IdURI="http://www.legislation.gov.uk/id/ukpga/2013/30/section/18/4/b" id="section-18-4-b"><Pnumber>b</Pnumber><P3para><Text>make transitional, transitory or saving provision, or</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/2013/30/section/18/4/c" IdURI="http://www.legislation.gov.uk/id/ukpga/2013/30/section/18/4/c" id="section-18-4-c"><Pnumber>c</Pnumber><P3para><Text>make consequential provision.</Text></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/2013/30/section/18/5" IdURI="http://www.legislation.gov.uk/id/ukpga/2013/30/section/18/5" id="section-18-5"><Pnumber>5</Pnumber><P2para><Text>The provision that the Secretary of State may make in any relevant instrument includes provision enabling the Registrar General to make regulations by statutory instrument (with or without the consent of a minister of the Crown).</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/2013/30/section/18/6" IdURI="http://www.legislation.gov.uk/id/ukpga/2013/30/section/18/6" id="section-18-6"><Pnumber>6</Pnumber><P2para><Text>But the Secretary of State—</Text><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/2013/30/section/18/6/a" IdURI="http://www.legislation.gov.uk/id/ukpga/2013/30/section/18/6/a" id="section-18-6-a"><Pnumber>a</Pnumber><P3para><Text>may not make enabling provision which gives the Registrar General power to require a fee to be paid or power to set the amount of a fee; and</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/2013/30/section/18/6/b" IdURI="http://www.legislation.gov.uk/id/ukpga/2013/30/section/18/6/b" id="section-18-6-b"><Pnumber>b</Pnumber><P3para><Text>may not make other enabling provision unless the Secretary of State is satisfied that the provision is necessary in connection with administrative matters relating to functions of the Registrar General or functions of superintendent registrars or registrars.</Text></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/2013/30/section/18/7" IdURI="http://www.legislation.gov.uk/id/ukpga/2013/30/section/18/7" id="section-18-7"><Pnumber>7</Pnumber><P2para><Text>Regulations made by the Registrar General under any enabling provision are subject to annulment in pursuance of a resolution of either House of Parliament.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/2013/30/section/18/8" IdURI="http://www.legislation.gov.uk/id/ukpga/2013/30/section/18/8" id="section-18-8"><Pnumber>8</Pnumber><P2para><Text>But that is subject to any provision in a relevant instrument about the kind of Parliamentary scrutiny, if any, to which the regulations are to be subject.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/2013/30/section/18/9" IdURI="http://www.legislation.gov.uk/id/ukpga/2013/30/section/18/9" id="section-18-9"><Pnumber>9</Pnumber><P2para><Text>In subsections (5) to (8)—</Text><UnorderedList Decoration="none" Class="Definition"><ListItem><Para><Text>“<Term id="term-enabling-provision">enabling provision</Term>” means provision made under subsection (5) enabling the Registrar General to make regulations;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-relevant-instrument">relevant instrument</Term>” means—</Text></Para><OrderedList Type="alpha" Decoration="parens"><ListItem NumberOverride="a"><Para><Text>regulations under section 9(1) or (2), or</Text></Para></ListItem><ListItem NumberOverride="b"><Para><Text>an order under section 14(4).</Text></Para></ListItem></OrderedList></ListItem></UnorderedList></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/2013/30/section/18/10" IdURI="http://www.legislation.gov.uk/id/ukpga/2013/30/section/18/10" id="section-18-10"><Pnumber>10</Pnumber><P2para><Text>Any power of the Secretary of State or Lord Chancellor under this Act to amend legislation by subordinate legislation includes power to repeal or revoke legislation (and any reference to the amendment of legislation by such an order or regulations is to be read accordingly).</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/2013/30/section/18/11" IdURI="http://www.legislation.gov.uk/id/ukpga/2013/30/section/18/11" id="section-18-11"><Pnumber>11</Pnumber><P2para><Text>The Secretary of State or Lord Chancellor must—</Text><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/2013/30/section/18/11/a" IdURI="http://www.legislation.gov.uk/id/ukpga/2013/30/section/18/11/a" id="section-18-11-a"><Pnumber>a</Pnumber><P3para><Text>obtain the consent of the Scottish Ministers before making any order or regulations under this Act, except an order under section 21(3), containing provision which would (if contained in an Act of the Scottish Parliament) be within the legislative competence of that Parliament;</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/2013/30/section/18/11/b" IdURI="http://www.legislation.gov.uk/id/ukpga/2013/30/section/18/11/b" id="section-18-11-b"><Pnumber>b</Pnumber><P3para><Text>obtain the consent of the Department of Finance and Personnel before making any order or regulations under this Act, except an order under section 21(3), containing provision which would (if contained in an Act of the Northern Ireland Assembly) be within the legislative competence of that Assembly.</Text></P3para></P3></P2para></P2></P1para></P1></P1group><P1group RestrictStartDate="2013-10-31"><Title>Interpretation</Title><P1
