Local Government Act 1972
2In section 101 of the Local Government Act 1972 (arrangements for discharge of functions by local authorities), after subsection (6) insert—
“(6ZA)Infrastructure Levy under Part 10A of the Planning Act 2008 is not a rate for the purposes of subsection (6).”
Town and Country Planning Act 1990
3In section 70(4) of the TCPA 1990 (determination of applications: general considerations), in paragraph (b) of the definition of “local finance consideration”, after “payment of” insert “Infrastructure Levy or”.
Deregulation and Contracting Out Act 1994
4In section 71(3) of the Deregulation and Contracting Out Act 1994 (functions excluded from sections 69 and 70), omit the word “and” at the end of paragraph (h) and after that paragraph insert—
“(ha)sections 204R and 204S of the Planning Act 2008 (Infrastructure Levy: collection and enforcement); and”.
Planning Act 2008
5The Planning Act 2008 is amended as follows.
6In the following sections, for “Part 11”, in each place it occurs, substitute “Parts 10A and 11”—
(a)section 32 (meaning of “development”);
(b)section 155(1) (when development begins);
(c)section 235(1) (interpretation).
7In section 232(1)(d) (orders and regulations), after “Part” insert “10A or”.
