In section 19 of the Mental Health Act 1983 (transfer of patients), after subsection (3) insert—

“(3A)

Before deciding to transfer a patient between hospitals in pursuance of regulations under subsection (1), or in pursuance of subsection (3), the person responsible for taking that decision must consult the patient’s nominated person (if any), unless consultation—

(a)

is not reasonably practicable, or

(b)

would involve unreasonable delay.”
