref eId="c00483" href="https://www.legislation.gov.uk/ukpga/1998/31/section/88C">section 88C</ref> or <ref eId="c00484" href="https://www.legislation.gov.uk/ukpga/1998/31/section/89">89</ref> of the <ref eId="c00485" href="https://www.legislation.gov.uk/ukpga/1998/31/contents">School Standards and Framework Act 1998</ref> as the number of pupils in the child’s age group which it is intended to admit to the school in the school year in which the child would be admitted, or</p></content></level><level class="para1"><num>(b)</num><content><p>in the case of an Academy school, the number determined in accordance with the Academy arrangements relating to the school or any enactment as the number of such pupils.</p></content></level></subsection><subsection><num>(5)</num><content><p>Subsection <ref href="#d25e931">(3)</ref> does not prevent a local authority from specifying a maintained school where the authority is responsible for determining the arrangements for the admission of pupils to the school.</p></content></subsection><subsection><num>(6)</num><intro><p>Subsection <ref href="#d25e931">(3)</ref> also does not prevent a local authority from specifying a maintained school or Academy school if—</p></intro><level class="para1"><num>(a)</num><content><p>in the opinion of the authority the school is a reasonable distance from the home of the child, and</p></content></level><level class="para1"><num>(b)</num><intro><p>there is no maintained school or Academy school in their area which—</p></intro><level class="para2"><num>(i)</num><content><p>the authority could specify (apart from subsection <ref href="#d25e931">(3)</ref>), and</p></content></level><level class="para2"><num>(ii)</num><content><p>is in the opinion of the authority a reasonable distance from the home of the child.</p></content></level></level></subsection></section><section eId="d25e1012"><num>436N</num><heading>School nomination notice: procedure</heading><subsection><num>(1)</num><intro><p>Before deciding to specify a maintained school, Academy school or alternative provision Academy in a school nomination notice a local authority must consult—</p></intro><level class="para1"><num>(a)</num><intro><p>in the case of a maintained school—</p></intro><level class="para2"><num>(i)</num><content><p>the governing body, and</p></content></level><level class="para2"><num>(ii)</num><content><p>if another local authority is responsible for determining the arrangements for the admission of pupils to the school, that authority, or</p></content></level></level><level class="para1"><num>(b)</num><content><p>in the case of an Academy school or alternative provision Academy, the proprietor.</p></content></level></subsection><subsection eId="d25e1046"><num>(2)</num><intro><p>Where a local authority decides to specify a maintained school, Academy school or alternative provision Academy in a school nomination notice the authority must, before serving the notice, serve notice in writing of their decision on—</p></intro><level class="para1" eId="d25e1052"><num>(a)</num><intro><p>in the case of a maintained school—</p></intro><level class="para2" eId="d25e1058"><num>(i)</num><content><p>the governing body,</p></content></level><level class="para2"><num>(ii)</num><content><p>the head teacher, and</p></content></level><level class="para2" eId="d25e1070"><num>(iii)</num><content><p>if another local authority is responsible for determining the arrangements for the admission of pupils to the school, that authority, or</p></content></level></level><level class="para1" eId="d25e1076"><num>(b)</num><intro><p>in the case of an Academy school or alternative provision Academy—</p></intro><level class="para2" eId="d25e1082"><num>(i)</num><content><p>the proprietor, and</p></content></level><level class="para2"><num>(ii)</num><content><p>the principal.</p></content></level></level></subsection><subsection eId="d25e1094"><num>(3)</num><content><p>A notice under subsection <ref href="#d25e1046">(2)</ref> must be served without delay, and in any event before the end of the period of 15 days beginning with the expiry of the period specified in the notice under section <ref href="#d25e96">436H</ref>.</p></content></subsection><subsection eId="d25e1106"><num>(4)</num><content><p>A person on whom a notice is served under subsection <ref href="#d25e1046">(2)</ref><ref href="#d25e1052">(a)</ref><ref href="#d25e1058">(i)</ref> or <ref href="#d25e1070">(iii)</ref> or <ref href="#d25e1076">(b)</ref><ref href="#d25e1082">(i)</ref> may apply to the Secretary of State in relation to a school in England, or to the Welsh Ministers in relation to a school in Wales, for a direction under this section and, if they do so, must inform the local authority which served the notice.</p></content></subsection><subsection eId="d25e1127"><num>(5)</num><intro><p>An application under subsection <ref href="#d25e1106">(4)</ref> must be made—</p></intro><level class="para1"><num>(a)</num><content><p>if the notice is served on a school day, before the end of the period of 10 school days beginning with the day on which the notice is served, or</p></content></level><level class="para1"><num>(b)</num><content><p>if the notice is served on a day that is not a school day, before the end of the period of 10 school days beginning with the first school day following the day on which the notice is served.</p></content></level></subsection><subsection eId="d25e1148"><num>(6)</num><content><p>If the local authority which served a notice under subsection <ref href="#d25e1046">(2)</ref> is not informed of an application under subsection <ref href="#d25e1106">(4)</ref> within the period specified in subsection <ref href="#d25e1127">(5)</ref>, the authority must serve the school nomination notice without delay, and in any event before the end of the period of five days beginning with the day after the day on which the period specified in subsection <ref href="#d25e1127">(5)</ref> ended.</p></content></subsection><subsection eId="d25e1166"><num>(7)</num><intro><p>Where the Secretary of State gives a direction under this section in relation to a school in England or the Welsh Ministers give a direction under this section in relation to a school in Wales—</p></intro><level class="para1"><num>(a)</num><content><p>the school or schools to be specified in the school nomination notice are to be determined in accordance with the direction, and</p></content></level><level class="para1"><num>(b)</num><content><p>the school nomination notice must be served without delay, and in any event before the end of the period of five days beginning with the day after that on which the direction is given.</p></content></level></subsection><subsection><num>(8)</num><intro><p>If a local authority in England serves a notice under <ref href="#d25e1046">subsection (2)</ref> specifying a school in Wales and an application for a direction is made to the Welsh Ministers under <ref href="#d25e1106">subsection (4)</ref> in relation to that notice, the direction under this section may only—</p></intro><level class="para1"><num>(a)</num><content><p>confirm that a school specified in the notice under <ref href="#d25e1046">subsection (2)</ref> should be specified in the school nomination notice, or</p></content></level><level class="para1"><num>(b)</num><content><p>refer the question of which school or schools should be specified in the school nomination notice back to the local authority to determine.</p></content></level></subsection><subsection eId="d25e1211"><num>(9)</num><intro><p>If a local authority in Wales serves a notice under <ref href="#d25e1046">subsection (2)</ref> specifying a school in England, and an application for a direction is made to the Secretary of State under <ref href="#d25e1106">subsection (4)</ref> in relation to that notice, the direction under this section may only—</p></intro><level class="para1"><num>(a)</num><content><p>confirm that a school specified in the notice under <ref href="#d25e1046">subsection (2)</ref> should be specified in the school nomination notice, or</p></content></level><level class="para1"><num>(b)</num><content><p>refer the question of which school or schools should be specified in the school nomination notice back to the local authority to determine.</p></content></level></subsection></section><section eId="d25e1241"><num>436O</num><heading>Amendment of school attendance order</heading><subsection><num>(1)</num><content><p>This section applies where a school attendance order under section <ref href="#d25e353">436I</ref> is in force in respect of a child, other than a child for whom the local authority maintains an EHC plan or a child for whom an individual development plan is maintained in which a particular school is named.</p></content></subsection><subsection eId="d25e1254"><num>(2)</num><intro><p>If at any time—</p></intro><level class="para1"><num>(a)</num><intro><p>the person on whom the order is served applies for the child to be admitted—</p></intro><level class="para2"><num>(i)</num><content><p>to a school maintained by a local authority, an Academy school or an alternative provision Academy, and</p></content></level><level class="para2"><num>(ii)</num><content><p>which is different from the school named in the order,</p></content></level></level><level class="para1"><num>(b)</num><content><p>the child is offered a place at the school as a result of the application, and</p></content></level><level class="para1"><num>(c)</num><content><p>the person requests the authority that served the order to amend the order by substituting that school for the one currently named,</p></content></level><wrapUp><p>the authority must comply with the request.</p></wrapUp></subsection><subsection eId="d25e1292"><num>(3)</num><intro><p>If at any time—</p></intro><level class="para1"><num>(a)</num><intro><p>the person on whom the order is served applies to the authority for the child to be admitted—</p></intro><level class="para2"><num>(i)</num><content><p>to a school not maintained by a local authority, an Academy school or an alternative provision Academy, and</p></content></level><level class="para2"><num>(ii)</num><content><p>which is different from the school named in the order,</p></content></level></level><level class="para1"><num>(b)</num><content><p>the child is offered a place at the school under arrangements made by the authority under which the fees payable in respect of the education provided at the school are to be paid by the authority under section 517, and</p></content></level><level class="para1"><num>(c)</num><content><p>the person requests the authority to amend the order by substituting that school for the one currently named,</p></content></level><wrapUp><p>the authority must comply with the request.</p></wrapUp></subsection><subsection><num>(4)</num><intro><p>If at any time—</p></intro><level class="para1"><num>(a)</num><intro><p>the person on whom the order is served applies for the child to be admitted—</p></intro><level class="para2"><num>(i)</num><content><p>to a school not maintained by a local authority, an Academy school or an alternative provision Academy,</p></content></level><level class="para2"><num>(ii)</num><content><p>which is different from the school named in the order, and</p></content></level><level class="para2"><num>(iii)</num><content><p>in respect of which no application is made under subsection <ref href="#d25e1292">(3)</ref>,</p></content></level></level><level class="para1"><num>(b)</num><content><p>the child is offered a place at the school as a result of the application,</p></content></level><level class="para1"><num>(c)</num><content><p>the school is suitable to the child’s age, ability and aptitude and to any special educational needs the child may have, and</p></content></level><level class="para1"><num>(d)</num><content><p>the person requests the authority to amend the order by substituting that school for the one currently named,</p></content></level><wrapUp><p>the authority must comply with the request.</p></wrapUp></subsection></section><section eId="d25e1386"><num>436P</num><heading>Revocation of school attendance order</heading><subsection><num>(1)</num><content><p>This section applies where a school attendance order made by a local authority under section <ref href="#d25e353">436I</ref> is in force in respect of a child.</p></content></subsection><subsection eId="d25e1399"><num>(2)</num><intro><p>The local authority must revoke the order if—</p></intro><level class="para1"><num>(a)</num><content><p>the order was served following a preliminary notice under section <ref href="#d25e96">436H</ref> in which the only condition cited was condition B,</p></content></level><level class="para1" eId="d25e1414"><num>(b)</num><content><p>the local authority is no longer conducting enquiries or taking action in respect of the child as mentioned in section <ref href="#d25e96">436H</ref><ref href="#d25e151">(5)</ref><ref href="#d25e157">(a)</ref>, and</p></content></level><level class="para1" eId="d25e1427"><num>(c)</num><content><p>the local authority is not aware of any other enquiries being made under <ref eId="c00486" href="https://www.legislation.gov.uk/ukpga/1989/41/section/47">section 47</ref> of the <ref eId="c00487" href="https://www.legislation.gov.uk/ukpga/1989/41/contents">Children Act 1989</ref> or of any other action being taken under <ref eId="c00488" href="https://www.legislation.gov.uk/ukpga/1989/41/section/47">section 47</ref><ref eId="c00489" href="https://www.legislation.gov.uk/ukpga/1989/41/section/47">(8)</ref> of <ref eId="c00490" href="https://www.legislation.gov.uk/ukpga/1989/41/contents">that Act</ref>, or which has been taken during the period of five years ending with the date that the order was made, in respect of the child.</p></content></level></subsection><subsection eId="d25e1447"><num>(3)</num><intro><p>The person on whom the order is served may at any time request the local authority to revoke the order on the ground that arrangements have been made—</p></intro><level class="para1" eId="d25e1453"><num>(a)</num><intro><p>for the child to receive suitable education otherwise than at a school, where the order was served—</p></intro><level class="para2"><num>(i)</num><content><p>as a result of the person failing to satisfy the local authority that the child is receiving suitable education, or</p></content></level><level class="para2"><num>(ii)</num><content><p>as a result of the person failing to satisfy the local authority both that the child is receiving suitable education and that it is in the best interests of the child to receive education otherwise than by regular attendance at school, where subsection <ref href="#d25e1399">(2)</ref><ref href="#d25e1414">(b)</ref> and <ref href="#d25e1427">(c)</ref> applies;</p></content></level></level><level class="para1" eId="d25e1479"><num>(b)</num><content><p>for the child to receive education, otherwise than at a school, that is in their best interests, where the order was served as a result of the person failing to satisfy the local authority that it is in the best interests of the child to receive education otherwise than by regular attendance at school.</p></content></level></subsection><subsection><num>(4)</num><content><p>The authority must comply with a request under subsection <ref href="#d25e1447">(3)</ref>, unless the authority is of the opinion that the arrangements mentioned in <ref href="#d25e1447">subsection (3)</ref><ref href="#d25e1453">(a)</ref> or <ref href="#d25e1479">(b)</ref>, or both, as the case may be, have not been made for the child.</p></content></subsection><subsection eId="d25e1502"><num>(5)</num><intro><p>If a person is aggrieved by a refusal of a local authority in England to comply with a request under subsection <ref href="#d25e1447">(3)</ref>—</p></intro><level class="para1"><num>(a)</num><content><p>the person may refer the question to the Secretary of State, and</p></content></level><level class="para1" eId="d25e1517"><num>(b)</num><content><p>the Secretary of State must give such direction determining the question as the Secretary of State considers appropriate.</p></content></level></subsection><subsection eId="d25e1523"><num>(6)</num><intro><p>If a person is aggrieved by a refusal of a local authority in Wales to comply with a request under subsection <ref href="#d25e1447">(3)</ref>—</p></intro><level class="para1"><num>(a)</num><content><p>the person may refer the question to the Welsh Ministers, and</p></content></level><level class="para1" eId="d25e1538"><num>(b)</num><content><p>the Welsh Ministers must give such direction determining the question as the Welsh Ministers consider appropriate.</p></content></level></subsection><subsection><num>(7)</num><intro><p>Where the child is one for whom the local authority maintains an EHC plan—</p></intro><level class="para1"><num>(a)</num><content><p>if the name of a school or other institution is specified in the EHC plan, subsection <ref href="#d25e1447">(3)</ref> does not apply;</p></content></level><level class="para1"><num>(b)</num><content><p>if the name of a school or other institution is not specified in the EHC plan, a direction under subsection <ref href="#d25e1502">(5)</ref><ref href="#d25e1517">(b)</ref> may require the authority to make such amendments in the plan as the Secretary of State considers necessary or expedient in consequence of the determination.</p></content></level></subsection><subsection><num>(8)</num><intro><p>Where the child is one for whom the local authority maintains an individual development plan—</p></intro><level class="para1"><num>(a)</num><content><p>if the name of a school or other institution is specified in the plan, subsection <ref href="#d25e1447">(3)</ref> does not apply;</p></content></level><level class="para1"><num>(b)</num><content><p>if the name of a school or other institution is not specified in the plan, a direction under subsection <ref href="#d25e1523">(6)</ref><ref href="#d25e1538">(b)</ref> may require the authority to make such amendments in the plan as the Welsh Ministers consider necessary or expedient in consequence of the determination.</p></content></level></subsection></section><section eId="d25e1599"><num>436Q</num><heading>Offence of failure to comply with school attendance order</heading><subsection eId="d25e1603"><num>(1)</num><content><p>If a person on whom a school attendance order under section <ref href="#d25e353">436I</ref> is served fails to comply with the requirements of the order, the person is guilty of an offence.</p></content></subsection><subsection><num>(2)</num><intro><p>Subsection <ref href="#d25e1603">(1)</ref> does not apply if—</p></intro><level class="para1"><num>(a)</num><content><p>the person proves that arrangements have been made for the child to receive suitable education otherwise than at a school, where the order was served as a result of the person failing to satisfy the local authority that the child is receiving suitable education,</p></content></level><level class="para1"><num>(b)</num><content><p>the person proves that arrangements have been made for the child to receive education, otherwise than at a school, that is in their best interests, where the order was served as a result of the person failing to satisfy the local authority that it is in the best interests of the child to receive education otherwise than by regular attendance at school,</p></content></level><level class="para1"><num>(c)</num><content><p>section <ref href="#d25e96">436H</ref><ref href="#d25e151">(5)</ref><ref href="#d25e157">(a)</ref> is no longer met in respect of the child, where the order was served following a preliminary notice under section <ref href="#d25e96">436H</ref> which cited only condition B, or</p></content></level><level class="para1"><num>(d)</num><intro><p>both—</p></intro><level class="para2"><num>(i)</num><content><p>the person proves that arrangements have been made for the child to receive suitable education otherwise than at a school, and</p></content></level><level class="para2"><num>(ii)</num><content><p>section <ref href="#d25e96">436H</ref><ref href="#d25e151">(5)</ref><ref href="#d25e157">(a)</ref> is no longer met in respect of the child,</p></content></level><wrapUp><p>where the order was served following a preliminary notice under section <ref href="#d25e96">436H</ref> which cited condition B and another condition.</p></wrapUp></level></subsection><subsection eId="d25e1679"><num>(3)</num><content><p>The reference in subsection <ref href="#d25e1603">(1)</ref> to failure to comply with the requirements of a school attendance order includes causing a child to cease to be registered at the school named in the school attendance order.</p></content></subsection><subsection><num>(4)</num><intro><p>Subsection <ref href="#d25e1679">(3)</ref> does not apply in circumstances where—</p></intro><level class="para1"><num>(a)</num><content><p>the school has, pursuant to section <ref href="#d25e616">436J</ref>, <ref href="#d25e708">436K</ref> or <ref href="#d25e1241">436O</ref>, ceased to be the school named in the school attendance order, or</p></content></level><level class="para1"><num>(b)</num><content><p>the school attendance order has been revoked pursuant to section <ref href="#d25e1386">436P</ref>.</p></content></level></subsection><subsection><num>(5)</num><intro><p>A person who—</p></intro><level class="para1"><num>(a)</num><content><p>fails to comply with the requirements of a school attendance order under section <ref href="#d25e353">436I</ref> by not causing a child to become a registered pupil at the school named in the order, and</p></content></level><level class="para1"><num>(b)</num><content><p>is convicted of an offence under this section in respect of the failure,</p></content></level><wrapUp><p>may be found guilty of an offence under this section again if the failure continues.</p></wrapUp></subsection><subsection eId="d25e1744"><num>(6)</num><content><p>If, in proceedings for an offence under this section, the person is acquitted, the court may direct that the school attendance order ceases to be in force.</p></content></subsection><subsection><num>(7)</num><content><p>A direction under subsection <ref href="#d25e1744">(6)</ref> does not affect the duty of the local authority to take further action under section <ref href="#d25e353">436I</ref> if at any time the authority is of the opinion that, having regard to any change of circumstances, it is expedient to do so.</p></content></subsection><subsection eId="d25e1762"><num>(8)</num><content><p>A person who commits an offence under this section is liable on summary conviction to imprisonment for a term not exceeding the maximum term for summary offences or a fine not exceeding level 4 on the standard scale (or both).</p></content></subsection><subsection><num>(9)</num><intro><p>In <ref href="#d25e1762">subsection (8)</ref>, “<term refersTo="#term-the-maximum-term-for-summary-offences">the maximum term for summary offences</term>” means—</p></intro><level class="para1"><num>(a)</num><content><p>if the offence is committed before the time when <ref eId="c00491" href="https://www.legislation.gov.uk/ukpga/2003/44/section/281">section 281</ref><ref eId="c00492" href="https://www.legislation.gov.uk/ukpga/2003/44/section/281">(5)</ref> of the <ref eId="c00493" href="https://www.legislation.gov.uk/ukpga/2003/44/contents">Criminal Justice Act 2003</ref> comes into force, six months;</p></content></level><level class="para1"><num>(b)</num><content><p>if the offence is committed after that time, 51 weeks.</p></content></level></subsection></section><section><num>436R</num><heading>References to “Academy school” and “Academy arrangements”</heading><subsection><num>(1)</num><content><p>In sections <ref href="#d25e353">436I</ref> and <ref href="#d25e750">436L</ref> to <ref href="#d25e1241">436O</ref>, a reference to an Academy school includes a reference to a city technology college and a city college for the technology of the arts.</p></content></subsection><subsection><num>(2)</num><content><p>The reference in section <ref href="#d25e915">436M</ref> to Academy arrangements includes a reference to an agreement under section 482.</p></content></subsection></section><section
