href="https://www.legislation.gov.uk/ukpga/1996/56/contents">Education Act 1996</ref>, after <ref eId="c00389" href="https://www.legislation.gov.uk/ukpga/1996/56/part/10/chapter/2">Chapter 2</ref> insert—<quotedStructure startQuote="“" endQuote="”" uk:context="body" uk:docName="ukpga" ukl:TargetClass="primary" ukl:TargetSubClass="unknown" ukl:Context="main" ukl:Format="double"><chapter><num>Chapter 2A</num><heading>Guidance on mobile phones etc: schools in England</heading><section eId="d25e112"><num>550C</num><heading>Guidance on use of mobile phones etc in schools in England</heading><subsection eId="d25e116"><num>(1)</num><content><p>The appropriate person for a school in England must have regard to guidance described in subsection <ref href="#d25e125">(2)</ref> in exercising functions in relation to the conduct of the school.</p></content></subsection><subsection eId="d25e125"><num>(2)</num><intro><p>The guidance referred to in subsection <ref href="#d25e116">(1)</ref> is guidance issued from time to time by the Secretary of State about registered pupils at schools having mobile phones and other personal interactive communication devices with them, and using them—</p></intro><level class="para1"><num>(a)</num><content><p>during school hours, and</p></content></level><level class="para1"><num>(b)</num><content><p>on school premises.</p></content></level></subsection><subsection><num>(3)</num><content><p>Subsections <ref href="#d25e158">(4)</ref> to <ref href="#d25e218">(6)</ref> apply for the purposes of this section.</p></content></subsection><subsection eId="d25e158"><num>(4)</num><intro><p>“<term refersTo="#term-appropriate-person">Appropriate person</term>” means—</p></intro><level class="para1"><num>(a)</num><intro><p>for the following kinds of school, the head teacher—</p></intro><level class="para2"><num>(i)</num><content><p>a community, foundation or voluntary school;</p></content></level><level class="para2"><num>(ii)</num><content><p>a community or foundation special school;</p></content></level><level class="para2"><num>(iii)</num><content><p>a maintained nursery school;</p></content></level><level class="para2"><num>(iv)</num><content><p>a pupil referral unit;</p></content></level><level class="para2"><num>(v)</num><content><p>a school approved by the Secretary of State under section 342 (approval of non-maintained special schools);</p></content></level></level><level class="para1"><num>(b)</num><content><p>for any other kind of school, the proprietor.</p></content></level></subsection><subsection><num>(5)</num><content><p>“<term refersTo="#term-school-hours">School hours</term>”, in relation to a school, means any time between the start of the first school session on a school day and the end of the last school session on the same day.</p></content></subsection><subsection eId="d25e218"><num>(6)</num><content><p>References to mobile phones and other personal interactive communication devices do not include references to devices provided by or on behalf of the appropriate person for a school for use by registered pupils.</p></content></subsection></section></chapter></quotedStructure></mod></p></content></subsection><subsection eId="section-36-2"><num>(2)</num><content><p><mod>In <ref eId="c00390" href="https://www.legislation.gov.uk/ukpga/2006/40/section/89">section 89</ref> of the <ref eId="c00391" href="https://www.legislation.gov.uk/ukpga/2006/40/contents">Education and Inspections Act 2006</ref> (determination by head teacher of behaviour policy), after <ref eId="c00392" href="https://www.legislation.gov.uk/ukpga/2006/40/section/89">subsection (6)</ref> insert—<quotedStructure startQuote="“" endQuote="”" uk:context="body" uk:docName="ukpga" ukl:TargetClass="primary" ukl:TargetSubClass="unknown" ukl:Context="main" ukl:Format="double"><subsection><num>(7)</num><content><p>If a notification or guidance given under section 88(2)(b) to the head teacher of a relevant school in England is inconsistent with guidance to which head teachers of relevant schools in England are required to have regard by section <ref href="#d25e112">550C</ref> of EA 1996 (guidance on use of mobile phones etc), the duty under subsection (2)(b) does not apply to the extent of the
