<Text>The Secretary of State may give NHS England directions as to the exercise of any of its functions.</Text>
</P2para>
</P2>

<Pnumber>2</Pnumber>
<P2para>
<Text>The directions that may be given include a direction as to whether a power is to be exercised or not.</Text>
</P2para>
</P2>
<P2 id="p00457">
<Pnumber>3</Pnumber>
<P2para>
<Text>The directions that may be given include a direction as to—</Text>
<P3 id="p00458">
<Pnumber>a</Pnumber>
<P3para>
<Text>when or how a function is, or is not, to be exercised;</Text>
</P3para>
</P3>
<P3 id="p00459">
<Pnumber>b</Pnumber>
<P3para>
<Text>conditions that must be met before a function is exercised (for example, conditions relating to the provision of information, consultation or approval);</Text>
</P3para>
</P3>
<P3>
<Pnumber>c</Pnumber>
<P3para>
<Text>matters to be taken into account in exercising a function.</Text>
</P3para>
</P3>
</P2para>
</P2>

<Pnumber>4</Pnumber>

<Text>For exceptions to the power to give directions under subsection <InternalLink Ref="p00455">(1)</InternalLink>, see section <InternalLink Ref="p00462">13ZD</InternalLink>.</Text>

<Pnumber>5</Pnumber>
<P2para>
<Text>A direction under subsection <InternalLink Ref="p00455">(1)</InternalLink> must include a statement that the Secretary of State considers the direction to be in the public interest.</Text>
</P2para>
</P2>
<P2>
<Pnumber>6</Pnumber>
<P2para>
<Text>As soon as reasonably practicable after giving a direction under subsection <InternalLink Ref="p00455">(1)</InternalLink>, the Secretary of State must publish it.</Text>

<Pnumber>7</Pnumber>
<P2para>
<Text>The fact that the Secretary of State has a function under any other enactment in relation to NHS England’s exercise of functions is not to be read as limiting the power conferred by subsection (1).</Text>

<P2para>
<Text>The reference in subsection (7) to a function of the Secretary of State does not include a function of making subordinate legislation.</Text>

<Title>Power to give directions: exceptions</Title>
<P1>
<Pnumber>13ZD</Pnumber>
<P1para>
<P2>
<Pnumber>1</Pnumber>
<P2para>
<Text>A direction under section <InternalLink Ref="p00454">13ZC</InternalLink> may not be given in relation to a function relating to the appointment or employment of a person.</Text>
</P2para>
</P2>
<P2>
<Pnumber>2</Pnumber>
<P2para>
<Text>A direction under section <InternalLink Ref="p00454">13ZC</InternalLink> may not be given in relation to a decision about the services to be provided to a particular individual for or in connection with the prevention, diagnosis or treatment of illness.</Text>
</P2para>
</P2>
<P2>
<Pnumber>3</Pnumber>
<P2para>
<Text>A direction under section <InternalLink Ref="p00454">13ZC</InternalLink> may not be given in relation to the provision of any drug, medicine or other treatment, or the use of any diagnostic technique, unless NICE has made a recommendation or issued guidance as to its clinical and cost effectiveness and the direction is not inconsistent with that recommendation or guidance.</Text>

<Title>Compliance with directions: significant failure</Title>
<P1>
<Pnumber>13ZE</Pnumber>
<P1para>
<P2>
<Pnumber>1</Pnumber>
<P2para>
<Text>This section applies where—</Text>
<P3>
<Pnumber>a</Pnumber>
<P3para>
<Text>NHS England is given a direction under section <InternalLink Ref="p00454">13ZC</InternalLink>,</Text>
</P3para>
</P3>
<P3>
<Pnumber>b</Pnumber>
<P3para>
<Text>the direction —</Text>
<P4>
<Pnumber>i</Pnumber>
<P4para>
<Text>states that the Secretary of State considers that NHS England is failing or has failed to discharge any of its functions, and</Text>
</P4para>
</P4>
<P4>
<Pnumber>ii</Pnumber>
<P4para>
<Text>states that the Secretary of State considers that the failure is significant and explains why,</Text>
</P4para>
</P4>
</P3para>
</P3>
<P3>
<Pnumber>c</Pnumber>
<P3para>
<Text>the direction states that it is given for the purposes of addressing that failure, and</Text>
</P3para>
</P3>
<P3>
<Pnumber>d</Pnumber>
<P3para>
<Text>NHS England fails to comply with the direction.</Text>
</P3para>
</P3>
</P2para>
</P2>
<P2>
<Pnumber>2</Pnumber>
<P2para>
<Text>The Secretary of State may—</Text>
<P3>
<Pnumber>a</Pnumber>
<P3para>
<Text>discharge the functions to which the direction relates, or</Text>
</P3para>
</P3>
<P3>
<Pnumber>b</Pnumber>
<P3para>
<Text>make arrangements for any other person to discharge them on the Secretary of State’s behalf.</Text>

</P3>
</P2para>
</P2>

<Pnumber>3</Pnumber>

<Text>Where the Secretary of State exercises the power under subsection (2), the Secretary of State must publish the reasons for doing so.</Text>

<Text>For the purpose of this section—</Text>

<Pnumber>a</Pnumber>
<P3para>
<Text>a failure to discharge a function includes a failure to discharge it properly, and</Text>

<Text>a failure to discharge a function properly includes a failure to discharge it consistently with what the Secretary of State considers to be the interests of the health service.</Text>

<Text>The directions that may be given include a direction to provide documents or other information that NHS England would need to obtain from others in the exercise of some other power.</Text>
