Code must require pub-owning businesses to offer their tied pub tenants falling within section 70(1)(a) a market rent only option in specified circumstances.</Text></P2para></P2><P2 id="term-market-rent-only-option">market rent only option</Term>” means the option for the tied pub tenant—</Text><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/2015/26/section/43/2/a" IdURI="http://www.legislation.gov.uk/id/ukpga/2015/26/section/43/2/a" id="section-43-2-a"><Pnumber>a</Pnumber><P3para><Text>to occupy the tied pub under a tenancy or licence which is MRO-compliant, and</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/2015/26/section/43/2/b" IdURI="http://www.legislation.gov.uk/id/ukpga/2015/26/section/43/2/b" id="section-43-2-b"><Pnumber>b</Pnumber><P3para><Text>to pay in respect of that occupation—</Text><P4 DocumentURI="http://www.legislation.gov.uk/ukpga/2015/26/section/43/2/b/i" IdURI="http://www.legislation.gov.uk/id/ukpga/2015/26/section/43/2/b/i" id="section-43-2-b-i"><Pnumber>i</Pnumber><P4para><Text>such rent as may be agreed between the pub-owning business and the tied rent.</Text></P4para></P4></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/2015/26/section/43/3" IdURI="http://www.legislation.gov.uk/id/ukpga/2015/26/section/43/3" id="section-43-3"><Pnumber>3</Pnumber><P2para><Text>The Pubs Code may specify—</Text><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/2015/26/section/43/3/a" IdURI="http://www.legislation.gov.uk/id/ukpga/2015/26/section/43/3/a" id="section-43-3-a"><Pnumber>a</Pnumber><P3para><Text>circumstances in which a market rent only option must or may be an option to occupy under a tenancy;</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/2015/26/section/43/3/b" IdURI="http://www.legislation.gov.uk/id/ukpga/2015/26/section/43/3/b" id="section-43-3-b"><Pnumber>b</Pnumber><P3para><Text>circumstances in which a market rent only option must or may be an option to occupy under a licence.</Text></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/2015/26/section/43/4" IdURI="http://www.legislation.gov.uk/id/ukpga/2015/26/section/43/4" id="section-43-4"><Pnumber>4</Pnumber><P2para><Text>A tenancy or licence is MRO-compliant if—</Text><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/2015/26/section/43/4/a" IdURI="http://www.legislation.gov.uk/id/ukpga/2015/26/section/43/4/a" id="section-43-4-a"><Pnumber>a</Pnumber><P3para><Text>taken together with any other contractual agreement entered into by the tied pub tenant with the pub-owning business in connection with the tenancy or licence it—</Text><P4 DocumentURI="http://www.legislation.gov.uk/ukpga/2015/26/section/43/4/a/i" IdURI="http://www.legislation.gov.uk/id/ukpga/2015/26/section/43/4/a/i" id="section-43-4-a-i"><Pnumber>i</Pnumber><P4para><Text>contains such terms and conditions as may be required by virtue of subsection (5)(a),</Text></P4para></P4><P4 DocumentURI="http://www.legislation.gov.uk/ukpga/2015/26/section/43/4/a/ii" IdURI="http://www.legislation.gov.uk/id/ukpga/2015/26/section/43/4/a/ii" id="section-43-4-a-ii"><Pnumber>ii</Pnumber><P4para><Text>does not contain any product or service tie other than one in respect of insurance in connection with the tied pub, and</Text></P4para></P4><P4 DocumentURI="http://www.legislation.gov.uk/ukpga/2015/26/section/43/4/a/iii" IdURI="http://www.legislation.gov.uk/id/ukpga/2015/26/section/43/4/a/iii" id="section-43-4-a-iii"><Pnumber>iii</Pnumber><P4para><Text>does not contain any unreasonable terms or conditions, and</Text></P4para></P4></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/2015/26/section/43/4/b" IdURI="http://www.legislation.gov.uk/id/ukpga/2015/26/section/43/4/b" id="section-43-4-b"><Pnumber>b</Pnumber><P3para><Text>it is not a tenancy at will.</Text></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/2015/26/section/43/5" IdURI="http://www.legislation.gov.uk/id/ukpga/2015/26/section/43/5" id="section-43-5"><Pnumber>5</Pnumber><P2para><Text>The Pubs Code may specify descriptions of terms and conditions—</Text><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/2015/26/section/43/5/a" IdURI="http://www.legislation.gov.uk/id/ukpga/2015/26/section/43/5/a" id="section-43-5-a"><Pnumber>a</Pnumber><P3para><Text>which are required to be contained in a tenancy or licence for it to be MRO-compliant;</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/2015/26/section/43/5/b" IdURI="http://www.legislation.gov.uk/id/ukpga/2015/26/section/43/5/b" id="section-43-5-b"><Pnumber>b</Pnumber><P3para><Text>which are to be regarded as reasonable or unreasonable for the purposes of subsection (4).</Text></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/2015/26/section/43/6" IdURI="http://www.legislation.gov.uk/id/ukpga/2015/26/section/43/6" id="section-43-6"><Pnumber>6</Pnumber><P2para><Text>Provision made under subsection (1) must include provision requiring a pub-owning business to offer a tied pub tenant a market rent only option—</Text><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/2015/26/section/43/6/a" IdURI="http://www.legislation.gov.uk/id/ukpga/2015/26/section/43/6/a" id="section-43-6-a"><Pnumber>a</Pnumber><P3para><Text>in connection with the renewal of any of the pub arrangements;</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/2015/26/section/43/6/b" IdURI="http://www.legislation.gov.uk/id/ukpga/2015/26/section/43/6/b" id="section-43-6-b"><Pnumber>b</Pnumber><P3para><Text>in connection with a rent assessment or assessment of money payable by the tenant in lieu of rent <Addition ChangeId="key-602e4f8f4f0b581f4b89ac2dd159cf29-1476382387335" CommentaryRef="key-602e4f8f4f0b581f4b89ac2dd159cf29">(whether or not it results in a proposal that the rent, or amount of money payable, should increase)</Addition>;</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/2015/26/section/43/6/c" IdURI="http://www.legislation.gov.uk/id/ukpga/2015/26/section/43/6/c" id="section-43-6-c"><Pnumber>c</Pnumber><P3para><Text>in connection with a significant increase in the price at which any product or service which is subject to a product or service tie is supplied to the tied pub tenant where the increase was not reasonably foreseeable—</Text><P4 DocumentURI="http://www.legislation.gov.uk/ukpga/2015/26/section/43/6/c/i" IdURI="http://www.legislation.gov.uk/id/ukpga/2015/26/section/43/6/c/i" id="section-43-6-c-i"><Pnumber>i</Pnumber><P4para><Text>when the tenancy or licence was granted, or</Text></P4para></P4><P4 DocumentURI="http://www.legislation.gov.uk/ukpga/2015/26/section/43/6/c/ii" IdURI="http://www.legislation.gov.uk/id/ukpga/2015/26/section/43/6/c/ii" id="section-43-6-c-ii"><Pnumber>ii</Pnumber><P4para><Text>if there has been an assessment of a kind mentioned in paragraph (b), when the last assessment was concluded;</Text></P4para></P4></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/2015/26/section/43/6/d" IdURI="http://www.legislation.gov.uk/id/ukpga/2015/26/section/43/6/d" id="section-43-6-d"><Pnumber>d</Pnumber><P3para><Text>after a trigger event has occurred.</Text></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/2015/26/section/43/7" IdURI="http://www.legislation.gov.uk/id/ukpga/2015/26/section/43/7" id="section-43-7"><Pnumber>7</Pnumber><P2para><Text>The Pubs Code may specify what  “<Term id="term-renewal">renewal</Term>” means in relation to a tenancy or a licence for the purposes of subsection (6).</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/2015/26/section/43/8" IdURI="http://www.legislation.gov.uk/id/ukpga/2015/26/section/43/8" id="section-43-8"><Pnumber>8</Pnumber><P2para><Text>In subsection (6)  “<Term id="term-pub-arrangements">pub arrangements</Term>”, in relation to a tied pub, means—</Text><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/2015/26/section/43/8/a" IdURI="http://www.legislation.gov.uk/id/ukpga/2015/26/section/43/8/a" id="section-43-8-a"><Pnumber>a</Pnumber><P3para><Text>the tenancy or licence under which the tied pub is occupied, and</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/2015/26/section/43/8/b" IdURI="http://www.legislation.gov.uk/id/ukpga/2015/26/section/43/8/b" id="section-43-8-b"><Pnumber>b</Pnumber><P3para><Text>any other contractual agreement which contains an obligation by virtue of which condition D in section 68 is met in relation to the premises.</Text></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/2015/26/section/43/9" IdURI="http://www.legislation.gov.uk/id/ukpga/2015/26/section/43/9" id="section-43-9"><Pnumber>9</Pnumber><P2para><Text>In this Part a  “<Term id="term-trigger-event">trigger event</Term>”, in relation to a tied pub tenant, means an event which—</Text><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/2015/26/section/43/9/a" IdURI="http://www.legislation.gov.uk/id/ukpga/2015/26/section/43/9/a" id="section-43-9-a"><Pnumber>a</Pnumber><P3para><Text>is beyond the control of the tied pub tenant,</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/2015/26/section/43/9/b" IdURI="http://www.legislation.gov.uk/id/ukpga/2015/26/section/43/9/b" id="section-43-9-b"><Pnumber>b</Pnumber><P3para><Text>was not reasonably foreseeable as mentioned in subsection (6)(c),</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/2015/26/section/43/9/c" IdURI="http://www.legislation.gov.uk/id/ukpga/2015/26/section/43/9/c" id="section-43-9-c"><Pnumber>c</Pnumber><P3para><Text>has a significant impact on the level of trade that could reasonably be expected to be achieved at the tied pub, and</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/2015/26/section/43/9/d" IdURI="http://www.legislation.gov.uk/id/ukpga/2015/26/section/43/9/d" id="section-43-9-d"><Pnumber>d</Pnumber><P3para><Text>is of a description specified in the Pubs Code.</Text></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/2015/26/section/43/10" IdURI="http://www.legislation.gov.uk/id/ukpga/2015/26/section/43/10" id="section-43-10"><Pnumber>10</Pnumber><P2para><Text>In this Part  “<Term id="term-market-rent">market rent</Term>”, in relation to the occupation of particular premises under a tenancy or licence which is MRO-compliant, means the estimated rent which it would be reasonable to pay in respect of that occupation on the following assumptions—</Text><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/2015/26/section/43/10/a" IdURI="http://www.legislation.gov.uk/id/ukpga/2015/26/section/43/10/a"
