29Criminal Procedure (Scotland) Act 1995

Section 288ZA of the Criminal Procedure (Scotland) Act 1995 (right of Advocate General to take part in proceedings) is amended as follows.

In subsection (2)—

a

in paragraph (a)(ii), for “incompatible with EU law” substitute “made unlawful by section 57(4) of the Scotland Act 1998 (restriction on subordinate legislation modifying retained EU law)”, and

b

in paragraph (b), for “with EU law” substitute “in breach of the restriction in section 30A(1) of the Scotland Act 1998 (restriction on the modification of retained EU law)”.

In subsection (3), omit paragraph (c).
