<Title>Restrictions on employment of children</Title>

<Pnumber>18</Pnumber>
<P1para>
<P2 id="p05062">
<Pnumber>1</Pnumber>
<P2para>
<Text>A child may not be employed to work—</Text>
<P3>
<Pnumber>a</Pnumber>
<P3para>
<Text>so long as the child is under the age of 14 (subject to regulations under <InternalLink Ref="p05119">subsection (2)</InternalLink>);</Text>
</P3para>
</P3>
<P3>
<Pnumber>b</Pnumber>
<P3para>
<Text>to do any work other than light work;</Text>
</P3para>
</P3>
<P3>
<Pnumber>c</Pnumber>
<P3para>
<Text>to do work of a description specified in regulations made by the appropriate national authority;</Text>
</P3para>
</P3>
<P3>
<Pnumber>d</Pnumber>
<P3para>
<Text>before 7.00 a.m. or after 8.00 p.m. on any day;</Text>
</P3para>
</P3>
<P3>
<Pnumber>e</Pnumber>
<P3para>
<Text>on any day on which the child is required to attend school—</Text>
<P4>
<Pnumber>i</Pnumber>
<P4para>
<Text>for more than one hour before the start of school hours,</Text>
</P4para>
</P4>
<P4>
<Pnumber>ii</Pnumber>
<P4para>
<Text>during school hours, or</Text>
</P4para>
</P4>
<P4>
<Pnumber>iii</Pnumber>
<P4para>
<Text>for more than two hours in total in the day;</Text>
</P4para>
</P4>
</P3para>
</P3>
<P3>
<Pnumber>f</Pnumber>
<P3para>
<Text>for more than 12 hours in any week in which the child is required to attend school;</Text>
</P3para>
</P3>
<P3>
<Pnumber>g</Pnumber>
<P3para>
<Text>for more than eight hours or, if the child is under 15, for more than five hours in any day on which the child is not required to attend school;</Text>
</P3para>
</P3>
<P3>
<Pnumber>h</Pnumber>
<P3para>
<Text>for more than 35 hours or, if the child is under 15, for more than 25 hours in any week in which the child is not required to attend school;</Text>
</P3para>
</P3>
<P3>
<Pnumber>i</Pnumber>
<P3para>
<Text>for more than four hours in any day without a break of one hour;</Text>
</P3para>
</P3>
<P3>
<Pnumber>j</Pnumber>
<P3para>
<Text>at any time in a year unless at that time a person employing the child is satisfied that the child has had, or could still have, a period of at least two consecutive weeks without employment during a period in the year in which the child is not required to attend school.</Text>
</P3para>
</P3>
</P2para>
</P2>
<P2 id="p05119">
<Pnumber>2</Pnumber>
<P2para>
<Text>The appropriate national authority may by regulations authorise the employment of children aged 13 to do specified descriptions of light work.</Text>
</P2para>
</P2>
<P2 id="p05123">
<Pnumber>3</Pnumber>
<P2para>
<Text>A child may not be employed to work except in accordance with a permit (a “child employment permit”) granted by a local authority on an application made in accordance with regulations made by the appropriate national authority.</Text>
</P2para>
</P2>
<P2 id="p05127">
<Pnumber>4</Pnumber>
<P2para>
<Text>The appropriate national authority may by regulations—</Text>
<P3 id="p05130">
<Pnumber>a</Pnumber>
<P3para>
<Text>make provision in relation to child employment permits;</Text>
</P3para>
</P3>
<P3>
<Pnumber>b</Pnumber>
<P3para>
<Text>provide that <InternalLink Ref="p05123">subsection (3)</InternalLink> does not apply in specified cases or circumstances;</Text>
</P3para>
</P3>
<P3>
<Pnumber>c</Pnumber>
<P3para>
<Text>make provision about the keeping of records.</Text>
</P3para>
</P3>
</P2para>
</P2>
<P2>
<Pnumber>5</Pnumber>
<P2para>
<Text>The provision that may be made in reliance on <InternalLink Ref="p05127">subsection (4)</InternalLink><InternalLink Ref="p05130">(a)</InternalLink> includes provision—</Text>
<P3>
<Pnumber>a</Pnumber>
<P3para>
<Text>authorising a local authority to request such information as the authority considers appropriate, or to require a child to have a medical examination, for the purpose of enabling the authority to determine an application;</Text>
</P3para>
</P3>
<P3>
<Pnumber>b</Pnumber>
<P3para>
<Text>requiring a local authority to have regard to specified matters when determining an application;</Text>
</P3para>
</P3>
<P3>
<Pnumber>c</Pnumber>
<P3para>
<Text>for the grant of a child employment permit subject to conditions determined by a local authority;</Text>
</P3para>
</P3>
<P3>
<Pnumber>d</Pnumber>
<P3para>
<Text>requiring a child employment permit to contain specified information;</Text>
</P3para>
</P3>
<P3>
<Pnumber>e</Pnumber>
<P3para>
<Text>authorising a local authority to vary, suspend or revoke a child employment permit in specified circumstances;</Text>
</P3para>
</P3>
<P3>
<Pnumber>f</Pnumber>
<P3para>
<Text>about appeals against—</Text>
<P4>
<Pnumber>i</Pnumber>
<P4para>
<Text>a decision to reject an application, or</Text>
</P4para>
</P4>
<P4>
<Pnumber>ii</Pnumber>
<P4para>
<Text>the revocation of a child employment permit;</Text>
</P4para>
</P4>
</P3para>
</P3>
<P3>
<Pnumber>g</Pnumber>
<P3para>
<Text>imposing requirements on persons employing children (including requirements to produce child employment permits for inspection);</Text>
</P3para>
</P3>
<P3>
<Pnumber>h</Pnumber>
<P3para>
<Text>requiring or authorising a local authority, in specified circumstances, to disclose information about a child employment permit to another local authority in England or Wales or to a local authority in Scotland.</Text>
</P3para>
</P3>
</P2para>
</P2>
<P2>
<Pnumber>6</Pnumber>
<P2para>
<Text>The appropriate national authority may by regulations make provision (subject to <InternalLink Ref="p05062">subsection (1)</InternalLink> and regulations under <InternalLink Ref="p05119">subsection (2)</InternalLink>)—</Text>
<P3>
<Pnumber>a</Pnumber>
<P3para>
<Text>specifying the number of hours in each day, or in each week, for which children may be employed, and the times of day at which they may be employed;</Text>
</P3para>
</P3>
<P3>
<Pnumber>b</Pnumber>
<P3para>
<Text>specifying the intervals to be allowed to children for meals and breaks, when in employment;</Text>
</P3para>
</P3>
<P3>
<Pnumber>c</Pnumber>
<P3para>
<Text>about entitlement to leave;</Text>
</P3para>
</P3>
<P3>
<Pnumber>d</Pnumber>
<P3para>
<Text>specifying other conditions to be met in relation to the employment of children.</Text>
</P3para>
</P3>
</P2para>
</P2>
<P2>
<Pnumber>7</Pnumber>
<P2para>
<Text>Nothing in this section, or in regulations made under any provision of this section, prevents a child from doing anything—</Text>
<P3>
<Pnumber>a</Pnumber>
<P3para>
<Text>under the authority of a licence granted under this Part, or</Text>
</P3para>
</P3>
<P3>
<Pnumber>b</Pnumber>
<P3para>
<Text>in a case where by virtue of <Citation URI="https://www.legislation.gov.uk/ukpga/1963/37/section/37" id="c00277" Class="UnitedKingdomPublicGeneralAct" Year="1963" Number="37" SectionRef="section-37">subsection (3)</Citation> of <Citation URI="https://www.legislation.gov.uk/ukpga/1963/37/section/37" id="c00278" Class="UnitedKingdomPublicGeneralAct" Year="1963" Number="37" SectionRef="section-37">section 37</Citation> of the <Citation URI="https://www.legislation.gov.uk/ukpga/1963/37/contents" id="c00279" Class="UnitedKingdomPublicGeneralAct" Year="1963" Number="37" SectionRef="contents">Children and Young Persons Act 1963</Citation> no licence under <Citation URI="https://www.legislation.gov.uk/ukpga/1963/37/section/37" id="c00280" Class="UnitedKingdomPublicGeneralAct" Year="1963" Number="37" SectionRef="section-37">that section</Citation> is required for the child to do it.</Text>

<Pnumber>8</Pnumber>
<P2para>
<Text>In this section—</Text>
<UnorderedList Class="Definition" Decoration="none">
<ListItem>
<Para>
<Text>“<Term>appropriate national authority</Term>” means—</Text>
<OrderedList Type="alpha" Decoration="parens">
<ListItem>
<Para>
<Text>in relation to England, the Secretary of State;</Text>
</Para>
</ListItem>
<ListItem>
<Para>
<Text>in relation to Wales, the Welsh Ministers;</Text>
</Para>
</ListItem>
</OrderedList>
</Para>
</ListItem>
<ListItem>
<Para>
<Text>“<Term>light work</Term>” means work which, on account of the inherent nature of the tasks which it involves and the particular conditions under which they are performed—</Text>
<OrderedList Type="alpha" Decoration="parens">
<ListItem>
<Para>
<Text>is not likely to be harmful to the safety, health or development of children, and</Text>
</Para>
</ListItem>
<ListItem>
<Para>
<Text>is not such as to be harmful to their education (through attendance at school or otherwise) as required by <Citation URI="https://www.legislation.gov.uk/ukpga/1996/56/section/7" id="c00281" Class="UnitedKingdomPublicGeneralAct" Year="1996" Number="56" SectionRef="section-7">section 7</Citation> of the <Citation URI="https://www.legislation.gov.uk/ukpga/1996/56/contents" id="c00282" Class="UnitedKingdomPublicGeneralAct" Year="1996" Number="56" SectionRef="contents">Education Act 1996</Citation> or to their participation in work experience in accordance with <Citation URI="https://www.legislation.gov.uk/ukpga/1996/56/section/560" id="c00283" Class="UnitedKingdomPublicGeneralAct" Year="1996" Number="56" SectionRef="section-560">section 560</Citation> of <Citation URI="https://www.legislation.gov.uk/ukpga/1996/56/contents" id="c00284" Class="UnitedKingdomPublicGeneralAct" Year="1996" Number="56" SectionRef="contents">that Act</Citation>, or their capacity to benefit from the education received or the experience gained (as the case may be);</Text>

<Text>“<Term>local authority in Scotland</Term>” means a council constituted under <Citation URI="https://www.legislation.gov.uk/ukpga/1994/39/section/2" id="c00285" Class="UnitedKingdomPublicGeneralAct" Year="1994" Number="39" SectionRef="section-2">section 2</Citation> of the <Citation URI="https://www.legislation.gov.uk/ukpga/1994/39/contents" id="c00286" Class="UnitedKingdomPublicGeneralAct" Year="1994" Number="39" SectionRef="contents">Local Government etc. (Scotland) Act 1994</Citation>;</Text>
</Para>

<Text>“<Term>specified</Term>”, in relation to regulations made under any provision of this section, means specified in the regulations;</Text>
</Para>
</ListItem>
<ListItem>
<Para>
<Text>“<Term>week</Term>” means any period of seven consecutive days;</Text>
</Para>
</ListItem>
<ListItem>
<Para>
<Text>“<Term>year</Term>” means a period of 12 months beginning with 1 January.</Text>
</Para>

<Title>Regulations under <InternalLink Ref="p05060">section 18</InternalLink>: further provision</Title>
<P1>
<Pnumber>18A</Pnumber>
<P1para>
<P2>
<Pnumber>1</Pnumber>
<P2para>
<Text>Regulations under <InternalLink Ref="p05060">section 18</InternalLink> may—</Text>
<P3>
<Pnumber>a</Pnumber>
<P3para>
<Text>make different provision for different purposes or areas;</Text>
</P3para>
</P3>
<P3>
<Pnumber>b</Pnumber>
<P3para>
<Text>make provision subject to exceptions;</Text>
</P3para>
</P3>
<P3>
<Pnumber>c</Pnumber>
<P3para>
<Text>make transitional or saving provision.</Text>
</P3para>
</P3>
</P2para>
</P2>
<P2>
<Pnumber>2</Pnumber>
<P2para>
<Text>Regulations under <InternalLink Ref="p05060">section 18</InternalLink> may provide for the processing of information in accordance with the regulations not to be in breach of—</Text>
<P3>
<Pnumber>a</Pnumber>
<P3para>
<Text>any obligation of confidence owed by the person processing the information, or</Text>
</P3para>
</P3>
<P3>
<Pnumber>b</Pnumber>
<P3para>
<Text>any other restriction on the processing of information (however imposed).</Text>
</P3para>
</P3>
</P2para>
</P2>
<P2>
<Pnumber>3</Pnumber>
<P2para>
<Text>Regulations under <InternalLink Ref="p05060">section 18</InternalLink> made by the Secretary of State are to be made by statutory instrument.</Text>
</P2para>
</P2>
<P2>
<Pnumber>4</Pnumber>
<P2para>
<Text>Regulations under section <InternalLink Ref="p05060">18</InternalLink> made by the Welsh Ministers are to be made by Welsh statutory instrument.</Text>
</P2para>
</P2>
<P2>
<Pnumber>5</Pnumber>
<P2para>
<Text>A statutory instrument containing regulations made by the Secretary of State under <InternalLink Ref="p05060">section 18</InternalLink> is subject to annulment in pursuance of a resolution of either House of Parliament.</Text>
</P2para>
</P2>
<P2>
<Pnumber>6</Pnumber>
<P2para>
<Text>Regulations made by the Welsh Ministers under <InternalLink Ref="p05060">section 18</InternalLink> are subject to the Senedd annulment procedure (see <Citation URI="https://www.legislation.gov.uk/anaw/2019/4/section/37E" id="c00287" Class="WelshNationalAssemblyAct" Year="2019" Number="4" SectionRef="section-37E">section 37E</Citation> of the <Citation URI="https://www.legislation.gov.uk/anaw/2019/4/contents" id="c00288" Class="WelshNationalAssemblyAct" Year="2019" Number="4" SectionRef="contents">Legislation (Wales) Act 2019 (anaw 4)</Citation>).</Text>
