eId="c00119" href="https://www.legislation.gov.uk/ukpga/1989/41/contents">Children Act 1989</ref> is amended as follows.</p></content></subsection><subsection eId="section-12-2"><num>(2)</num><content><p><mod>After section <ref href="#">22I</ref> (inserted by section <ref href="#">5</ref>) insert—<quotedStructure startQuote="“" endQuote="”" uk:context="body" uk:docName="ukpga" ukl:TargetClass="primary" ukl:TargetSubClass="unknown" ukl:Context="main" ukl:Format="double"><hcontainer name="crossheading" ukl:Name="Pblock"><heading>Accommodation of looked after children: regional co-operation arrangements</heading><section eId="d25e103"><num>22J</num><heading>Accommodation of looked after children: regional co-operation arrangements</heading><subsection eId="d25e107"><num>(1)</num><content><p>The Secretary of State may give directions requiring two or more local authorities to make regional co-operation arrangements.</p></content></subsection><subsection eId="d25e113"><num>(2)</num><intro><p>“<term refersTo="#term-regional-co-operation-arrangements">Regional co-operation arrangements</term>” means arrangements—</p></intro><level class="para1"><num>(a)</num><content><p>for the local authorities to carry out their strategic accommodation functions jointly,</p></content></level><level class="para1" eId="d25e128"><num>(b)</num><content><p>for the local authorities’ strategic accommodation functions to be carried out by one of the local authorities on behalf of the others, or</p></content></level><level class="para1" eId="d25e134"><num>(c)</num><content><p>for a body corporate to support the local authorities in carrying out their strategic accommodation functions.</p></content></level></subsection><subsection eId="d25e140"><num>(3)</num><intro><p>A local authority’s “strategic accommodation functions” are—</p></intro><level class="para1"><num>(a)</num><content><p>assessing current and future requirements for the accommodation of children being looked after by the local authority,</p></content></level><level class="para1"><num>(b)</num><content><p>developing and publishing strategies for meeting those requirements,</p></content></level><level class="para1"><num>(c)</num><content><p>commissioning the provision of accommodation for children being looked after by the local authority,</p></content></level><level class="para1"><num>(d)</num><content><p>recruiting prospective local authority foster parents and supporting local authority foster parents,</p></content></level><level class="para1"><num>(e)</num><content><p>developing, or facilitating the development of, new provision for the accommodation of children being looked after by the local authority, and</p></content></level><level class="para1" eId="d25e176"><num>(f)</num><content><p>any other functions relating to a local authority’s duties under section 22A, 22C or 22G that are specified in regulations made by the Secretary of State.</p></content></level></subsection><subsection><num>(4)</num><intro><p>Before making regulations under subsection <ref href="#d25e140">(3)</ref><ref href="#d25e176">(f)</ref> the Secretary of State must consult—</p></intro><level class="para1"><num>(a)</num><content><p>local authorities, and</p></content></level><level class="para1"><num>(b)</num><content><p>such other persons (if any) as the Secretary of State considers appropriate.</p></content></level></subsection><subsection><num>(5)</num><intro><p>A direction under subsection <ref href="#d25e107">(1)</ref> may—</p></intro><level class="para1"><num>(a)</num><content><p>specify which of the three kinds of regional co-operation arrangements the local authorities must make, or</p></content></level><level class="para1"><num>(b)</num><content><p>specify more than one kind of regional co-operation arrangement (“the permitted arrangements”) and require the local authorities to determine which of the permitted arrangements to make.</p></content></level></subsection><subsection><num>(6)</num><intro><p>A direction which requires or permits the local authorities to make regional co-operation arrangements of the kind in subsection <ref href="#d25e113">(2)</ref><ref href="#d25e128">(b)</ref> may—</p></intro><level class="para1"><num>(a)</num><content><p>specify which local authority is to carry out the strategic accommodation functions, or</p></content></level><level class="para1"><num>(b)</num><content><p>require the local authorities to determine which of them is to carry out the strategic accommodation functions.</p></content></level></subsection><subsection><num>(7)</num><intro><p>A direction which requires or permits the local authorities to make regional co-operation arrangements of the kind in subsection <ref href="#d25e113">(2)</ref><ref href="#d25e134">(c)</ref> may—</p></intro><level class="para1"><num>(a)</num><content><p>specify the kind of body corporate with which the arrangements may be made;</p></content></level><level class="para1"><num>(b)</num><content><p>require a body corporate to be established for the purposes of the arrangements.</p></content></level></subsection><subsection><num>(8)</num><intro><p>If a direction requires a body corporate to be established, it may—</p></intro><level class="para1"><num>(a)</num><content><p>specify which of the local authorities is to establish the body corporate, or</p></content></level><level class="para1"><num>(b)</num><content><p>require the local authorities to determine which of them is to establish it.</p></content></level></subsection><subsection><num>(9)</num><content><p>The Secretary of State may give a direction requiring a local authority to terminate arrangements made in accordance with a direction under subsection <ref href="#d25e107">(1)</ref>.</p></content></subsection><subsection><num>(10)</num><content><p>A direction under this section may make different provision for different purposes.</p></content></subsection></section></hcontainer></quotedStructure></mod></p></content></subsection><subsection eId="section-12-3"><num>(3)</num><intro><p>In <ref eId="c00120" href="https://www.legislation.gov.uk/ukpga/1989/41/section/104">section 104</ref> (regulations and orders)—</p></intro><level class="para1" eId="section-12-3-a"><num>(a)</num><content><p><mod>in <ref eId="c00121" href="https://www.legislation.gov.uk/ukpga/1989/41/section/104">subsection (2)</ref>, after “(3AB),” insert <quotedText>“<ref href="#d25e354">(3AC)</ref>,”</quotedText>;</mod></p></content></level><level class="para1" eId="section-12-3-b"><num>(b)</num><content><p><mod>in <ref eId="c00122" href="https://www.legislation.gov.uk/ukpga/1989/41/section/104">subsection (3A)</ref>, after “(3AB),” insert <quotedText>“<ref
