SCHEDULE 12The Information Commissioner
Carrying out of the Commissioner's functions by officers and staff

The functions of the Commissioner are to be carried out by the deputy commissioner or deputy commissioners if—
a
there is a vacancy in the office of the Commissioner, or
b
the Commissioner is for any reason unable to act.

When the Commissioner appoints a second or subsequent deputy commissioner, the Commissioner must specify which deputy commissioner is to carry out which of the Commissioner's functions in the circumstances referred to in sub-paragraph (1).

A function of the Commissioner may, to the extent authorised by the Commissioner, be carried out by any of the Commissioner's officers or staff.
