section 67 of the Regulation of Investigatory Powers Act 2000 insert—</Text><BlockAmendment TargetClass="primary" TargetSubClass="regulation" Context="main" Format="default"><P1group><Title>Appeals from the Tribunal</Title><P1><Pnumber PuncAfter="">67A</Pnumber><P1para><P2><Pnumber>1</Pnumber><P2para><Text>A relevant person may appeal on a point of law against any determination of the Tribunal of a kind mentioned in section 68(4) or any decision of the Tribunal of a kind mentioned in section 68(4C).</Text></P2para></P2><P2><Pnumber>2</Pnumber><P2para><Text>Before making a determination or decision which might be the subject of an appeal under this section, the Tribunal must specify the court which is to have jurisdiction to hear the appeal (the  “relevant appellate court”).</Text></P2para></P2><P2><Pnumber>3</Pnumber><P2para><Text>This court is whichever of the following courts appears to the Tribunal to be the most appropriate—</Text><P3><Pnumber>a</Pnumber><P3para><Text>the Court of Appeal in England and Wales,</Text></P3para></P3><P3><Pnumber>b</Pnumber><P3para><Text>the Court of Session.</Text></P3para></P3></P2para></P2><P2><Pnumber>4</Pnumber><P2para><Text>The Secretary of State may by regulations, with the consent of the Northern Ireland Assembly, amend subsection (3) so as to add the Court of Appeal in Northern Ireland to the list of courts mentioned there.</Text></P2para></P2><P2><Pnumber>5</Pnumber><P2para><Text>The Secretary of State may by regulations specify criteria to be applied by the Tribunal in making decisions under subsection (2) as to the identity of the relevant appellate court.</Text></P2para></P2><P2><Pnumber>6</Pnumber><P2para><Text>An appeal under this section—</Text><P3><Pnumber>a</Pnumber><P3para><Text>is to be heard by the relevant appellate court, but</Text></P3para></P3><P3><Pnumber>b</Pnumber><P3para><Text>may not be made without the leave of the Tribunal or, if that is refused, of the relevant appellate court.</Text></P3para></P3></P2para></P2><P2><Pnumber>7</Pnumber><P2para><Text>The Tribunal or relevant appellate court must not grant leave to appeal unless it considers that—</Text><P3><Pnumber>a</Pnumber><P3para><Text>the appeal would raise an important point of principle or practice, or</Text></P3para></P3><P3><Pnumber>b</Pnumber><P3para><Text>there is another compelling reason for granting leave.</Text></P3para></P3></P2para></P2><P2><Pnumber>8</Pnumber><P2para><Text>In this section—</Text><UnorderedList Decoration="none" Class="Definition"><ListItem><Para><Text>“<Term>relevant appellate court</Term>” has the meaning given by subsection (2),</Text></Para></ListItem><ListItem><Para><Text>“<Term>relevant person</Term>”, in relation to any proceedings, complaint or reference, means the complainant or—</Text></Para><OrderedList id="section-246-1-b"><Pnumber>b</Pnumber><P3para><Text>the availability and development of techniques to use such powers while minimising interference with privacy.</Text></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/2016/25/section/246/2" IdURI="http://www.legislation.gov.uk/id/ukpga/2016/25/section/246/2" id="section-246-2"><Pnumber>2</Pnumber><P2para><Text>The Technology Advisory Panel must provide advice to the Investigatory Powers Commissioner about such matters falling within subsection (1)(a) or id="section-246-3"><Pnumber>3</Pnumber><P2para><Text>Subject to this, the Panel may provide advice to the Investigatory Powers Commissioner about such matters falling within subsection (1)(a) or (b) as it considers appropriate (whether or not requested to do so).</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/2016/25/section/246/4" IdURI="http://www.legislation.gov.uk/id/ukpga/2016/25/section/246/4" id="section-246-4"><Pnumber>4</Pnumber><P2para><Text>The Panel may provide advice to the Secretary of State or the Scottish Ministers about such matters falling within subsection (1)(a) or (b) as it considers appropriate (whether or not requested to do so) but such advice to the Scottish Ministers may only relate to matters for which the Scottish Ministers are responsible.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/2016/25/section/246/5" IdURI="http://www.legislation.gov.uk/id/ukpga/2016/25/section/246/5" id="section-246-5"><Pnumber>5</Pnumber><P2para><Text>The Panel must, as soon as reasonably practicable after the end of each calendar year, make a report to the Investigatory Powers Commissioner about the carrying out of the functions of the Panel.</Text></P2para></P2><P2
