breakfast club provision in primary schools in England</heading><content><p><mod>After <ref eId="c00307" href="https://www.legislation.gov.uk/ukpga/1996/56/section/551A">section 551A</ref> of the <ref eId="c00308" href="https://www.legislation.gov.uk/ukpga/1996/56/contents">Education Act 1996</ref> insert—<quotedStructure startQuote="“" endQuote="”" uk:context="body" uk:docName="ukpga" ukl:TargetClass="primary" ukl:TargetSubClass="unknown" ukl:Context="main" ukl:Format="double"><hcontainer name="crossheading" ukl:Name="Pblock"><heading>Breakfast clubs</heading><section eId="d28e89"><num>551B</num><heading>Free breakfast club provision in primary schools in England</heading><subsection eId="d28e93"><num>(1)</num><content><p>The appropriate authority of a relevant school in England must secure that breakfast club provision is available, free of charge, for all qualifying primary pupils at the school.</p></content></subsection><subsection eId="d28e99"><num>(2)</num><intro><p>“<term refersTo="#term-breakfast-club-provision">Breakfast club provision</term>” means—</p></intro><level class="para1"><num>(a)</num><content><p>the provision of childcare for a period of at least 30 minutes ending immediately before the start of the first school session on each school day, and</p></content></level><level class="para1" eId="d28e114"><num>(b)</num><content><p>the provision of breakfast before the start of the first school session on each school day.</p></content></level></subsection><subsection><num>(3)</num><content><p>The references in <ref href="#d28e99">subsection (2)</ref> to the provision of childcare and breakfast are to their provision on the school premises or on suitable premises in the vicinity of the school premises.</p></content></subsection><subsection><num>(4)</num><intro><p>The duty under <ref href="#d28e93">subsection (1)</ref> does not apply in relation to a relevant school on any school day in which—</p></intro><level class="para1"><num>(a)</num><content><p>there is only one school session, and</p></content></level><level class="para1"><num>(b)</num><content><p>that session begins in the afternoon.</p></content></level></subsection><subsection><num>(5)</num><content><p>Food and drink provided pursuant to <ref href="#d28e99">subsection (2)</ref><ref href="#d28e114">(b)</ref> may, subject to the applicable food standards duty, take such form as the appropriate authority thinks fit.</p></content></subsection><subsection><num>(6)</num><intro><p>In this section and sections <ref href="#d28e323">551C</ref> and <ref href="#d28e438">551D</ref>—</p></intro><hcontainer name="definition"><intro><p>“<term refersTo="#term-the-appropriate-authority">the appropriate authority</term>” means—</p></intro><level class="para1"><num>(a)</num><content><p>in relation to an Academy school, an alternative provision Academy or a non-maintained special school, the proprietor;</p></content></level><level class="para1"><num>(b)</num><content><p>in relation to a maintained school, the governing body;</p></content></level><level class="para1"><num>(c)</num><content><p>in relation to a pupil referral unit, the local authority which maintains the unit;</p></content></level></hcontainer><hcontainer name="definition"><intro><p>“<term refersTo="#term-qualifying-primary-pupil">qualifying primary pupil</term>”, in relation to a relevant school, means a junior pupil who is a registered pupil at the school and—</p></intro><level class="para1"><num>(a)</num><content><p>is of compulsory school age, or</p></content></level><level class="para1"><num>(b)</num><content><p>is not of compulsory school age but is in reception at the school;</p></content></level></hcontainer><hcontainer name="definition"><intro><p>“<term refersTo="#term-relevant-school">relevant school</term>” means—</p></intro><level class="para1"><num>(a)</num><content><p>an Academy school,</p></content></level><level class="para1"><num>(b)</num><content><p>an alternative provision Academy,</p></content></level><level class="para1"><num>(c)</num><content><p>a maintained school,</p></content></level><level class="para1"><num>(d)</num><content><p>a non-maintained special school, or</p></content></level><level class="para1"><num>(e)</num><content><p>a pupil referral unit,</p></content></level><wrapUp><p>other than where established in a hospital.</p></wrapUp></hcontainer></subsection><subsection><num>(7)</num><intro><p>In this section—</p></intro><hcontainer name="definition"><intro><p>“<term refersTo="#term-the-applicable-food-standards-duty">the applicable food standards duty</term>” means—</p></intro><level class="para1"><num>(a)</num><content><p>the duty imposed by section 114A(4) of SSFA 1998 (including as applied in relation to a non-maintained special school by regulations under section 342(4)(a) of this Act), or</p></content></level><level class="para1"><num>(b)</num><content><p>in relation to an Academy school or an alternative provision Academy, a duty contained in Academy arrangements relating to the school that is equivalent to the duty imposed by section 114A(4) of SSFA 1998 (see <ref href="#">section 512C</ref> of this Act);</p></content></level></hcontainer><hcontainer name="definition"><content><p>“<term refersTo="#term-childcare">childcare</term>” has the meaning given by <ref eId="c00309" href="https://www.legislation.gov.uk/ukpga/2006/21/section/18">section 18</ref> of the <ref eId="c00310" href="https://www.legislation.gov.uk/ukpga/2006/21/contents">Childcare Act 2006</ref>;</p></content></hcontainer><hcontainer name="definition"><intro><p>“<term refersTo="#term-maintained-school">maintained school</term>” means—</p></intro><level class="para1"><num>(a)</num><content><p>a community, foundation or voluntary school, or</p></content></level><level class="para1"><num>(b)</num><content><p>a community or foundation special school;</p></content></level></hcontainer><hcontainer name="definition"><content><p>“<term refersTo="#term-non-maintained-special-school">non-maintained special school</term>” has the meaning given by section 337A;</p></content></hcontainer><hcontainer name="definition"><content><p>“<term refersTo="#term-reception">reception</term>” means a year group in which the majority of children will, in the school year, attain the age of 5;</p></content></hcontainer><hcontainer name="definition"><content><p>“<term refersTo="#term-ssfa-1998">SSFA 1998</term>” means the School Standards and Framework Act 1998.</p></content></hcontainer></subsection></section><section eId="d28e323"><num>551C</num><heading>Power to exempt schools from duty under <ref href="#d28e89">section 551B</ref><ref href="#d28e93">(1)</ref></heading><subsection eId="d28e327"><num>(1)</num><content><p>The Secretary of State may, on an application made by the appropriate authority of a relevant school, by notice given to the appropriate authority designate the school as one to which the duty under <ref href="#d28e89">section 551B</ref><ref href="#d28e93">(1)</ref> does not apply.</p></content></subsection><subsection><num>(2)</num><intro><p>Before making an application under <ref href="#d28e327">subsection (1)</ref>, the appropriate authority of a relevant school must consult—</p></intro><level class="para1"><num>(a)</num><content><p>parents of qualifying primary pupils at the school, and</p></content></level><level class="para1"><num>(b)</num><content><p>the local authority for the area in which the school is situated.</p></content></level></subsection><subsection><num>(3)</num><content><p>An application under <ref href="#d28e327">subsection (1)</ref> must be made in accordance with such requirements as may be prescribed.</p></content></subsection><subsection><num>(4)</num><intro><p>The Secretary of State may designate a relevant school under <ref href="#d28e327">subsection (1)</ref> only if satisfied that requiring the appropriate authority to discharge the duty under <ref href="#d28e89">section 551B</ref><ref href="#d28e93">(1)</ref>—</p></intro><level class="para1"><num>(a)</num><content><p>would seriously prejudice the efficient use of resources, or</p></content></level><level class="para1"><num>(b)</num><content><p>would be contrary to the best interests of qualifying primary pupils at the school,</p></content></level><wrapUp><p>having regard to the particular circumstances of the school or of qualifying primary pupils at the school or any other relevant factor.</p></wrapUp></subsection><subsection><num>(5)</num><content><p>A designation under <ref href="#d28e327">subsection (1)</ref> has effect for the period specified in the notice under that subsection (and the period may be indefinite).</p></content></subsection><subsection><num>(6)</num><content><p>A designation under <ref href="#d28e327">subsection (1)</ref> may be varied or revoked by a further designation.</p></content></subsection><subsection><num>(7)</num><intro><p>The Secretary of State must—</p></intro><level class="para1"><num>(a)</num><content><p>keep a list of relevant schools in relation to which a designation under <ref href="#d28e327">subsection (1)</ref> has effect, and</p></content></level><level class="para1"><num>(b)</num><content><p>make the list publicly available.</p></content></level></subsection></section><section eId="d28e438"><num>551D</num><heading>Guidance in connection with breakfast club provision</heading><subsection><num>(1)</num><intro><p>The Secretary of State must issue guidance to the appropriate authorities of relevant schools in England with respect to—</p></intro><level class="para1"><num>(a)</num><content><p>the discharge of the duty imposed on those appropriate authorities by <ref href="#d28e89">section 551B</ref><ref href="#d28e93">(1)</ref>;</p></content></level><level class="para1"><num>(b)</num><content><p>applications for a designation under <ref href="#d28e323">section 551C</ref><ref href="#d28e327">(1)</ref>;</p></content></level><level class="para1"><num>(c)</num><content><p>the exercise by the Secretary of State of the power conferred by <ref href="#d28e323">section 551C</ref><ref href="#d28e327">(1)</ref>.</p></content></level></subsection><subsection><num>(2)</num><intro><p>The appropriate authority of a relevant school in England must have regard to guidance issued under this section in connection with—</p></intro><level class="para1"><num>(a)</num><content><p>the discharge of the duty under <ref href="#d28e89">section 551B</ref><ref href="#d28e93">(1)</ref>;</p></content></level><level class="para1"><num>(b)</num><content><p>the making of an application for a designation under <ref href="#d28e323">section 551C</ref><ref href="#d28e327">(1)</ref>.</p></content></level></subsection><subsection><num>(3)</num><content><p>The Secretary of State may from time to time revise guidance issued under this
