<Text>After <Citation URI="https://www.legislation.gov.uk/ukpga/1996/52/section/213A" id="c00093" Class="UnitedKingdomPublicGeneralAct" Year="1996" Number="52" SectionRef="section-213A">section 213A</Citation> of the <Citation URI="https://www.legislation.gov.uk/ukpga/1996/52/contents" id="c00094" Class="UnitedKingdomPublicGeneralAct" Year="1996" Number="52" SectionRef="contents">Housing Act 1996</Citation> (homelessness: co-operation in certain cases involving children) insert— </Text>

<Title>Duty of local housing authority in England to notify in certain cases involving children</Title>
<P1>
<Pnumber>213AA</Pnumber>
<P1para>
<P2 id="p01946">
<Pnumber>1</Pnumber>
<P2para>
<Text>This section applies where a local housing authority in England secures that accommodation is available for occupation by a child, in response to an application for assistance under this Part, unless securing that such accommodation is available means the authority ceases to be subject to the duty under section 193.</Text>
</P2para>
</P2>
<P2 id="p01950">
<Pnumber>2</Pnumber>
<P2para>
<Text>Except as provided in subsection <InternalLink Ref="p01964">(3)</InternalLink>, the authority must ask the parent of the child—</Text>
<P3 id="p01954">
<Pnumber>a</Pnumber>
<P3para>
<Text>to agree to the authority notifying each relevant body applicable to the child that accommodation has been secured for the child as mentioned in <InternalLink Ref="p01946">subsection (1)</InternalLink>, and</Text>
</P3para>
</P3>
<P3 id="p01959">
<Pnumber>b</Pnumber>
<P3para>
<Text>if that agreement is given, to provide the authority with information about those bodies to enable the authority to identify each relevant body applicable to the child.</Text>
</P3para>
</P3>
</P2para>
</P2>
<P2 id="p01964">
<Pnumber>3</Pnumber>
<P2para>
<Text>If the child—</Text>
<P3>
<Pnumber>a</Pnumber>
<P3para>
<Text>is 16 or 17 years old,</Text>
</P3para>
</P3>
<P3>
<Pnumber>b</Pnumber>
<P3para>
<Text>is living independently from their parents, and</Text>
</P3para>
</P3>
<P3>
<Pnumber>c</Pnumber>
<P3para>
<Text>is the applicant for assistance within the meaning of section 183(2),</Text>
</P3para>
</P3>
<Text>the authority must ask the child as provided in <InternalLink Ref="p01950">subsection (2)</InternalLink><InternalLink Ref="p01954">(a)</InternalLink> and <InternalLink Ref="p01959">(b)</InternalLink>.</Text>
</P2para>
</P2>
<P2 id="p01986">
<Pnumber>4</Pnumber>
<P2para>
<Text>If the parent or child (as the case may be) agrees to the authority making the notification mentioned in <InternalLink Ref="p01950">subsection (2)</InternalLink><InternalLink Ref="p01954">(a)</InternalLink>, the authority must take reasonable steps to notify each relevant body applicable to the child within 14 days beginning with the latest of—</Text>
<P3>
<Pnumber>a</Pnumber>
<P3para>
<Text>the day on which the authority receives agreement,</Text>
</P3para>
</P3>
<P3>
<Pnumber>b</Pnumber>
<P3para>
<Text>the day on which the information about the relevant body is provided to the authority, and</Text>
</P3para>
</P3>
<P3>
<Pnumber>c</Pnumber>
<P3para>
<Text>the day on which the child is placed in accommodation.</Text>
</P3para>
</P3>
</P2para>
</P2>
<P2>
<Pnumber>5</Pnumber>
<P2para>
<Text>The duties in subsections <InternalLink Ref="p01950">(2)</InternalLink> and <InternalLink Ref="p01986">(4)</InternalLink> only arise once in relation to each application for assistance under this Part.</Text>
</P2para>
</P2>
<P2>
<Pnumber>6</Pnumber>
<P2para>
<Text>In this section “<Term>relevant body</Term>” means—</Text>
<P3>
<Pnumber>a</Pnumber>
<P3para>
<Text>the general medical practice in England with which the child is registered;</Text>
</P3para>
</P3>
<P3>
<Pnumber>b</Pnumber>
<P3para>
<Text>the body in the child’s local authority area in England through which health visiting services are available to the child;</Text>
</P3para>
</P3>
<P3>
<Pnumber>c</Pnumber>
<P3para>
<Text>the appropriate authority of a relevant educational institution in England at which the child is a registered pupil or student.</Text>
</P3para>
</P3>
</P2para>
</P2>
<P2>
<Pnumber>7</Pnumber>
<P2para>
<Text>The Secretary of State may make provision by regulations for the purposes of this section—</Text>
<P3>
<Pnumber>a</Pnumber>
<P3para>
<Text>specifying any other description of body as a “relevant body”;</Text>
</P3para>
</P3>
<P3 id="p02034">
<Pnumber>b</Pnumber>
<P3para>
<Text>specifying any other institution as a relevant educational institution;</Text>
</P3para>
</P3>
<P3>
<Pnumber>c</Pnumber>
<P3para>
<Text>specifying the appropriate authority to be notified under this section in relation to an institution specified under <InternalLink Ref="p02034">paragraph (b)</InternalLink>.</Text>
</P3para>
</P3>
</P2para>
</P2>
<P2>
<Pnumber>8</Pnumber>
<P2para>
<Text>In this section—</Text>

<Para>
<Text>“<Term>appropriate authority</Term>” means—</Text>
<OrderedList Type="alpha" Decoration="parens">
<ListItem>
<Para>
<Text>in relation to an Academy, a non-maintained special school, a special post-16 institution, an independent school or a provider of post-16 education or training, the proprietor;</Text>
</Para>
</ListItem>
<ListItem>
<Para>
<Text>in relation to a school maintained by a local authority or an institution within the further education sector, the governing body;</Text>
</Para>
</ListItem>
</OrderedList>
</Para>
</ListItem>
<ListItem>
<Para>
<Text>“<Term>child</Term>” means a person under the age of 18;</Text>
</Para>
</ListItem>
<ListItem>
<Para>
<Text>“<Term>parent</Term>” in relation to a child, includes any person—</Text>

<ListItem>
<Para>
<Text>who is not a parent of the child but who has parental responsibility for the child, or</Text>
</Para>
</ListItem>
<ListItem>
<Para>
<Text>who has care of the child, disregarding any absence of the child at a hospital or boarding school or any other temporary absence;</Text>
</Para>
</ListItem>
</OrderedList>
</Para>
</ListItem>
<ListItem>
<Para>
<Text>“<Term>parental responsibility</Term>” has the meaning given by <Citation URI="https://www.legislation.gov.uk/ukpga/1989/41/section/3" id="c00095" Class="UnitedKingdomPublicGeneralAct" Year="1989" Number="41" SectionRef="section-3">section 3</Citation> of the <Citation URI="https://www.legislation.gov.uk/ukpga/1989/41/contents" id="c00096" Class="UnitedKingdomPublicGeneralAct" Year="1989" Number="41" SectionRef="contents">Children Act 1989</Citation>;</Text>
</Para>

<Para>
<Text>“<Term>proprietor</Term>” means the person or body of persons responsible for the management of the school or institution;</Text>
</Para>
</ListItem>
<ListItem>
<Para>
<Text>“<Term>relevant educational institution</Term>” means—</Text>

<Text>an Academy (as defined by <Citation URI="https://www.legislation.gov.uk/ukpga/1996/56/section/579" id="c00097" Class="UnitedKingdomPublicGeneralAct" Year="1996" Number="56" SectionRef="section-579">section 579</Citation><Citation URI="https://www.legislation.gov.uk/ukpga/1996/56/section/579" id="c00098" Class="UnitedKingdomPublicGeneralAct" Year="1996" Number="56" SectionRef="section-579">(1)</Citation> of the <Citation URI="https://www.legislation.gov.uk/ukpga/1996/56/contents" id="c00099" Class="UnitedKingdomPublicGeneralAct" Year="1996" Number="56" SectionRef="contents">Education Act 1996</Citation>) other than a secure 16-19 Academy (within the meaning of section 1B(7) of the Academies Act 2010);</Text>

<Text>a school maintained by a local authority (within the meaning of <Citation URI="https://www.legislation.gov.uk/ukpga/1998/31/section/142" id="c00100" Class="UnitedKingdomPublicGeneralAct" Year="1998" Number="31" SectionRef="section-142">section 142</Citation><Citation URI="https://www.legislation.gov.uk/ukpga/1998/31/section/142" id="c00101" Class="UnitedKingdomPublicGeneralAct" Year="1998" Number="31" SectionRef="section-142">(1)</Citation> of the <Citation URI="https://www.legislation.gov.uk/ukpga/1998/31/contents" id="c00102" Class="UnitedKingdomPublicGeneralAct" Year="1998" Number="31" SectionRef="contents">School Standards and Framework Act 1998</Citation>);</Text>

<Text>The amendment made by <InternalLink Ref="section-11" IdURI="http://www.legislation.gov.uk/id/ukpga/2026/21/section/11" DocumentURI="http://www.legislation.gov.uk/ukpga/2026/21/section/11">this section</InternalLink> does not apply in relation to a child for whom a local housing authority in England has secured accommodation in response to an application for assistance under <Citation URI="https://www.legislation.gov.uk/ukpga/1996/52/part/7" id="c00117" Class="UnitedKingdomPublicGeneralAct" Year="1996" Number="52" SectionRef="part-7">Part 7</Citation> of the <Citation URI="https://www.legislation.gov.uk/ukpga/1996/52/contents" id="c00118" Class="UnitedKingdomPublicGeneralAct" Year="1996" Number="52" SectionRef="contents">Housing Act 1996</Citation> which was made before the date on which <InternalLink Ref="section-11" IdURI="http://www.legislation.gov.uk/id/ukpga/2026/21/section/11" DocumentURI="http://www.legislation.gov.uk/ukpga/2026/21/section/11">this section</InternalLink> comes into force.</Text>
