An order under subsection (3A)—
a
in the case of an order made by the Secretary of State, is to be made by statutory instrument subject to annulment in pursuance of a resolution of either House of Parliament;
b
in the case of an order made by the Welsh Ministers, is to be made by statutory instrument subject to annulment in pursuance of a resolution of Senedd Cymru;
c
in the case of an order made by the Scottish Ministers, is subject to the negative procedure (see Part 2 of the Interpretation and Legislative Reform (Scotland) Act 2010 (asp 10)).

In this section, “the appropriate national authority” means—
a
the Secretary of State in relation to England;
b
the Welsh Ministers in relation to Wales;
c
the Scottish Ministers in relation to Scotland.
