eId="section-3" uk:target="true"><num>3</num><heading>Income reduction orders</heading><subsection eId="section-3-1"><num>(1)</num><content><p><mod>In the Sentencing Code, in Part 7 (financial orders and orders relating to property), after Chapter 4 insert—<quotedStructure startQuote="“" endQuote="”" uk:context="body" uk:docName="ukpga" ukl:TargetClass="primary" ukl:TargetSubClass="unknown" ukl:Context="main" ukl:Format="double"><chapter eId="d25e92"><num>Chapter 5</num><heading>Income reduction orders</heading><section eId="d25e100"><num>161A</num><heading>Income reduction order</heading><subsection eId="d25e104"><num>(1)</num><intro><p>In this Code “<term refersTo="#term-income-reduction-order">income reduction order</term>” means an order under this Chapter that—</p></intro><level class="para1"><num>(a)</num><content><p>is made in respect of an offender for an offence, and</p></content></level><level class="para1" eId="d25e119"><num>(b)</num><content><p>requires the offender, for the period in respect of which the order has effect, to pay such percentage of the offender’s excess monthly income as is determined by the court.</p></content></level></subsection><subsection eId="d25e125"><num>(2)</num><content><p>For the purposes of subsection <ref href="#d25e104">(1)</ref><ref href="#d25e119">(b)</ref>, “<term refersTo="#term-the-offender’s-excess-monthly-income">the offender’s excess monthly income</term>” means such of the offender’s monthly income as exceeds an amount specified in regulations made by the Secretary of State.</p></content></subsection><subsection eId="d25e139"><num>(3)</num><content><p>For the purposes of subsection <ref href="#d25e125">(2)</ref>, “<term refersTo="#term-monthly-income">monthly income</term>” means monthly income after deduction of such amounts as may be specified in the regulations.</p></content></subsection><subsection><num>(4)</num><content><p>The regulations may make further provision about how the court is to determine the offender’s monthly income.</p></content></subsection><subsection><num>(5)</num><content><p>The amount specified under subsection <ref href="#d25e125">(2)</ref> must not be less than an amount equal to 170 times the hourly amount of the national minimum wage.</p></content></subsection><subsection><num>(6)</num><content><p>For further provision about determining the percentage of the offender’s excess monthly income payable under an income reduction order, see section <ref href="#d25e195">161B</ref>.</p></content></subsection><subsection><num>(7)</num><content><p>In this section “<term refersTo="#term-national-minimum-wage">national minimum wage</term>” means such single hourly rate as is for the time being specified in regulations under <ref eId="c00001" href="https://www.legislation.gov.uk/ukpga/1998/39/section/1">section 1</ref><ref eId="c00002" href="https://www.legislation.gov.uk/ukpga/1998/39/section/1">(3)</ref> of the <ref eId="c00003" href="https://www.legislation.gov.uk/ukpga/1998/39/contents">National Minimum Wage Act 1998</ref>.</p></content></subsection></section><section eId="d25e195"><num>161B</num><heading>Determining the amount payable under an income reduction order</heading><subsection eId="d25e199"><num>(1)</num><content><p>The Secretary of State must by regulations make provision about how the court is to determine the percentage of the offender’s excess monthly income payable under an income reduction order.</p></content></subsection><subsection eId="d25e205"><num>(2)</num><content><p>Provision made by regulations under subsection <ref href="#d25e199">(1)</ref> must secure that the percentage determined by the court does not exceed a specified percentage.</p></content></subsection><subsection><num>(3)</num><content><p>The percentage specified by virtue of subsection <ref href="#d25e205">(2)</ref> must not exceed twenty per cent.</p></content></subsection><subsection><num>(4)</num><intro><p>Provision made by virtue of subsection <ref href="#d25e199">(1)</ref> may include provision for the percentage to depend on (among other things)—</p></intro><level class="para1"><num>(a)</num><content><p>the offence or offences committed;</p></content></level><level class="para1"><num>(b)</num><content><p>how the offender is otherwise dealt with (including, where the offender is fined, the amount of the fine);</p></content></level><level class="para1"><num>(c)</num><content><p>the age of the offender.</p></content></level></subsection><subsection><num>(5)</num><content><p>In this section, “<term refersTo="#term-specified">specified</term>” means specified in the regulations.</p></content></subsection></section><section><num>161C</num><heading>Further provision about income reduction orders</heading><subsection eId="d25e266"><num>(1)</num><content><p>The Secretary of State may by regulations make such further provision about income reduction orders as the Secretary of State considers appropriate.</p></content></subsection><subsection><num>(2)</num><intro><p>Regulations under <ref href="#d25e266">subsection (1)</ref> may make provision about payments under an income reduction order including (among other things)—</p></intro><level class="para1"><num>(a)</num><content><p>provision about the form and manner in which payments must or may be made;</p></content></level><level class="para1"><num>(b)</num><content><p>provision for payments to be made to a specified person, or a person of a specified description;</p></content></level><level class="para1"><num>(c)</num><content><p>provision about the date by which, or period within which, payments must be made;</p></content></level><level class="para1"><num>(d)</num><content><p>provision about interest on any unpaid amounts payable under an income reduction order.</p></content></level></subsection><subsection eId="d25e305"><num>(3)</num><intro><p>Regulations under <ref href="#d25e266">subsection (1)</ref> may—</p></intro><level class="para1" eId="d25e314"><num>(a)</num><content><p>make provision for monitoring compliance with income reduction orders;</p></content></level><level class="para1" eId="d25e320"><num>(b)</num><content><p>make provision for the enforcement of income reduction orders, including provision about the recovery of any unpaid amounts under an income reduction order;</p></content></level><level class="para1"><num>(c)</num><content><p>make provision about appeals.</p></content></level></subsection><subsection><num>(4)</num><intro><p>The provision that may be made by virtue of subsection <ref href="#d25e305">(3)</ref><ref href="#d25e314">(a)</ref>and <ref href="#d25e320">(b)</ref> includes—</p></intro><level class="para1"><num>(a)</num><content><p>provision for a specified person, or a person of a specified description, to require the provision of documents or information;</p></content></level><level class="para1"><num>(b)</num><content><p>provision for a specified person, or a person of a specified description, to require the offender to attend at a place and answer questions.</p></content></level></subsection><subsection><num>(5)</num><content><p>In this section, “<term refersTo="#term-specified">specified</term>” means specified in the regulations.</p></content></subsection></section><section eId="d25e370"><num>161D</num><heading>Income reduction order: availability</heading><subsection eId="d25e374"><num>(1)</num><intro><p>An income reduction order is available to a court by or before which an offender is convicted of an offence where—</p></intro><level class="para1"><num>(a)</num><content><p>the offence is committed on or after the date on which section <ref href="#section-3">3</ref> of the Sentencing Act 2026 comes fully into force,</p></content></level><level class="para1"><num>(b)</num><content><p>the offender is aged at least 18 when convicted of the offence,</p></content></level><level class="para1" eId="d25e395"><num>(c)</num><intro><p>the court imposes a suspended sentence order in relation to—</p></intro><level class="para2"><num>(i)</num><content><p>the offence, or</p></content></level><level class="para2"><num>(ii)</num><content><p>a combination of the offence and one or more offences associated with it, and</p></content></level></level><level class="para1"><num>(d)</num><intro><p>when the sentence is imposed—</p></intro><level class="para2"><num>(i)</num><content><p>the offender’s monthly income exceeds such amount as is specified in regulations under section <ref href="#d25e100">161A</ref><ref href="#d25e125">(2)</ref>, or</p></content></level><level class="para2"><num>(ii)</num><content><p>it appears to the court that the offender’s monthly income will exceed that amount during the operational period of the suspended sentence order.</p></content></level></level></subsection><subsection><num>(2)</num><content><p>The Secretary of State may, by regulations, make provision about circumstances in which a court may not make an income reduction order.</p></content></subsection><subsection><num>(3)</num><content><p>Where an income reduction order is available, the court may make such an order whether or not it also deals with the offender for the offence in any other way.</p></content></subsection></section><section><num>161E</num><heading>Making an income reduction order</heading><subsection><num>(1)</num><intro><p>An income reduction order must specify—</p></intro><level class="para1"><num>(a)</num><content><p>the percentage of the offender’s excess monthly income payable under the order,</p></content></level><level class="para1"><num>(b)</num><content><p>the period for which the order has effect,</p></content></level><level class="para1"><num>(c)</num><content><p>the date or dates by which payments under the order must be made, and</p></content></level><level class="para1"><num>(d)</num><content><p>the person to whom payments under the order must be made.</p></content></level></subsection><subsection><num>(2)</num><content><p>The period for which the order has effect may not exceed the operational period of the suspended sentence order mentioned in section <ref href="#d25e370">161D</ref><ref href="#d25e374">(1)</ref><ref href="#d25e395">(c)</ref>.</p></content></subsection><subsection><num>(3)</num><intro><p>In determining—</p></intro><level class="para1"><num>(a)</num><content><p>whether to make an income reduction order against an offender, or</p></content></level><level class="para1"><num>(b)</num><content><p>the percentage of the offender’s excess monthly income payable under the order,</p></content></level><wrapUp><p>the court must have regard to the offender’s means, so far as they appear or are known to the court.</p></wrapUp></subsection><subsection><num>(4)</num><intro><p>Where the court considers—</p></intro><level class="para1" eId="d25e524"><num>(a)</num><intro><p>that it would be appropriate to impose both an income reduction order and one or more of—</p></intro><level class="para2" eId="d25e530"><num>(i)</num><content><p>a compensation order,</p></content></level><level class="para2"><num>(ii)</num><content><p>an unlawful profit order, or</p></content></level><level class="para2" eId="d25e542"><num>(iii)</num><content><p>a slavery and trafficking reparation order, but</p></content></level></level><level class="para1"><num>(b)</num><content><p>that the offender has insufficient means to pay both the income reduction order and appropriate amounts under such of those orders as it would be appropriate to make,</p></content></level><wrapUp><p>the court must give preference to such of the orders in paragraph <ref href="#d25e524">(a)</ref><ref href="#d25e530">(i)</ref>to <ref href="#d25e542">(iii)</ref> as it would be appropriate to make (though it may impose an income reduction order as well).</p></wrapUp></subsection><subsection><num>(5)</num><intro><p>For the effect of proceedings in relation to confiscation orders on the court’s powers in relation to income reduction orders, see the following provisions of the <ref eId="c00004" href="https://www.legislation.gov.uk/ukpga/2002/29/contents">Proceeds of Crime Act 2002</ref>—</p></intro><level class="para1"><num>(a)</num><content><p><ref eId="c00005" href="https://www.legislation.gov.uk/ukpga/2002/29/section/13">section 13</ref> (where confiscation order has been made);</p></content></level><level class="para1"><num>(b)</num><content><p><ref eId="c00006" href="https://www.legislation.gov.uk/ukpga/2002/29/section/15">section 15</ref> (where proceedings on a confiscation order have been postponed).</p></content></level></subsection><subsection><num>(6)</num><intro><p>In this section—</p></intro><hcontainer name="definition"><content><p>“<term refersTo="#term-the-operational-period">the operational period</term>” has the meaning given by section 288(2);</p></content></hcontainer><hcontainer name="definition"><content><p>“<term refersTo="#term-slavery-and-trafficking-reparation-order">slavery and trafficking reparation order</term>” means an order under <ref eId="c00007" href="https://www.legislation.gov.uk/ukpga/2015/30/section/8">section 8</ref> of the <ref eId="c00008" href="https://www.legislation.gov.uk/ukpga/2015/30/contents">Modern Slavery Act 2015</ref>;</p></content></hcontainer><hcontainer name="definition"><content><p>“<term refersTo="#term-unlawful-profit-order">unlawful profit order</term>” means an unlawful profit order under <ref eId="c00009" href="https://www.legislation.gov.uk/ukpga/2013/3/section/4">section 4</ref> of the <ref eId="c00010" href="https://www.legislation.gov.uk/ukpga/2013/3/contents">Prevention of Social Housing Fraud Act 2013</ref>.</p></content></hcontainer></subsection></section><section><num>161F</num><heading>Variation or discharge of income reduction order</heading><subsection eId="d25e636"><num>(1)</num><content><p>An income reduction order may be varied or discharged by the court that made it if, on an application by a person within <ref href="#d25e645">subsection (2)</ref>, it appears to the court, having regard to any change in the circumstances since the order was made, to be appropriate to do so.</p></content></subsection><subsection eId="d25e645"><num>(2)</num><intro><p>The persons are—</p></intro><level class="para1"><num>(a)</num><content><p>the offender;</p></content></level><level class="para1"><num>(b)</num><content><p>an officer of a provider of probation services.</p></content></level></subsection><subsection><num>(3)</num><content><p>The power to vary an order includes power to decrease the percentage of the offender’s excess monthly income payable under the order.</p></content></subsection><subsection><num>(4)</num><content><p>But the court may not exercise the power in subsection <ref href="#d25e636">(1)</ref> so as to increase the percentage payable under the order.</p></content></subsection></section><section><num>161G</num><heading>Income reduction orders: supplementary</heading><subsection eId="d25e685"><num>(1)</num><intro><p>In this Chapter—</p></intro><hcontainer name="definition"><content><p>“<term refersTo="#term-income">income</term>” means income chargeable to income tax within the meaning of the Income Tax Acts;</p></content></hcontainer><hcontainer name="definition"><content><p>“<term refersTo="#term-monthly-income">monthly income</term>” has the meaning given by section <ref href="#d25e100">161A</ref><ref href="#d25e139">(3)</ref>;</p></content></hcontainer><hcontainer name="definition"><content><p>“<term refersTo="#term-the-offender’s-excess-monthly-income">the offender’s excess monthly income</term>” has the meaning given by section <ref href="#d25e100">161A</ref><ref href="#d25e125">(2)</ref>;</p></content></hcontainer><hcontainer name="definition"><intro><p>“<term refersTo="#term-primary-legislation">primary legislation</term>” means—</p></intro><level class="para1"><num>(a)</num><content><p>an Act of Parliament,</p></content></level><level class="para1"><num>(b)</num><content><p>an Act of the Scottish Parliament,</p></content></level><level class="para1"><num>(c)</num><content><p>a Measure or Act of Senedd Cymru, or</p></content></level><level class="para1"><num>(d)</num><content><p>Northern Ireland legislation.</p></content></level></hcontainer></subsection><subsection><num>(2)</num><content><p>The Secretary of State may by regulations amend the definition of “income” in subsection <ref href="#d25e685">(1)</ref>.</p></content></subsection><subsection><num>(3)</num><content><p>Regulations under this Chapter may amend primary legislation.</p></content></subsection><subsection><num>(4)</num><content><p>Regulations under this Chapter are subject to the affirmative resolution procedure.</p></content></subsection></section></chapter></quotedStructure></mod></p></content></subsection><subsection eId="section-3-2"><num>(2)</num><content><p><mod>In Schedule 9 to the
