Territorial Extent and Application

56.This Act extends to England and Wales, Scotland and Northern Ireland, as described below.

  • all provisions in this Act extend to England and Wales, other than section 55(4) (closure of support under the renewables obligation in Northern Ireland).

  • in the application of this Act to Wales, it is to be noted that there are no government pipeline and storage system assets in Wales, and section 150 (smoke and carbon monoxide alarms) is only exercisable in relation to a relevant landlord of residential premises in England.

  • the new provisions in the Warm Homes and Energy Conservation Act will apply only to England.

  • all provisions in this Act extend to Scotland, other than section 55(4), section 149 (fees in respect of decommissioning and clean-up of nuclear installations) and section 150 (smoke and carbon monoxide alarms).

  • only the following provisions extend to Northern Ireland:

    • decarbonisation (Part 1),

    • general considerations (Part 2, Chapter 1),

    • contracts for difference (Part 2, Chapter 2),

    • investment contracts (Part 2, Chapter 4),

    • power to apply to Northern Ireland provisions in relation to closure of support under the renewables obligation (section 55(4), in Part 2),

    • transition to certificate purchase scheme (section 56, in Part 2),

    • emissions performance standard (Part 2, Chapter 8),

    • exemption from liability in damages (section 63, in Part 2),

    • most aspects of nuclear regulation (Part 3),

    • fees in respect of decommissioning and clean-up of nuclear sites (section 149, in Part 6), and

    • final provisions (Part 7).
