Territorial extent and application

  1. Section 9 sets out the territorial extent of the sections in the Act. The extent of an Act is the legal jurisdiction where it forms part of the law; application refers to where it has practical effect.
  2. Agriculture is a devolved matter and within the competence of the devolved administrations. The Act provides the Secretary of State with the power to make regulations on a UK wide basis, on behalf of Scotland, Wales and Northern Ireland but only with their consent. The UK Parliament will not normally legislate for areas within the competence of the Scottish Parliament, National Assembly for Wales or the Northern Ireland Assembly without the consent of the legislature concerned. As the provisions of this Act fall within devolved competence, the consent of the Scottish Parliament, National Assembly for Wales and Northern Ireland Assembly has been granted through legislative consent motions.
