class="para1"><num>(b)</num><content><p>monetary penalties imposed by the Secretary of State under <ref class="schGroup7"><heading>Interpretation</heading><paragraph class="schProv1"><num>1</num><subparagraph><num>(1)</num><intro><p>In this Schedule “<term refersTo="#term-monetary-penalty">monetary penalty</term>” means—</p></intro><level class="para1"><num>(a)</num><content><p>a monetary penalty under section <ref href="#">30ZC</ref>;</p></content></level><level class="para1"><num>(b)</num><content><p>a monetary penalty under section <ref href="#">30ZM</ref>.</p></content></level></subparagraph><subparagraph><num>(2)</num><intro><p>In this Schedule the “<term refersTo="#term-relevant-authority">relevant authority</term>” means—</p></intro><level class="para1"><num>(a)</num><content><p>in relation to a monetary penalty under section <ref href="#">30ZC</ref>, the CIECSS;</p></content></level><level class="para1"><num>(b)</num><content><p>in relation to a monetary penalty under section <ref href="#">30ZM</ref>, the Secretary of State.</p></content></level></subparagraph></paragraph></hcontainer><hcontainer name="crossheading" class="schGroup7"><heading>Notice of intention to impose monetary penalty</heading><paragraph class="schProv1"><num>2</num><subparagraph><num>(1)</num><content><p>Before imposing a monetary penalty on a person, the relevant authority must serve on the person a notice (a “notice of intention”) stating that the relevant authority proposes to impose the penalty.</p></content></subparagraph><subparagraph eId="d25e230"><num>(2)</num><intro><p>A notice of intention must—</p></intro><level class="para1"><num>(a)</num><content><p>state the reasons for the proposal to impose a penalty;</p></content></level><level class="para1"><num>(b)</num><content><p>state the amount of the proposed penalty;</p></content></level><level class="para1" eId="d25e248"><num>(c)</num><content><p>inform the person that the person may, before the end of the period of 28 days beginning with the day on which the notice is served on the person, make written representations to the relevant authority about the proposal.</p></content></level></subparagraph><subparagraph><num>(3)</num><content><p>If at any time after the notice of intention is served the relevant authority decides not to impose a monetary penalty on the person, the relevant authority must serve on the person a notice to that effect.</p></content></subparagraph><subparagraph><num>(4)</num><intro><p>The relevant authority may not decide to impose a monetary penalty on the person before—</p></intro><level class="para1"><num>(a)</num><content><p>the relevant authority has considered any written representations made before the end of the period mentioned in sub-paragraph <ref href="#d25e230">(2)</ref><ref href="#d25e248">(c)</ref>,</p></content></level><level class="para1"><num>(b)</num><content><p>the person has notified the relevant authority in writing that they do not intend to make representations, or</p></content></level><level class="para1"><num>(c)</num><content><p>the period mentioned in sub-paragraph <ref href="#d25e230">(2)</ref><ref href="#d25e248">(c)</ref> has ended without any written representations having been made.</p></content></level></subparagraph></paragraph></hcontainer><hcontainer name="crossheading" class="schGroup7"><heading>Imposition of monetary penalty</heading><paragraph eId="d25e297" class="schProv1"><num>3</num><subparagraph><num>(1)</num><content><p>If the relevant authority decides to impose a monetary penalty on the person, the relevant authority must (subject to sub-paragraphs <ref href="#d25e313">(2)</ref> and <ref href="#d25e341">(3)</ref>) serve on the person a notice to that effect.</p></content></subparagraph><subparagraph eId="d25e313"><num>(2)</num><intro><p>A notice imposing a penalty under section <ref href="#">30ZC</ref><ref href="#">(1)</ref> or <ref href="#">30ZM</ref> (penalty for failure to comply with requirements) may not be served—</p></intro><level class="para1"><num>(a)</num><content><p>more than 6 months after the relevant authority first has sufficient evidence to be satisfied on the balance of probabilities that the failure to comply occurred, or</p></content></level><level class="para1"><num>(b)</num><content><p>more than 3 years after the failure to comply occurred,</p></content></level><wrapUp><p>(whichever is earlier).</p></wrapUp></subparagraph><subparagraph eId="d25e341"><num>(3)</num><content><p>A notice imposing a penalty under section <ref href="#">30ZC</ref><ref href="#">(2)</ref> (penalty for act or omission constituting an offence) may not be served after the end of the period within which proceedings could be brought for the offence in question (see section 29).</p></content></subparagraph><subparagraph eId="d25e352"><num>(4)</num><intro><p>A notice imposing a penalty (a “penalty notice”) must—</p></intro><level class="para1"><num>(a)</num><content><p>state the reasons for imposing the penalty;</p></content></level><level class="para1"><num>(b)</num><content><p>state the amount of the penalty;</p></content></level><level class="para1"><num>(c)</num><content><p>state how the penalty may be paid;</p></content></level><level class="para1" eId="d25e376"><num>(d)</num><content><p>state the period within which the penalty must be paid;</p></content></level><level class="para1"><num>(e)</num><content><p>inform the person of the right to appeal under paragraph <ref href="#d25e554">6</ref>;</p></content></level><level class="para1"><num>(f)</num><content><p>explain the consequences of non-payment.</p></content></level></subparagraph><subparagraph><num>(5)</num><content><p>The period specified under sub-paragraph <ref href="#d25e352">(4)</ref><ref href="#d25e376">(d)</ref> must not be less than 28 days beginning with the day on which the penalty notice is served on the person.</p></content></subparagraph><subparagraph><num>(6)</num><intro><p>The person must pay the penalty before the end of—</p></intro><level class="para1"><num>(a)</num><content><p>the period specified under sub-paragraph <ref href="#d25e352">(4)</ref><ref href="#d25e376">(d)</ref>, or</p></content></level><level class="para1"><num>(b)</num><content><p>if an appeal is brought under paragraph <ref href="#d25e554">6</ref>, the period of 28 days beginning with the day on which the appeal is withdrawn or finally determined (if the penalty notice then has effect).</p></content></level></subparagraph><subparagraph><num>(7)</num><content><p>Where a penalty notice has been served on a person, the relevant authority may cancel or vary it by serving on the person a notice to that effect (but may not vary it so as to increase the amount of the penalty or reduce the period within which it may be paid).</p></content></subparagraph></paragraph></hcontainer><hcontainer name="crossheading" class="schGroup7"><heading>Amount of monetary penalty</heading><paragraph eId="d25e443" class="schProv1"><num>4</num><subparagraph><num>(1)</num><content><p>Subject to sub-paragraphs <ref href="#d25e459">(2)</ref> to <ref href="#d25e484">(4)</ref>, a monetary penalty may be of any amount.</p></content></subparagraph><subparagraph eId="d25e459"><num>(2)</num><content><p>The Secretary of State may by regulations set the maximum amount of a penalty imposed under section <ref href="#">30ZC</ref><ref href="#">(1)</ref> or <ref href="#">30ZM</ref> (penalty for failure to comply with requirements).</p></content></subparagraph><subparagraph><num>(3)</num><content><p>The amount of a penalty imposed by the CIECSS under section <ref href="#">30ZC</ref><ref href="#">(2)</ref> (penalty for act or omission constituting an offence) may not exceed the amount of the fine that may be imposed on summary conviction for the offence in question (where that is not an unlimited amount).</p></content></subparagraph><subparagraph eId="d25e484"><num>(4)</num><intro><p>In deciding the amount of a monetary penalty, the relevant authority must consider—</p></intro><level class="para1"><num>(a)</num><content><p>the nature and seriousness of the failure to comply, or the act or omission, for which the penalty is to be imposed;</p></content></level><level class="para1"><num>(b)</num><content><p>whether there are any mitigating or aggravating factors;</p></content></level><level class="para1"><num>(c)</num><content><p>whether the person has previously failed to comply with, or committed offences under, this Part or regulations made under it;</p></content></level><level class="para1"><num>(d)</num><content><p>the likely impact of the monetary penalty on the person.</p></content></level></subparagraph></paragraph></hcontainer><hcontainer name="crossheading" class="schGroup7"><heading>Interest and recovery</heading><paragraph class="schProv1"><num>5</num><subparagraph><num>(1)</num><content><p>This paragraph applies if all or part of a monetary penalty is unpaid by the time when it is required to be paid.</p></content></subparagraph><subparagraph><num>(2)</num><content><p>The unpaid amount of the penalty for the time being carries interest at the rate specified in <a href="https://www.legislation.gov.uk/ukpga/Vict/1-2/110/section/17">section 17</a> of the <a href="https://www.legislation.gov.uk/ukpga/Vict/1-2/110/contents">Judgments Act 1838</a> (and does not also carry interest as a judgment debt under that section).</p></content></subparagraph><subparagraph><num>(3)</num><content><p>The total amount of interest imposed must not exceed the amount of the penalty.</p></content></subparagraph><subparagraph><num>(4)</num><content><p>The unpaid amount of the penalty and any unpaid interest may be recovered by the relevant authority as a debt.</p></content></subparagraph></paragraph></hcontainer><hcontainer name="crossheading" class="schGroup7"><heading>Right of appeal against imposition of monetary penalty</heading><paragraph eId="d25e554" class="schProv1"><num>6</num><subparagraph><num>(1)</num><intro><p>A person on whom a penalty notice has been served may appeal to the Tribunal against the decision of the relevant authority—</p></intro><level class="para1"><num>(a)</num><content><p>to impose the penalty;</p></content></level><level class="para1"><num>(b)</num><content><p>as to the amount of the penalty.</p></content></level></subparagraph><subparagraph><num>(2)</num><content><p>An appeal under this paragraph may not be brought after the end of the period of 28 days beginning with the day on which the penalty notice was served on the person.</p></content></subparagraph><subparagraph><num>(3)</num><intro><p>On an appeal under this paragraph the Tribunal may—</p></intro><level class="para1"><num>(a)</num><content><p>confirm the penalty notice,</p></content></level><level class="para1"><num>(b)</num><content><p>direct that the penalty notice ceases to have effect, or</p></content></level><level class="para1"><num>(c)</num><content><p>in the case of an appeal against the amount of the penalty, vary the amount.</p></content></level></subparagraph></paragraph></hcontainer></hcontainer></quotedStructure></mod></p></content></subsection><subsection eId="section-19-4"><num>(4)</num><content><p><mod>In <ref eId="c00195" href="https://www.legislation.gov.uk/ukpga/2000/14/section/118">section 118</ref> (orders and regulations), in subsection <ref href="#">(2B)</ref> (inserted by section <ref href="#">16</ref><ref href="#">(3)</ref>) after paragraph <ref href="#">(b)</ref> (inserted by section <ref href="#">17</ref><ref href="#">(4)</ref>) insert—<quotedStructure startQuote="“"
