uk:target="true"><num>29</num><heading>Employment of children in Scotland</heading><subsection eId="section-29-1"><num>(1)</num><content><p>The <a href="https://www.legislation.gov.uk/ukpga/Edw8and1Geo6/1/37/contents">Children and Young Persons (Scotland) Act 1937</a> is amended as follows.</p></content></subsection><subsection eId="section-29-2"><num>(2)</num><content><p><mod>For <a href="https://www.legislation.gov.uk/ukpga/Edw8and1Geo6/1/37/section/28">section 28</a> substitute—<quotedStructure startQuote="“" endQuote="”" uk:context="body" uk:docName="ukpga" ukl:TargetClass="primary" ukl:TargetSubClass="unknown" ukl:Context="main" ukl:Format="double"><section eId="d25e97"><num>28</num><heading>Restrictions on employment of children</heading><subsection eId="d25e101"><num>(1)</num><intro><p>A child may not be employed to work—</p></intro><level class="para1"><num>(a)</num><content><p>so long as the child is under the age of 14 (subject to regulations under <ref href="#d25e188">subsection (2)</ref>);</p></content></level><level class="para1"><num>(b)</num><content><p>to do any work other than light work;</p></content></level><level class="para1"><num>(c)</num><content><p>to do work of a description specified in regulations made by the Scottish Ministers;</p></content></level><level class="para1"><num>(d)</num><content><p>before 7.00 a.m. or after 8.00 p.m. on any day;</p></content></level><level class="para1"><num>(e)</num><intro><p>on any day on which the child is required to attend school—</p></intro><level class="para2"><num>(i)</num><content><p>for more than one hour before the start of school hours,</p></content></level><level class="para2"><num>(ii)</num><content><p>during school hours, or</p></content></level><level class="para2"><num>(iii)</num><content><p>for more than two hours in total in the day;</p></content></level></level><level class="para1"><num>(f)</num><content><p>for more than 12 hours in any week in which the child is required to attend school;</p></content></level><level class="para1"><num>(g)</num><content><p>for more than eight hours or, if the child is under 15, for more than five hours in any day on which the child is not required to attend school;</p></content></level><level class="para1"><num>(h)</num><content><p>for more than 35 hours or, if the child is under 15, for more than 25 hours in any week in which the child is not required to attend school;</p></content></level><level class="para1"><num>(i)</num><content><p>for more than four hours in any day without a break of one hour;</p></content></level><level class="para1"><num>(j)</num><content><p>at any time in a year unless at that time a person employing the child is satisfied that the child has had, or could still have, a period of at least two consecutive weeks without employment during a period in the year in which the child is not required to attend school.</p></content></level></subsection><subsection eId="d25e188"><num>(2)</num><content><p>The Scottish Ministers may by regulations authorise the employment of children aged 13 to do specified descriptions of light work.</p></content></subsection><subsection eId="d25e194"><num>(3)</num><content><p>A child may not be employed to work except in accordance with a permit (a “child employment permit”) granted by a local authority on an application made in accordance with regulations made by the Scottish Ministers.</p></content></subsection><subsection eId="d25e200"><num>(4)</num><intro><p>The Scottish Ministers may by regulations—</p></intro><level class="para1" eId="d25e206"><num>(a)</num><content><p>make provision in relation to child employment permits;</p></content></level><level class="para1"><num>(b)</num><content><p>provide that <ref href="#d25e194">subsection (3)</ref> does not apply in specified cases or circumstances;</p></content></level><level class="para1"><num>(c)</num><content><p>make provision about the keeping of records.</p></content></level></subsection><subsection><num>(5)</num><intro><p>The provision that may be made in reliance on <ref href="#d25e200">subsection (4)</ref><ref href="#d25e206">(a)</ref> includes provision—</p></intro><level class="para1"><num>(a)</num><content><p>authorising a local authority to request such information as the authority considers appropriate, or to require a child to have a medical examination, for the purpose of enabling the authority to determine an application;</p></content></level><level class="para1"><num>(b)</num><content><p>requiring a local authority to have regard to specified matters when determining an application;</p></content></level><level class="para1"><num>(c)</num><content><p>for the grant of a child employment permit subject to conditions determined by a local authority;</p></content></level><level class="para1"><num>(d)</num><content><p>requiring a child employment permit to contain specified information;</p></content></level><level class="para1"><num>(e)</num><content><p>authorising a local authority to vary, suspend or revoke a child employment permit in specified circumstances;</p></content></level><level class="para1"><num>(f)</num><intro><p>about appeals against—</p></intro><level class="para2"><num>(i)</num><content><p>a decision to reject an application, or</p></content></level><level class="para2"><num>(ii)</num><content><p>the revocation of a child employment permit;</p></content></level></level><level class="para1"><num>(g)</num><content><p>imposing requirements on persons employing children (including requirements to produce child employment permits for inspection);</p></content></level><level class="para1"><num>(h)</num><content><p>requiring or authorising a local authority, in specified circumstances, to disclose information about a child employment permit to another local authority in Scotland, to a local authority in England or to a local authority in Wales.</p></content></level></subsection><subsection><num>(6)</num><intro><p>The Scottish Ministers may by regulations make provision (subject to <ref href="#d25e101">subsection (1)</ref> and regulations under <ref href="#d25e188">subsection (2)</ref>)—</p></intro><level class="para1"><num>(a)</num><content><p>specifying the number of hours in each day, or in each week, for which children may be employed, and the times of day at which they may be employed;</p></content></level><level class="para1"><num>(b)</num><content><p>specifying the intervals to be allowed to children for meals and breaks, when in employment;</p></content></level><level class="para1"><num>(c)</num><content><p>about entitlement to leave;</p></content></level><level class="para1"><num>(d)</num><content><p>specifying other conditions to be met in relation to the employment of children.</p></content></level></subsection><subsection><num>(7)</num><intro><p>Nothing in this section, or in regulations made under any provision of this section, prevents a child from doing anything—</p></intro><level class="para1"><num>(a)</num><content><p>under the authority of a licence granted under this Part, or</p></content></level><level class="para1"><num>(b)</num><content><p>in a case where by virtue of <ref eId="c00295" href="https://www.legislation.gov.uk/ukpga/1963/37/section/37">subsection (3)</ref> of <ref eId="c00296" href="https://www.legislation.gov.uk/ukpga/1963/37/section/37">section 37</ref> of the <ref eId="c00297" href="https://www.legislation.gov.uk/ukpga/1963/37/contents">Children and Young Persons Act 1963</ref> no licence under <ref eId="c00298" href="https://www.legislation.gov.uk/ukpga/1963/37/section/37">that section</ref> is required for the child to do it.</p></content></level></subsection><subsection><num>(8)</num><intro><p>In this section—</p></intro><hcontainer name="definition"><intro><p>“<term refersTo="#term-light-work">light work</term>” means work which, on account of the inherent nature of the tasks which it involves and the particular conditions under which they are performed—</p></intro><level class="para1"><num>(a)</num><content><p>is not likely to be harmful to the safety, health or development of children, and</p></content></level><level class="para1"><num>(b)</num><content><p>is not such as to be harmful to their education (through attendance at school or otherwise) as required by <ref eId="c00299" href="https://www.legislation.gov.uk/ukpga/1980/44/section/30">section 30</ref> of the <ref eId="c00300" href="https://www.legislation.gov.uk/ukpga/1980/44/contents">Education (Scotland) Act 1980</ref> or to their participation in work experience in accordance with <ref eId="c00301" href="https://www.legislation.gov.uk/ukpga/1980/44/section/123">section 123</ref> of <ref eId="c00302" href="https://www.legislation.gov.uk/ukpga/1980/44/contents">that Act</ref>, or their capacity to benefit from the education received or the experience gained (as the case may be);</p></content></level></hcontainer><hcontainer name="definition"><content><p>“<term refersTo="#term-local-authority-in-england">local authority in England</term>” and “<term refersTo="#term-local-authority-in-wales">local authority in Wales</term>” have the same meaning as in the <ref eId="c00303" href="https://www.legislation.gov.uk/ukpga/1996/56/contents">Education Act 1996</ref> (see section 579(1) of that Act);</p></content></hcontainer><hcontainer name="definition"><content><p>“<term refersTo="#term-specified">specified</term>”, in relation to regulations made under any provision of this section, means specified in the regulations;</p></content></hcontainer><hcontainer name="definition"><content><p>“<term refersTo="#term-week">week</term>” means any period of seven consecutive days;</p></content></hcontainer><hcontainer name="definition"><content><p>“<term refersTo="#term-year">year</term>” means a period of 12 months beginning with 1 January.</p></content></hcontainer></subsection></section><section><num>28A</num><heading>Regulations under <ref href="#d25e97">section 28</ref>: further provision</heading><subsection><num>(1)</num><intro><p>Regulations under <ref href="#d25e97">section 28</ref> may—</p></intro><level class="para1"><num>(a)</num><content><p>make different provision for different purposes or areas;</p></content></level><level class="para1"><num>(b)</num><content><p>make provision subject to exceptions;</p></content></level><level class="para1"><num>(c)</num><content><p>make transitional or saving provision.</p></content></level></subsection><subsection><num>(2)</num><intro><p>Regulations under <ref href="#d25e97">section 28</ref> may provide for the processing of information in accordance with the regulations not to be in breach of—</p></intro><level class="para1"><num>(a)</num><content><p>any obligation of confidence owed by the person processing the information, or</p></content></level><level class="para1"><num>(b)</num><content><p>any other restriction on the processing of information (however imposed).</p></content></level></subsection><subsection><num>(3)</num><content><p>Regulations under <ref href="#d25e97">section 28</ref> are subject to the negative procedure (see <ref eId="c00304" href="https://www.legislation.gov.uk/asp/2010/10/part/2">Part 2</ref> of the <ref eId="c00305" href="https://www.legislation.gov.uk/asp/2010/10/contents">Interpretation and Legislative Reform (Scotland) Act 2010 (asp 10)</ref>).</p></content></subsection><subsection><num>(4)</num><content><p>In this section “<term refersTo="#term-processing">processing</term>” has the same meaning as in the <ref eId="c00306" href="https://www.legislation.gov.uk/ukpga/2018/12/contents">Data Protection Act 2018</ref> (see section 3 of that Act).</p></content></subsection></section></quotedStructure></mod></p></content></subsection><subsection eId="section-29-3"><num>(3)</num><content><p><mod>In <a
