eId="crossheading-treatment"><heading>Treatment</heading><section eId="section-21" uk:target="true"><num>21</num><heading>Care and treatment plans</heading><content><p><mod>In the Mental Health Act 1983, in Part 10, before section 130A insert—<quotedStructure startQuote="“" endQuote="”" uk:context="body" uk:docName="ukpga" ukl:TargetClass="primary" ukl:TargetSubClass="unknown" ukl:Context="main" ukl:Format="double"><section eId="d25e81"><num>130ZA</num><heading>Care and treatment plans for patients in England</heading><subsection><num>(1)</num><content><p>The appropriate practitioner must prepare a care and treatment plan for a patient to whom this section applies.</p></content></subsection><subsection><num>(2)</num><intro><p>This section applies to a patient who—</p></intro><level class="para1"><num>(a)</num><intro><p>is liable to be detained under this Act in a hospital or registered establishment in England otherwise than—</p></intro><level class="para2"><num>(i)</num><content><p>by virtue of an emergency application where the second medical recommendation referred to in section 4(4)(a) has not been given and received, or</p></content></level><level class="para2"><num>(ii)</num><content><p>by virtue of section 5(2) or (4), 135 or 136 or directions for detention in a place of safety under section 35(4), 36(3), 37(4), 38(4) or 45A(5),</p></content></level></level><level class="para1"><num>(b)</num><content><p>is subject to guardianship under this Act, if the area of the responsible local social services authority is in England, or</p></content></level><level class="para1"><num>(c)</num><content><p>is a community patient, if the responsible hospital is in England.</p></content></level></subsection><subsection eId="d25e127"><num>(3)</num><intro><p>A “care and treatment plan” is a document—</p></intro><level class="para1" eId="d25e133"><num>(a)</num><content><p>containing a plan, made in accordance with regulations made by the Secretary of State, for meeting the patient’s needs arising from or related to mental disorder, and</p></content></level><level class="para1"><num>(b)</num><content><p>containing, or to which is attached, any other information authorised or required by the regulations.</p></content></level></subsection><subsection><num>(4)</num><intro><p>The information authorised or required to be included in, or attached to, a care and treatment plan by virtue of regulations under subsection <ref href="#d25e127">(3)</ref> may include—</p></intro><level class="para1"><num>(a)</num><intro><p>information about people with whom a patient has a relationship or other connection, or to whom a care and treatment plan is relevant, for purposes related to—</p></intro><level class="para2"><num>(i)</num><content><p>the meeting of the patient’s needs mentioned in subsection <ref href="#d25e127">(3)</ref><ref href="#d25e133">(a)</ref>, or</p></content></level><level class="para2"><num>(ii)</num><content><p>the review or revision of the care and treatment plan;</p></content></level></level><level class="para1"><num>(b)</num><content><p>any information contained in a report prepared in accordance with section <ref href="#">125A</ref> or <ref href="#">125B</ref>.</p></content></level></subsection><subsection eId="d25e189"><num>(5)</num><intro><p>The appropriate practitioner must review a care and treatment plan—</p></intro><level class="para1"><num>(a)</num><content><p>following any meeting relating to the patient under section <ref href="#">125A</ref> or <ref href="#">125B</ref>;</p></content></level><level class="para1"><num>(b)</num><content><p>following any change in the relevant patient’s condition or circumstances which the appropriate practitioner considers significant;</p></content></level><level class="para1"><num>(c)</num><intro><p>if the appropriate practitioner is considering whether the relevant patient should—</p></intro><level class="para2"><num>(i)</num><content><p>become liable to be detained by virtue of a different provision of this Act,</p></content></level><level class="para2"><num>(ii)</num><content><p>become subject to guardianship under this Act,</p></content></level><level class="para2"><num>(iii)</num><content><p>become a community patient, or</p></content></level><level class="para2"><num>(iv)</num><content><p>be discharged under section 23;</p></content></level></level><level class="para1"><num>(d)</num><content><p>if the appropriate practitioner is notified that the patient’s case is to be considered by a tribunal under this Act;</p></content></level><level class="para1"><num>(e)</num><content><p>if requested to do so by virtue of <ref href="#d25e421">section 130ZB</ref><ref href="#d25e443">(3)</ref>;</p></content></level><level class="para1" eId="d25e260"><num>(f)</num><intro><p>if reasonably requested to do so by—</p></intro><level class="para2"><num>(i)</num><content><p>the relevant patient;</p></content></level><level class="para2"><num>(ii)</num><content><p>anyone named by the relevant patient as someone to be consulted about their care and treatment plan;</p></content></level><level class="para2"><num>(iii)</num><content><p>the relevant patient’s nominated person;</p></content></level><level class="para2"><num>(iv)</num><content><p>any independent mental health advocate from whom the relevant patient is receiving help by virtue of section 130A;</p></content></level><level class="para2"><num>(v)</num><content><p>any donee or deputy for the relevant patient;</p></content></level><level class="para2"><num>(vi)</num><content><p>any other person who cares for the relevant patient or is interested in the relevant patient’s welfare.</p></content></level></level></subsection><subsection><num>(6)</num><content><p>When preparing or reviewing a care and treatment plan, the appropriate practitioner must, if it is practicable and appropriate to do so, consult the persons mentioned in <ref href="#d25e189">subsection (5)</ref><ref href="#d25e260">(f)</ref>.</p></content></subsection><subsection><num>(7)</num><intro><p>The Secretary of State may by regulations make provision—</p></intro><level class="para1"><num>(a)</num><content><p>requiring a care and treatment plan to be revised in specified circumstances;</p></content></level><level class="para1"><num>(b)</num><content><p>specifying, in relation to cases in which a care and treatment plan must be prepared, reviewed or revised, when that must be done.</p></content></level></subsection><subsection><num>(8)</num><intro><p>The Secretary of State may by regulations make provision about—</p></intro><level class="para1"><num>(a)</num><content><p>disclosure of information contained in a care and treatment plan;</p></content></level><level class="para1"><num>(b)</num><content><p>disclosure of other information for the purposes of functions under this section.</p></content></level></subsection><subsection><num>(9)</num><intro><p>Regulations under this section may make—</p></intro><level class="para1"><num>(a)</num><content><p>provision subject to specified exceptions;</p></content></level><level class="para1"><num>(b)</num><content><p>different provision for different cases;</p></content></level><level class="para1"><num>(c)</num><content><p>transitional, consequential, incidental or supplemental provision.</p></content></level></subsection><subsection eId="d25e373"><num>(10)</num><intro><p>References in this section—</p></intro><level class="para1"><num>(a)</num><content><p>to a donee for a patient are to a donee of a lasting power of attorney (within the meaning of section 9 of the Mental Capacity Act 2005) created by the patient;</p></content></level><level class="para1"><num>(b)</num><content><p>to a deputy for a patient are to a deputy appointed for the patient by the Court of Protection under section 16 of the Mental Capacity Act 2005;</p></content></level><level class="para1" eId="d25e391"><num>(c)</num><intro><p>to the responsible local social services authority—</p></intro><level class="para2"><num>(i)</num><content><p>in relation to a patient who is subject to guardianship in pursuance of a guardianship application, are to be read in accordance with section 34(3);</p></content></level><level class="para2"><num>(ii)</num><content><p>in relation to a patient who is subject to guardianship in pursuance of a guardianship order under section 37, are to the local social services authority specified in the order.</p></content></level></level></subsection><subsection><num>(11)</num><content><p>In this section “<term refersTo="#term-the-appropriate-practitioner">the appropriate practitioner</term>” has the same meaning as in Part 2 (see section 34(1)).</p></content></subsection></section><section eId="d25e421"><num>130ZB</num><heading>Care and treatment plans: monitoring</heading><subsection eId="d25e425"><num>(1)</num><content><p>The managers of a hospital or registered establishment in England must make arrangements for the monitoring of compliance with the duties imposed by <ref href="#d25e81">section 130ZA</ref> in relation to relevant patients for whom the managers are responsible.</p></content></subsection><subsection eId="d25e434"><num>(2)</num><content><p>A local social services authority whose area is in England must make arrangements for the monitoring of compliance with the duties imposed by <ref href="#d25e81">section 130ZA</ref> in relation to relevant patients for whom the authority is the responsible local social services authority.</p></content></subsection><subsection eId="d25e443"><num>(3)</num><content><p>Arrangements under subsection <ref href="#d25e425">(1)</ref> or <ref href="#d25e434">(2)</ref> must include arrangements for the appropriate practitioner, in relation to a relevant patient, to be requested to review the patient’s care and treatment plan where the managers or local social services authority (as the case may be) consider that the care and treatment plan should be reviewed.</p></content></subsection><subsection><num>(4)</num><intro><p>For the purposes of subsection <ref href="#d25e425">(1)</ref> the managers of a hospital or registered establishment are “responsible” for a relevant patient if the patient—</p></intro><level class="para1"><num>(a)</num><content><p>is liable to be detained under this Act in the hospital or registered establishment, or</p></content></level><level class="para1"><num>(b)</num><content><p>is a community patient for whom the hospital or registered establishment is the responsible hospital.</p></content></level></subsection><subsection><num>(5)</num><content><p>The reference in subsection <ref href="#d25e434">(2)</ref> to the responsible local social services authority is to be read in accordance with <ref href="#d25e81">section 130ZA</ref><ref href="#d25e373">(10)</ref><ref href="#d25e391">(c)</ref>.</p></content></subsection><subsection><num>(6)</num><intro><p>In this section—</p></intro><hcontainer name="definition"><content><p>“<term refersTo="#term-the-appropriate-practitioner">the appropriate practitioner</term>” has the same meaning as in Part 2 (see section 34(1));</p></content></hcontainer><hcontainer name="definition"><content><p>“<term refersTo="#term-care-and-treatment-plan">care and treatment plan</term>” has the meaning given by section <ref href="#d25e81">130ZA</ref><ref href="#d25e127">(3)</ref>;</p></content></hcontainer><hcontainer name="definition"><content><p>“<term refersTo="#term-relevant-patient">relevant patient</term>” means a patient to whom section <ref
