<Text>Regulations may require employers to—</Text>

<Text>develop and publish a plan (an “equality action plan”) showing the steps that the employers are taking in relation to their employees with regard to prescribed matters related to gender equality, and</Text>

</P3>
<P3>
<Pnumber>b</Pnumber>
<P3para>
<Text>publish prescribed information relating to the plan.</Text>
</P3para>
</P3>
</P2para>
</P2>
<P2>
<Pnumber>2</Pnumber>
<P2para>
<Text>This section does not apply to—</Text>
<P3>
<Pnumber>a</Pnumber>
<P3para>
<Text>an employer with fewer than 250 employees;</Text>
</P3para>
</P3>

<Pnumber>b</Pnumber>
<P3para>
<Text>a public authority, other than—</Text>

<Pnumber>i</Pnumber>

<Text>a public authority specified in Part 1 of Schedule 19, or</Text>

<Text>a public authority specified in Part 4 of Schedule 19 with the letter “D” included after the entry.</Text>

<Text>For the purposes of <InternalLink Ref="p07040">subsection (1)</InternalLink>, a matter is related to gender equality if it is related to advancing equality of opportunity between male and female employees.</Text>

<Pnumber>4</Pnumber>
<P2para>
<Text>Accordingly, matters related to gender equality include—</Text>
<P3>
<Pnumber>a</Pnumber>
<P3para>
<Text>addressing the gender pay gap, and</Text>
</P3para>
</P3>
<P3>
<Pnumber>b</Pnumber>
<P3para>
<Text>supporting employees going through the menopause.</Text>
</P3para>
</P3>
</P2para>
</P2>
<P2>
<Pnumber>5</Pnumber>
<P2para>
<Text>The regulations may, among other things, make provision about—</Text>
<P3>
<Pnumber>a</Pnumber>
<P3para>
<Text>the content of a plan;</Text>
</P3para>
</P3>
<P3>
<Pnumber>b</Pnumber>
<P3para>
<Text>the form and manner in which a plan or information is to be published;</Text>
</P3para>
</P3>

<Pnumber>c</Pnumber>

<Text>when and how frequently a plan or information is to be published or revised;</Text>

<Pnumber>d</Pnumber>

<Text>requirements for senior approval before a plan or information is published;</Text>

<Pnumber>e</Pnumber>

<Text>descriptions of employers;</Text>

<Pnumber>f</Pnumber>
<P3para>
<Text>descriptions of employee;</Text>

<Text>descriptions of information.</Text>

<Text>The regulations may not require an employer, after the first publication of information, to publish information more frequently than at intervals of 12 months.</Text>

<Text>The regulations may make provision for a failure to comply with the regulations to be enforced, otherwise than as an offence, by such means as are prescribed.</Text>

<Text>The reference to a failure to comply with the regulations includes a reference to a failure by a person acting on behalf of an employer.</Text>

<Text>A Minister of the Crown must consult—</Text>
<P3>
<Pnumber>a</Pnumber>
<P3para>
<Text>the Commission, before making regulations under this section that apply to a public authority, and</Text>

<P3para>
<Text>the Welsh Ministers, before making regulations under this section that apply to a public authority specified in Part 4 of Schedule 19 with the letter “D” included after the entry.</Text>
