The Environmental Protection Act 1990 is amended as follows.

In section 33ZA (fixed penalty notices relating to depositing, treatment or disposal of waste: England)—
a
in subsection (10), for the words from “the period” to the end substitute “a period specified by the authority.”

b
after that subsection insert—
10A
The Secretary of State may by regulations substitute different amounts for the amounts for the time being specified in subsections (9) and (10).

in subsection (9), for the words from “within” to the end substitute “before the end of a period specified by the authority.”

after that subsection insert—
