Territorial extent and application
- Section 89 sets out the territorial extent of the Act, that is the jurisdictions which the Act forms part of the law of. The extent of an Act can be different from its application. Application is about where an Act produces a practical effect.
- The provisions in the Act for the most part extend and apply to England and Wales only. Sections 57 to 61 (local authority support), section 78 (homelessness: victims of domestic abuse), section 79 (secure tenancies granted to victims of domestic abuse) and section 83 (contact centres) extend to England and Wales and apply to England only. The provisions in Part 2 of Schedule 2 extend and apply to Scotland only, while those in section 73 and Part 3 of Schedule 3 extend and apply to Northern Ireland only. Sections 81 and 82 (data processing for immigration purposes) extend and apply to England and Wales, Scotland and Northern Ireland.
- See the table at Annex B for a summary of the position regarding territorial extent and application in the UK.
