Enforcement of licence conditions

46Use of powers under Competition Act 1998

(1)

Before exercising a power listed in subsection (3), the CAA must consider whether it would be more appropriate to proceed under the Competition Act 1998.

(2)

The CAA must not exercise such a power to the extent that it considers that it would be more appropriate to proceed under the Competition Act 1998.

(3)

Those powers are—

(a)

the power to give a contravention notice under section 31;

(b)

the power to give an enforcement order under section 33;

(c)

the powers to give and confirm an urgent enforcement order under sections 35 and 36;

(d)

the powers to impose penalties under sections 39 and 40.
