uk:target="true"><num>3</num><heading>Multi-agency child protection teams for local authority areas</heading><subsection eId="section-3-1"><num>(1)</num><content><p>The <ref eId="c00014" href="https://www.legislation.gov.uk/ukpga/2004/31/contents">Children Act 2004</ref> is amended as follows.</p></content></subsection><subsection eId="section-3-2"><num>(2)</num><content><p><mod>After <ref eId="c00015" href="https://www.legislation.gov.uk/ukpga/2004/31/section/16E">section 16E</ref> insert—<quotedStructure startQuote="“" endQuote="”" uk:context="body" uk:docName="ukpga" ukl:TargetClass="primary" ukl:TargetSubClass="unknown" ukl:Context="main" ukl:Format="double"><section eId="d25e97"><num>16EA</num><heading>Section 16E arrangements: multi-agency child protection teams</heading><subsection eId="d25e101"><num>(1)</num><content><p>Arrangements made under section 16E by the safeguarding partners for a local authority area must include the establishment of one or more multi-agency child protection teams for the area for the purpose of providing support to the local authority in connection with the discharge of its duties under <ref eId="c00016" href="https://www.legislation.gov.uk/ukpga/1989/41/section/47">section 47</ref> of the <ref eId="c00017" href="https://www.legislation.gov.uk/ukpga/1989/41/contents">Children Act 1989</ref> (duty to investigate where child at risk of significant harm).</p></content></subsection><subsection eId="d25e113"><num>(2)</num><intro><p>The support referred to in subsection <ref href="#d25e101">(1)</ref> includes—</p></intro><level class="para1"><num>(a)</num><content><p>the co-ordination of assistance for the local authority under <ref eId="c00018" href="https://www.legislation.gov.uk/ukpga/1989/41/section/47">section 47</ref><ref eId="c00019" href="https://www.legislation.gov.uk/ukpga/1989/41/section/47">(9)</ref> of the <ref eId="c00020" href="https://www.legislation.gov.uk/ukpga/1989/41/contents">Children Act 1989</ref>, and</p></content></level><level class="para1" eId="d25e136"><num>(b)</num><content><p>support of any other kind prescribed by regulations made by the Secretary of State.</p></content></level></subsection><subsection eId="d25e142"><num>(3)</num><intro><p>A multi-agency child protection team is to consist of—</p></intro><level class="para1" eId="d25e148"><num>(a)</num><content><p>at least one of each of the persons mentioned in <ref href="#d25e163">subsection (4)</ref>, and</p></content></level><level class="para1"><num>(b)</num><content><p>such other persons as the local authority considers appropriate after consulting the other safeguarding partners.</p></content></level></subsection><subsection eId="d25e163"><num>(4)</num><intro><p>The persons referred to in <ref href="#d25e142">subsection (3)</ref><ref href="#d25e148">(a)</ref> are—</p></intro><level class="para1" eId="d25e174"><num>(a)</num><content><p>a person, nominated by the local authority, with experience in education in relation to children;</p></content></level><level class="para1" eId="d25e180"><num>(b)</num><content><p>a social worker, nominated by the local authority, with experience in social work in relation to children;</p></content></level><level class="para1"><num>(c)</num><content><p>a registered health professional, nominated by an integrated care board for an area any part of which falls within the area of the local authority, with experience in the provision of healthcare in relation to children;</p></content></level><level class="para1"><num>(d)</num><intro><p>a constable or relevant police employee who—</p></intro><level class="para2"><num>(i)</num><content><p>is nominated by the chief officer of police for a police area any part of which falls within the area of the local authority, and</p></content></level><level class="para2"><num>(ii)</num><content><p>has experience in child protection.</p></content></level></level></subsection><subsection eId="d25e210"><num>(5)</num><content><p>A person may be nominated under a particular paragraph of subsection (4) only if the person satisfies any requirements prescribed by regulations made by the Secretary of State for the purposes of <ref eId="c00021" href="https://www.legislation.gov.uk/ukpga/1989/41/section/47">that paragraph</ref>.</p></content></subsection><subsection><num>(6)</num><content><p>The requirements that may be prescribed under <ref href="#d25e210">subsection (5)</ref> include, in particular, requirements relating to a person’s qualifications or their experience so far as relating to the safeguarding and promotion of the welfare of children.</p></content></subsection><subsection><num>(7)</num><content><p>Before making regulations under <ref href="#d25e113">subsection (2)</ref><ref href="#d25e136">(b)</ref> or <ref href="#d25e210">(5)</ref>, the Secretary of State must consult such persons (if any) as the Secretary of State considers appropriate.</p></content></subsection><subsection eId="d25e242"><num>(8)</num><intro><p>In this section—</p></intro><hcontainer name="definition"><intro><p>“<term refersTo="#term-registered-health-professional">registered health professional</term>” means a person on the register of one or more of the following bodies—</p></intro><level class="para1"><num>(a)</num><content><p>the General Medical Council;</p></content></level><level class="para1"><num>(b)</num><content><p>the Nursing and Midwifery Council;</p></content></level><level class="para1"><num>(c)</num><content><p>the Health and Care Professions Council;</p></content></level></hcontainer><hcontainer name="definition"><intro><p>“<term refersTo="#term-relevant-police-employee">relevant police employee</term>” means—</p></intro><level class="para1"><num>(a)</num><content><p>a person (other than a constable) who is—</p><blockList class="ordered roman parens" ukl:Name="OrderedList" ukl:Type="roman" ukl:Decoration="parens"><item><num>(i)</num><p>employed, or engaged to provide services, for the purposes of a body of constables, and</p></item><item><num>(ii)</num><p>under the direction and control of a person who has the direction and control of a body of constables, or</p></item></blockList></content></level><level class="para1"><num>(b)</num><content><p>a person who is—</p><blockList class="ordered roman parens" ukl:Name="OrderedList" ukl:Type="roman" ukl:Decoration="parens"><item><num>(i)</num><p>employed by the Common Council of the City of London in its capacity as a police authority, and</p></item><item><num>(ii)</num><p>under the direction and control of a chief officer of police;</p></item></blockList></content></level></hcontainer><hcontainer name="definition"><content><p>“<term refersTo="#term-social-worker">social worker</term>” means a person registered as a social worker in the register kept under <ref eId="c00022" href="https://www.legislation.gov.uk/ukpga/2017/16/section/39">section 39</ref><ref eId="c00023" href="https://www.legislation.gov.uk/ukpga/2017/16/section/39">(1)</ref> of the <ref eId="c00024" href="https://www.legislation.gov.uk/ukpga/2017/16/contents">Children and Social Work Act 2017</ref>.</p></content></hcontainer></subsection></section><section eId="d25e321"><num>16EB</num><heading>Multi-agency child protection teams: co-operation</heading><subsection eId="d25e325"><num>(1)</num><content><p>If the conditions in <ref href="#d25e334">subsection (2)</ref> are met, the safeguarding partners for a local authority area and a relevant agency must together draw up a memorandum setting out how the relevant agency will work with the safeguarding partners to facilitate the operation of MACPT arrangements.</p></content></subsection><subsection eId="d25e334"><num>(2)</num><intro><p>The conditions are that—</p></intro><level class="para1" eId="d25e340"><num>(a)</num><content><p>the relevant agency is designated for the purposes of this section by regulations made by the Secretary of State;</p></content></level><level class="para1"><num>(b)</num><content><p>the safeguarding partners have notified the relevant agency that it is required to work with the safeguarding partners in drawing up a memorandum under this section.</p></content></level></subsection><subsection><num>(3)</num><content><p>Before making regulations under <ref href="#d25e334">subsection (2)</ref><ref href="#d25e340">(a)</ref>, the Secretary of State must consult such persons (if any) as the Secretary of State considers appropriate.</p></content></subsection><subsection><num>(4)</num><content><p>In this section, “<term refersTo="#term-macpt-arrangements">MACPT arrangements</term>” means arrangements made by the safeguarding partners in accordance with <ref href="#d25e97">section 16EA</ref><ref href="#d25e101">(1)</ref> for the establishment of a multi-agency child protection team.</p></content></subsection></section></quotedStructure></mod></p></content></subsection><subsection eId="section-3-3"><num>(3)</num><intro><p>In <ref eId="c00025" href="https://www.legislation.gov.uk/ukpga/2004/31/section/16G">section 16G</ref> (further provision about arrangements)—</p></intro><level class="para1" eId="section-3-3-a"><num>(a)</num><content><p><mod>after <ref eId="c00026" href="https://www.legislation.gov.uk/ukpga/2004/31/section/16G">subsection (4)</ref> insert—<quotedStructure startQuote="“" endQuote="”" uk:context="body" uk:docName="ukpga" ukl:TargetClass="primary" ukl:TargetSubClass="unknown" ukl:Context="main" ukl:Format="double"><subsection eId="d25e396"><num>(4A)</num><intro><p>Where a memorandum under <ref href="#d25e321">section 16EB</ref><ref href="#d25e325">(1)</ref> has effect—</p></intro><level class="para1"><num>(a)</num><content><p>references in subsections (2) and (3) to arrangements under section 16E include references to the memorandum, and</p></content></level><level class="para1" eId="d25e413"><num>(b)</num><content><p>the safeguarding partners and the relevant agency in question must act in accordance with the memorandum.</p></content></level></subsection></quotedStructure><inline name="appendText">;</inline></mod></p></content></level><level class="para1" eId="section-3-3-b"><num>(b)</num><content><p><mod>in <ref eId="c00027" href="https://www.legislation.gov.uk/ukpga/2004/31/section/16G">subsection (6)</ref>, after “subsection (4)” insert <quotedText>“or <ref href="#d25e396">(4A)</ref><ref href="#d25e413">(b)</ref>”</quotedText>;</mod></p></content></level><level class="para1" eId="section-3-3-c"><num>(c)</num><content><p><mod>after <ref eId="c00028" href="https://www.legislation.gov.uk/ukpga/2004/31/section/16G">subsection (7)</ref> insert—<quotedStructure startQuote="“" endQuote="”" uk:context="body" uk:docName="ukpga" ukl:TargetClass="primary" ukl:TargetSubClass="unknown" ukl:Context="main" ukl:Format="double"><subsection><num>(8)</num><intro><p>Where a memorandum under <ref href="#d25e321">section 16EB</ref><ref href="#d25e325">(1)</ref> has effect, a report under subsection (7) must also include information about—</p></intro><level class="para1"><num>(a)</num><content><p>what the safeguarding partners and the relevant agency in question have done as a result of the memorandum, and</p></content></level><level class="para1"><num>(b)</num><content><p>how effective the memorandum has been in practice.</p></content></level></subsection></quotedStructure></mod></p></content></level></subsection><subsection eId="section-3-4"><num>(4)</num><intro><p>In <ref eId="c00029" href="https://www.legislation.gov.uk/ukpga/2004/31/section/16J">section 16J</ref> (combining safeguarding partner areas and delegating functions)—</p></intro><level class="para1" eId="section-3-4-a"><num>(a)</num><content><p><mod>in <ref eId="c00030" href="https://www.legislation.gov.uk/ukpga/2004/31/section/16J">subsections (1)</ref> and <ref eId="c00031" href="https://www.legislation.gov.uk/ukpga/2004/31/section/16J">(2)</ref>, after “(5)” insert <quotedText>“and <ref href="#d25e513">(6)</ref><ref href="#d25e519">(a)</ref> and <ref href="#d25e525">(b)</ref>”</quotedText>;</mod></p></content></level><level class="para1" eId="section-3-4-b"><num>(b)</num><content><p><mod>after <ref eId="c00032" href="https://www.legislation.gov.uk/ukpga/2004/31/section/16J">subsection (5)</ref> insert—<quotedStructure startQuote="“" endQuote="”" uk:context="body" uk:docName="ukpga" ukl:TargetClass="primary" ukl:TargetSubClass="unknown" ukl:Context="main" ukl:Format="double"><subsection eId="d25e513"><num>(6)</num><intro><p>Where an agreement under subsection (1) has effect—</p></intro><level class="para1" eId="d25e519"><num>(a)</num><content><p>the safeguarding partners for the local authority area must, in making MACPT arrangements for the area, ensure that any multi-agency child protection team established under the arrangements has enough people to operate effectively having regard to the size of the area to which the agreement relates and any other relevant factors,</p></content></level><level class="para1" eId="d25e525"><num>(b)</num><intro><p><ref href="#d25e97">section 16EA</ref><ref href="#d25e142">(3)</ref><ref href="#d25e148">(a)</ref> and <ref href="#d25e163">(4)</ref><ref href="#d25e174">(a)</ref> and <ref href="#d25e180">(b)</ref> has effect as if—</p></intro><level class="para2"><num>(i)</num><content><p>the reference to at least one person, nominated by the local authority, with experience in education in relation to children, and</p></content></level><level class="para2"><num>(ii)</num><content><p>the reference to at least one social worker, nominated by the local authority, with experience in social work in relation to children,</p></content></level><wrapUp><p>were a reference to at least one such person or social worker for each of the local authorities which is a safeguarding partner for the local authority area, and</p></wrapUp></level><level class="para1"><num>(c)</num><content><p>each such person or social worker is to act, for the purposes of the multi-agency child protection team to which they are nominated, only in relation to the area of the local authority which nominated them.</p></content></level></subsection><subsection><num>(7)</num><intro><p>In this section—</p></intro><hcontainer name="definition"><content><p>“<term refersTo="#term-macpt-arrangements">MACPT arrangements</term>” has the same meaning as in <ref href="#d25e321">section 16EB</ref>;</p></content></hcontainer><hcontainer name="definition"><content><p>“<term refersTo="#term-social-worker">social worker</term>” has the meaning given by <ref href="#d25e97">section 16EA</ref><ref href="#d25e242">(8)</ref>.</p></content></hcontainer></subsection></quotedStructure></mod></p></content></level></subsection><subsection eId="section-3-5"><num>(5)</num><content><p><mod>In <ref
