uk:target="true"><num>11</num><heading>Children in temporary accommodation</heading><subsection eId="section-11-1"><num>(1)</num><content><p><mod>After <ref eId="c00093" href="https://www.legislation.gov.uk/ukpga/1996/52/section/213A">section 213A</ref> of the <ref eId="c00094" href="https://www.legislation.gov.uk/ukpga/1996/52/contents">Housing Act 1996</ref> (homelessness: co-operation in certain cases involving children) insert— <quotedStructure startQuote="“" endQuote="”" uk:context="body" uk:docName="ukpga" ukl:TargetClass="primary" ukl:TargetSubClass="unknown" ukl:Context="main" ukl:Format="double"><section><num>213AA</num><heading>Duty of local housing authority in England to notify in certain cases involving children</heading><subsection eId="d25e95"><num>(1)</num><content><p>This section applies where a local housing authority in England secures that accommodation is available for occupation by a child, in response to an application for assistance under this Part, unless securing that such accommodation is available means the authority ceases to be subject to the duty under section 193.</p></content></subsection><subsection eId="d25e101"><num>(2)</num><intro><p>Except as provided in subsection <ref href="#d25e125">(3)</ref>, the authority must ask the parent of the child—</p></intro><level class="para1" eId="d25e110"><num>(a)</num><content><p>to agree to the authority notifying each relevant body applicable to the child that accommodation has been secured for the child as mentioned in <ref href="#d25e95">subsection (1)</ref>, and</p></content></level><level class="para1" eId="d25e119"><num>(b)</num><content><p>if that agreement is given, to provide the authority with information about those bodies to enable the authority to identify each relevant body applicable to the child.</p></content></level></subsection><subsection eId="d25e125"><num>(3)</num><intro><p>If the child—</p></intro><level class="para1"><num>(a)</num><content><p>is 16 or 17 years old,</p></content></level><level class="para1"><num>(b)</num><content><p>is living independently from their parents, and</p></content></level><level class="para1"><num>(c)</num><content><p>is the applicant for assistance within the meaning of section 183(2),</p></content></level><wrapUp><p>the authority must ask the child as provided in <ref href="#d25e101">subsection (2)</ref><ref href="#d25e110">(a)</ref> and <ref href="#d25e119">(b)</ref>.</p></wrapUp></subsection><subsection eId="d25e159"><num>(4)</num><intro><p>If the parent or child (as the case may be) agrees to the authority making the notification mentioned in <ref href="#d25e101">subsection (2)</ref><ref href="#d25e110">(a)</ref>, the authority must take reasonable steps to notify each relevant body applicable to the child within 14 days beginning with the latest of—</p></intro><level class="para1"><num>(a)</num><content><p>the day on which the authority receives agreement,</p></content></level><level class="para1"><num>(b)</num><content><p>the day on which the information about the relevant body is provided to the authority, and</p></content></level><level class="para1"><num>(c)</num><content><p>the day on which the child is placed in accommodation.</p></content></level></subsection><subsection><num>(5)</num><content><p>The duties in subsections <ref href="#d25e101">(2)</ref> and <ref href="#d25e159">(4)</ref> only arise once in relation to each application for assistance under this Part.</p></content></subsection><subsection><num>(6)</num><intro><p>In this section “<term refersTo="#term-relevant-body">relevant body</term>” means—</p></intro><level class="para1"><num>(a)</num><content><p>the general medical practice in England with which the child is registered;</p></content></level><level class="para1"><num>(b)</num><content><p>the body in the child’s local authority area in England through which health visiting services are available to the child;</p></content></level><level class="para1"><num>(c)</num><content><p>the appropriate authority of a relevant educational institution in England at which the child is a registered pupil or student.</p></content></level></subsection><subsection><num>(7)</num><intro><p>The Secretary of State may make provision by regulations for the purposes of this section—</p></intro><level class="para1"><num>(a)</num><content><p>specifying any other description of body as a “relevant body”;</p></content></level><level class="para1" eId="d25e239"><num>(b)</num><content><p>specifying any other institution as a relevant educational institution;</p></content></level><level class="para1"><num>(c)</num><content><p>specifying the appropriate authority to be notified under this section in relation to an institution specified under <ref href="#d25e239">paragraph (b)</ref>.</p></content></level></subsection><subsection><num>(8)</num><intro><p>In this section—</p></intro><hcontainer name="definition"><intro><p>“<term refersTo="#term-appropriate-authority">appropriate authority</term>” means—</p></intro><level class="para1"><num>(a)</num><content><p>in relation to an Academy, a non-maintained special school, a special post-16 institution, an independent school or a provider of post-16 education or training, the proprietor;</p></content></level><level class="para1"><num>(b)</num><content><p>in relation to a school maintained by a local authority or an institution within the further education sector, the governing body;</p></content></level></hcontainer><hcontainer name="definition"><content><p>“<term refersTo="#term-child">child</term>” means a person under the age of 18;</p></content></hcontainer><hcontainer name="definition"><intro><p>“<term refersTo="#term-parent">parent</term>” in relation to a child, includes any person—</p></intro><level class="para1"><num>(a)</num><content><p>who is not a parent of the child but who has parental responsibility for the child, or</p></content></level><level class="para1"><num>(b)</num><content><p>who has care of the child, disregarding any absence of the child at a hospital or boarding school or any other temporary absence;</p></content></level></hcontainer><hcontainer name="definition"><content><p>“<term refersTo="#term-parental-responsibility">parental responsibility</term>” has the meaning given by <ref eId="c00095" href="https://www.legislation.gov.uk/ukpga/1989/41/section/3">section 3</ref> of the <ref eId="c00096" href="https://www.legislation.gov.uk/ukpga/1989/41/contents">Children Act 1989</ref>;</p></content></hcontainer><hcontainer name="definition"><content><p>“<term refersTo="#term-proprietor">proprietor</term>” means the person or body of persons responsible for the management of the school or institution;</p></content></hcontainer><hcontainer name="definition"><intro><p>“<term refersTo="#term-relevant-educational-institution">relevant educational institution</term>” means—</p></intro><level class="para1"><num>(a)</num><content><p>an Academy (as defined by <ref eId="c00097" href="https://www.legislation.gov.uk/ukpga/1996/56/section/579">section 579</ref><ref eId="c00098" href="https://www.legislation.gov.uk/ukpga/1996/56/section/579">(1)</ref> of the <ref eId="c00099" href="https://www.legislation.gov.uk/ukpga/1996/56/contents">Education Act 1996</ref>) other than a secure 16-19 Academy (within the meaning of section 1B(7) of the Academies Act 2010);</p></content></level><level class="para1"><num>(b)</num><content><p>a school maintained by a local authority (within the meaning of <ref eId="c00100" href="https://www.legislation.gov.uk/ukpga/1998/31/section/142">section 142</ref><ref eId="c00101" href="https://www.legislation.gov.uk/ukpga/1998/31/section/142">(1)</ref> of the <ref eId="c00102" href="https://www.legislation.gov.uk/ukpga/1998/31/contents">School Standards and Framework Act 1998</ref>);</p></content></level><level class="para1"><num>(c)</num><content><p>a non-maintained special school (within the meaning of <ref eId="c00103" href="https://www.legislation.gov.uk/ukpga/1996/56/section/337A">section 337A</ref> of the <ref eId="c00104" href="https://www.legislation.gov.uk/ukpga/1996/56/contents">Education Act 1996</ref>);</p></content></level><level class="para1"><num>(d)</num><content><p>an independent school (within the meaning of <ref eId="c00105" href="https://www.legislation.gov.uk/ukpga/1996/56/section/463">section 463</ref> of the <ref eId="c00106" href="https://www.legislation.gov.uk/ukpga/1996/56/contents">Education Act 1996</ref>);</p></content></level><level class="para1"><num>(e)</num><content><p>an institution within the further education sector (within the meaning of <ref eId="c00107" href="https://www.legislation.gov.uk/ukpga/1992/13/section/91">section 91</ref><ref eId="c00108" href="https://www.legislation.gov.uk/ukpga/1992/13/section/91">(3)</ref> of the <ref eId="c00109" href="https://www.legislation.gov.uk/ukpga/1992/13/contents">Further and Higher Education Act 1992</ref>);</p></content></level><level class="para1"><num>(f)</num><content><p>a special post-16 institution (within the meaning of <ref eId="c00110" href="https://www.legislation.gov.uk/ukpga/2014/6/section/83">section 83</ref> of the <ref eId="c00111" href="https://www.legislation.gov.uk/ukpga/2014/6/contents">Children and Families Act 2014</ref>);</p></content></level><level class="para1"><num>(g)</num><content><p>a provider of post-16 education or training that provides the kind of education or training mentioned in <ref eId="c00112" href="https://www.legislation.gov.uk/ukpga/2006/40/section/123">section 123</ref><ref eId="c00113" href="https://www.legislation.gov.uk/ukpga/2006/40/section/123">(1)</ref><ref eId="c00114" href="https://www.legislation.gov.uk/ukpga/2006/40/section/123">(d)</ref> or <ref eId="c00115" href="https://www.legislation.gov.uk/ukpga/2006/40/section/123">(g)</ref> of the <ref eId="c00116" href="https://www.legislation.gov.uk/ukpga/2006/40/contents">Education and Inspections Act 2006</ref>;</p></content></level><level class="para1"><num>(h)</num><content><p>a provider of post-16 education or training that provides education or training, other than in institutions within the further education sector, which is suitable to the requirements of persons aged 16 or over but under 19 and funded wholly or partly by the Secretary of State.</p></content></level></hcontainer></subsection></section></quotedStructure></mod></p></content></subsection><subsection eId="section-11-2"><num>(2)</num><content><p>The amendment made by <ref href="#section-11">this section</ref> does not apply in relation to a child for whom a local housing authority in England has secured accommodation in response to an application for assistance under <ref eId="c00117" href="https://www.legislation.gov.uk/ukpga/1996/52/part/7">Part 7</ref> of the <ref eId="c00118" href="https://www.legislation.gov.uk/ukpga/1996/52/contents">Housing Act 1996</ref> which was made before the date on which <ref href="#section-11">this section</ref> comes into force.</p></content></subsection></section></hcontainer></part></body></act></akomaNtoso>
