45Policing of railways and railway property

(1)

In Part 2 of Schedule 5 to the Scotland Act 1998, Section E2 (specific reservations: rail transport) is amended as follows.

Under the heading “Exceptions”, after the exception relating to the promotion and construction of railways insert— “ Policing of railways and railway property. ”

(3)

Under the heading “Interpretation”, after the definition of “railway” insert—

““Railway property” has the meaning given by section 75(3) of the Railways and Transport Safety Act 2003.”
