(1)No recommendation is to be made to His Majesty in Council to make an Order in Council under section 1 or 2 unless a draft of the statutory instrument containing the Order has been laid before, and approved by a resolution of, each House of Parliament.

(2)An Order in Council under section 1 or 2

(a)may allow for the waiver of immunities and privileges;

(b)may provide for exceptions to an immunity, privilege or exemption in cases specified in the Order;

(c)may provide for an exemption or relief from a tax or duty to be subject to arrangements or conditions—

(i)specified in the Order, or

(ii)to be made or imposed by the Secretary of State or the Commissioners for His Majesty’s Revenue and Customs;

(d)may make different provision for different cases and for different persons;

(e)may contain consequential, supplementary, incidental, transitional or saving provision.
