PuncAfter="">69</Pnumber><P1para><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/2011/21/section/69/1/2011-11-15" IdURI="http://www.legislation.gov.uk/id/ukpga/2011/21/section/69/1" id="section-69-1"><Pnumber>1</Pnumber><P2para><Text>ASCLA 2009 is amended as follows.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/2011/21/section/69/2/2011-11-15" IdURI="http://www.legislation.gov.uk/id/ukpga/2011/21/section/69/2" id="section-69-2"><Pnumber>2</Pnumber><P2para><Text>After section 83 insert—</Text><BlockAmendment TargetClass="primary" TargetSubClass="unknown" Context="main" Format="default"><P1group><Title>The apprenticeship offer</Title><P1><Pnumber PuncAfter="">83A</Pnumber><P1para><P2><Pnumber>1</Pnumber><P2para><Text>The Chief Executive must secure the provision of proper facilities for apprenticeship training that is suitable to the requirements of persons who—</Text><P3><Pnumber>a</Pnumber><P3para><Text>are within subsection (4), (5) or (6), and</Text></P3para></P3><P3><Pnumber>b</Pnumber><P3para><Text>have an apprenticeship opportunity.</Text></P3para></P3><Text>This is subject to section 83B (limit on scope of apprenticeship offer).</Text></P2para></P2><P2><Pnumber>2</Pnumber><P2para><Text>The duty imposed by subsection (1) is referred to in this section and section 83B as  “the apprenticeship offer”.</Text></P2para></P2><P2><Pnumber>3</Pnumber><P2para><Text>An apprenticeship opportunity is an opportunity to—</Text><P3><Pnumber>a</Pnumber><P3para><Text>enter into an apprenticeship agreement,</Text></P3para></P3><P3><Pnumber>b</Pnumber><P3para><Text>enter into any other contract of employment in connection with which training will be provided in accordance with an apprenticeship framework, or</Text></P3para></P3><P3><Pnumber>c</Pnumber><P3para><Text>undertake any other kind of working—</Text><P4><Pnumber>i</Pnumber><P4para><Text>in relation to which alternative English completion conditions apply under section 1(5), and</Text></P4para></P4><P4><Pnumber>ii</Pnumber><P4para><Text>in connection with which training will be provided in accordance with an apprenticeship framework.</Text></P4para></P4></P3para></P3></P2para></P2><P2><Pnumber>4</Pnumber><P2para><Text>A person within this subsection is one who is over compulsory school age but under 19.</Text></P2para></P2><P2><Pnumber>5</Pnumber><P2para><Text>A person within this subsection is one who is not within subsection (4) and—</Text><P3><Pnumber>a</Pnumber><P3para><Text>is a person aged under 21 towards whom a local authority in England has the duties provided for in section 23C of the Children Act 1989 (continuing functions in relation to certain formerly looked after children), or</Text></P3para></P3><P3><Pnumber>b</Pnumber><P3para><Text>is a person to whom section 23CA of that Act applies (further assistance for certain formerly looked after children aged under 25), in relation to whom a local authority in England is the responsible local authority (within the meaning of that section).</Text></P3para></P3></P2para></P2><P2><Pnumber>6</Pnumber><P2para><Text>A person within this subsection is one who—</Text><P3><Pnumber>a</Pnumber><P3para><Text>is not within subsection (4), and</Text></P3para></P3><P3><Pnumber>b</Pnumber><P3para><Text>is of a prescribed description.</Text></P3para></P3></P2para></P2><P2><Pnumber>7</Pnumber><P2para><Text>If regulations under subsection (6)(b) describe a person by reference to an age or an age range, the age, or the upper age of the age range, must be less than 25.</Text></P2para></P2><P2><Pnumber>8</Pnumber><P2para><Text>Facilities are proper if they are—</Text><P3><Pnumber>a</Pnumber><P3para><Text>of a quantity sufficient to meet the reasonable needs of individuals, and</Text></P3para></P3><P3><Pnumber>b</Pnumber><P3para><Text>of a quality adequate to meet those needs.</Text></P3para></P3></P2para></P2><P2><Pnumber>9</Pnumber><P2para><Text>Section 83(2) and (3) (when apprenticeship training is suitable, and matters to which Chief Executive must have regard) apply for the purposes of the apprenticeship offer.</Text></P2para></P2><P2><Pnumber>10</Pnumber><P2para><Text>In complying with the apprenticeship offer the Chief Executive must make the best use of the Chief Executive's resources.</Text></P2para></P2><P2><Pnumber>11</Pnumber><P2para><Text>In this section  “<Term>apprenticeship framework</Term>” has the meaning given by section 12.</Text></P2para></P2><P2><Pnumber>12</Pnumber><P2para><Text>The Secretary of State may by order amend this section for the purpose of changing the descriptions of persons to whom the apprenticeship offer applies.</Text></P2para></P2></P1para></P1></P1group><P1group><Title>Limit on scope of the apprenticeship offer</Title><P1><Pnumber PuncAfter="">83B</Pnumber><P1para><P2><Pnumber>1</Pnumber><P2para><Text>The Chief Executive is not required by the apprenticeship offer to secure the provision of facilities for apprenticeship training at a particular level for a person who—</Text><P3><Pnumber>a</Pnumber><P3para><Text>has already completed an English apprenticeship in relation to an apprenticeship framework at that level, or</Text></P3para></P3><P3><Pnumber>b</Pnumber><P3para><Text>holds an apprenticeship certificate at that level.</Text></P3para></P3></P2para></P2><P2><Pnumber>2</Pnumber><P2para><Text>For the purposes of this section apprenticeship training is at a particular level if it might reasonably be expected to lead to the issue of an apprenticeship certificate at that level.</Text></P2para></P2><P2><Pnumber>3</Pnumber><P2para><Text>The following provisions of Chapter 1 of Part 1 apply for the purposes of this section—</Text><UnorderedList Decoration="none"><ListItem><Para><Text>section 1 (meaning of  “completing an English apprenticeship”);</Text></Para></ListItem><ListItem><Para><Text>section 12 (meaning of apprenticeship framework and level of an apprenticeship framework).</Text></Para></ListItem></UnorderedList></P2para></P2><P2><Pnumber>4</Pnumber><P2para><Text>In this section  “<Term>apprenticeship certificate</Term>” means an apprenticeship certificate issued under section 3 or 4.</Text></P2para></P2><P2><Pnumber>5</Pnumber><P2para><Text>A reference in this section to an apprenticeship certificate at any level includes a reference to a certificate or other evidence (including a certificate awarded or evidence provided by a person outside England) which appears to the Chief Executive to be evidence of experience and attainment at a comparable or higher level.</Text></P2para></P2></P1para></P1></P1group></BlockAmendment></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/2011/21/section/69/3/2011-11-15" IdURI="http://www.legislation.gov.uk/id/ukpga/2011/21/section/69/3"
