IdURI="http://www.legislation.gov.uk/id/ukpga/2012/9/section/95/1" id="section-95-1"><Pnumber>1</Pnumber><P2para><Text>The Secretary of State must by notice direct the relevant data controller to delete details, contained in relevant official records, of a disregarded conviction or caution.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/2012/9/section/95/2" IdURI="http://www.legislation.gov.uk/id/ukpga/2012/9/section/95/2" id="section-95-2"><Pnumber>2</Pnumber><P2para><Text>A notice under subsection (1) may be given at any time after condition A in section 92 is met but no deletion may have effect before condition B in that section is met.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/2012/9/section/95/3" IdURI="http://www.legislation.gov.uk/id/ukpga/2012/9/section/95/3" id="section-95-3"><Pnumber>3</Pnumber><P2para><Text>Subject to that, the relevant data controller must delete the details as soon as id="section-95-4"><Pnumber>4</Pnumber><P2para><Text>Having done so, the relevant data controller must give notice to the person who has the disregarded conviction or caution that the details of it id="section-95-5"><Pnumber>5</Pnumber><P2para><Text>In this section—</Text><UnorderedList Decoration="none" Class="Definition"><ListItem><Para><Text>“<Term id="term-delete">delete</Term>”, in relation to such relevant official records as may be prescribed, means record with the details of the conviction or caution concerned—</Text></Para><OrderedList Type="alpha" Decoration="parens"><ListItem NumberOverride="a"><Para><Text>the fact that it is a disregarded conviction or caution, and</Text></Para></ListItem><ListItem NumberOverride="b"><Para><Text>the effect of it being such a conviction or caution,</Text></Para></ListItem></OrderedList></ListItem><ListItem><Para><Text>“<Term id="term-the-names-database">the names database</Term>” means the names database held by the <Substitution ChangeId="key-2b8593c6f60c9e160bad166c9898e68e-1472227895770" CommentaryRef="key-2b8593c6f60c9e160bad166c9898e68e">Secretary of State
                </Substitution> for the use of constables,</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-official-records">official records</Term>” means records containing information about persons convicted of, or cautioned for, offences and kept by any court, police force, government department or local or other public authority in England and Wales for the purposes of its functions,</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-prescribed">prescribed</Term>” means prescribed by order of the Secretary of State,</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-relevant-data-controller">relevant data controller</Term>” means—</Text></Para><OrderedList Type="alpha" Decoration="parens"><ListItem NumberOverride="a"><Para><Text>in relation to the names database, any chief officer of police of a police force in England and Wales who is a data controller in relation to the details concerned,</Text></Para></ListItem><ListItem NumberOverride="b"><Para><Text>in relation to other relevant official records, such person as may be prescribed,</Text></Para></ListItem></OrderedList></ListItem><ListItem><Para><Text>“<Term id="term-relevant-official-records">relevant official records</Term>” means—</Text></Para><OrderedList Type="alpha" Decoration="parens"><ListItem NumberOverride="a"><Para><Text>the names database, and</Text></Para></ListItem><ListItem NumberOverride="b"><Para><Text>such other official records as may be pursuance of a resolution of either House of Parliament.</Text></P3para></P3></P2para></P2></P1para></P1></P1group><P1group RestrictStartDate="2012-10-01"><Title>Effect of disregard for disclosure and other purposes</Title><P1 DocumentURI="http://www.legislation.gov.uk/ukpga/2012/9/section/96" IdURI="http://www.legislation.gov.uk/id/ukpga/2012/9/section/96" id="section-96"><Pnumber PuncAfter=""><CommentaryRef Ref="key-4e3b2bbdec21fc54aaf5ca333ea4bfb6"/>96</Pnumber><P1para><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/2012/9/section/96/1" IdURI="http://www.legislation.gov.uk/id/ukpga/2012/9/section/96/1" id="section-96-1"><Pnumber>1</Pnumber><P2para><Text>A person who has a disregarded conviction or caution is to be treated for all purposes in law as if the person has not—</Text><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/2012/9/section/96/1/a" IdURI="http://www.legislation.gov.uk/id/ukpga/2012/9/section/96/1/a" id="section-96-1-a"><Pnumber>a</Pnumber><P3para><Text>committed the offence,</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/2012/9/section/96/1/b" IdURI="http://www.legislation.gov.uk/id/ukpga/2012/9/section/96/1/b" id="section-96-1-b"><Pnumber>b</Pnumber><P3para><Text>been charged with, or prosecuted for, the offence,</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/2012/9/section/96/1/c" IdURI="http://www.legislation.gov.uk/id/ukpga/2012/9/section/96/1/c" id="section-96-1-c"><Pnumber>c</Pnumber><P3para><Text>been convicted of the offence,</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/2012/9/section/96/1/d" IdURI="http://www.legislation.gov.uk/id/ukpga/2012/9/section/96/1/d" id="section-96-1-d"><Pnumber>d</Pnumber><P3para><Text>been sentenced for the offence, or</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/2012/9/section/96/1/e" IdURI="http://www.legislation.gov.uk/id/ukpga/2012/9/section/96/1/e" id="section-96-1-e"><Pnumber>e</Pnumber><P3para><Text>been cautioned for the offence.</Text></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/2012/9/section/96/2" IdURI="http://www.legislation.gov.uk/id/ukpga/2012/9/section/96/2" id="section-96-2"><Pnumber>2</Pnumber><P2para><Text>In particular—</Text><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/2012/9/section/96/2/a" IdURI="http://www.legislation.gov.uk/id/ukpga/2012/9/section/96/2/a" id="section-96-2-a"><Pnumber>a</Pnumber><P3para><Text>no evidence is to be admissible in any proceedings before a judicial authority exercising its jurisdiction or functions in England and Wales to prove that the person has done, or undergone, anything within subsection (1)(a) to (e), and</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/2012/9/section/96/2/b" IdURI="http://www.legislation.gov.uk/id/ukpga/2012/9/section/96/2/b" id="section-96-2-b"><Pnumber>b</Pnumber><P3para><Text>the person is not, in any such proceedings, to be asked (and, if asked, is not to be required to answer) any question relating to the person's past which cannot be answered without acknowledging or referring to the conviction or caution or any circumstances ancillary to it.</Text></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/2012/9/section/96/3" IdURI="http://www.legislation.gov.uk/id/ukpga/2012/9/section/96/3" id="section-96-3"><Pnumber>3</Pnumber><P2para><Text>Where a question is put to a person, other than in such proceedings, seeking information with respect to the previous convictions, cautions, offences, conduct or circumstances of any person—</Text><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/2012/9/section/96/3/a" IdURI="http://www.legislation.gov.uk/id/ukpga/2012/9/section/96/3/a" id="section-96-3-a"><Pnumber>a</Pnumber><P3para><Text>the question is to be treated as not relating to any disregarded conviction or caution, or any circumstances ancillary to it (and the answer to the question may be framed accordingly), and</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/2012/9/section/96/3/b" IdURI="http://www.legislation.gov.uk/id/ukpga/2012/9/section/96/3/b" id="section-96-3-b"><Pnumber>b</Pnumber><P3para><Text>the person questioned is not to be subjected to any liability or otherwise prejudiced in law by reason of any failure to acknowledge or disclose that conviction or caution or any circumstances ancillary to it in answering the question.</Text></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/2012/9/section/96/4" IdURI="http://www.legislation.gov.uk/id/ukpga/2012/9/section/96/4" id="section-96-4"><Pnumber>4</Pnumber><P2para><Text>Any obligation imposed on any person by any enactment or rule of law or by the provisions of any agreement or arrangement to disclose any matters to any other person is not to extend to requiring the disclosure of a disregarded conviction or caution or any circumstances ancillary to it.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/2012/9/section/96/5" IdURI="http://www.legislation.gov.uk/id/ukpga/2012/9/section/96/5" id="section-96-5"><Pnumber>5</Pnumber><P2para><Text>A disregarded conviction or caution, or any circumstances ancillary to it, is not a proper ground for—</Text><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/2012/9/section/96/5/a" IdURI="http://www.legislation.gov.uk/id/ukpga/2012/9/section/96/5/a" id="section-96-5-a"><Pnumber>a</Pnumber><P3para><Text>dismissing or excluding a person from any office, profession, occupation or employment, or</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/2012/9/section/96/5/b" IdURI="http://www.legislation.gov.uk/id/ukpga/2012/9/section/96/5/b" id="section-96-5-b"><Pnumber>b</Pnumber><P3para><Text>prejudicing the person in any way in any office, profession, occupation or employment.</Text></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/2012/9/section/96/6" IdURI="http://www.legislation.gov.uk/id/ukpga/2012/9/section/96/6" id="section-96-6"><Pnumber>6</Pnumber><P2para><Text>This section is subject to section 97 but otherwise applies despite any enactment or rule of law to the contrary.</Text></P2para></P2><P2 process preliminary to the caution (including consideration by any person of how to deal with the offence and the procedure for giving the caution);</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/2012/9/section/98/3/d" IdURI="http://www.legislation.gov.uk/id/ukpga/2012/9/section/98/3/d" id="section-98-3-d"><Pnumber>d</Pnumber><P3para><Text>any proceedings for the offence which take place before the caution is given;</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/2012/9/section/98/3/e"
