DocumentURI="http://www.legislation.gov.uk/ukpga/2010/15/section/74/3/b" IdURI="http://www.legislation.gov.uk/id/ukpga/2010/15/section/74/3/b" id="section-74-3-b"><Pnumber>b</Pnumber><P3para><Text>the difference between the amount of statutory maternity pay to which she is entitled and what her pay would have been had she not been on maternity leave.</Text></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/2010/15/section/74/4" IdURI="http://www.legislation.gov.uk/id/ukpga/2010/15/section/74/4" id="section-74-4"><Pnumber>4</Pnumber><P2para><Text>The third condition is that the terms of her work do not provide for the maternity-related pay to be subject to—</Text><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/2010/15/section/74/4/a" IdURI="http://www.legislation.gov.uk/id/ukpga/2010/15/section/74/4/a" id="section-74-4-a"><Pnumber>a</Pnumber><P3para><Text>an increase as mentioned in subsection (2)(a), or</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/2010/15/section/74/4/b" IdURI="http://www.legislation.gov.uk/id/ukpga/2010/15/section/74/4/b" id="section-74-4-b"><Pnumber>b</Pnumber><P3para><Text>an increase that would have occurred as mentioned in subsection (2)(b).</Text></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/2010/15/section/74/5" IdURI="http://www.legislation.gov.uk/id/ukpga/2010/15/section/74/5" id="section-74-5"><Pnumber>5</Pnumber><P2para><Text>The modification referred to in subsection (1) is a modification to provide for the maternity-related pay to be subject to—</Text><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/2010/15/section/74/5/a" IdURI="http://www.legislation.gov.uk/id/ukpga/2010/15/section/74/5/a" id="section-74-5-a"><Pnumber>a</Pnumber><P3para><Text>any increase as mentioned in subsection (2)(a), or</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/2010/15/section/74/5/b" IdURI="http://www.legislation.gov.uk/id/ukpga/2010/15/section/74/5/b" id="section-74-5-b"><Pnumber>b</Pnumber><P3para><Text>any increase that would have occurred as mentioned in subsection (2)(b).</Text></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/2010/15/section/74/6" IdURI="http://www.legislation.gov.uk/id/ukpga/2010/15/section/74/6" id="section-74-6"><Pnumber>6</Pnumber><P2para><Text>A term of her work that—</Text><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/2010/15/section/74/6/a" IdURI="http://www.legislation.gov.uk/id/ukpga/2010/15/section/74/6/a" id="section-74-6-a"><Pnumber>a</Pnumber><P3para><Text>provides for pay within subsection (7), but</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/2010/15/section/74/6/b" IdURI="http://www.legislation.gov.uk/id/ukpga/2010/15/section/74/6/b" id="section-74-6-b"><Pnumber>b</Pnumber><P3para><Text>does not provide for her to be given the pay in circumstances in which she would have been given it had she not been on maternity leave,</Text></P3para></P3><Text>is modified so as to provide for her to be given it in circumstances in which it would normally be given.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/2010/15/section/74/7" IdURI="http://www.legislation.gov.uk/id/ukpga/2010/15/section/74/7" id="section-74-7"><Pnumber>7</Pnumber><P2para><Text>Pay is within this subsection if it is—</Text><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/2010/15/section/74/7/a" IdURI="http://www.legislation.gov.uk/id/ukpga/2010/15/section/74/7/a" id="section-74-7-a"><Pnumber>a</Pnumber><P3para><Text>pay (including pay by way of bonus) in respect of times before the woman is on maternity leave,</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/2010/15/section/74/7/b" IdURI="http://www.legislation.gov.uk/id/ukpga/2010/15/section/74/7/b" id="section-74-7-b"><Pnumber>b</Pnumber><P3para><Text>pay by way of bonus in respect of times when she is on compulsory maternity leave, or</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/2010/15/section/74/7/c" IdURI="http://www.legislation.gov.uk/id/ukpga/2010/15/section/74/7/c" id="section-74-7-c"><Pnumber>c</Pnumber><P3para><Text>pay by way of bonus in respect of times after the end of the protected period.</Text></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/2010/15/section/74/8" IdURI="http://www.legislation.gov.uk/id/ukpga/2010/15/section/74/8" id="section-74-8"><Pnumber>8</Pnumber><P2para><Text>A term of the woman's work that—</Text><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/2010/15/section/74/8/a" IdURI="http://www.legislation.gov.uk/id/ukpga/2010/15/section/74/8/a" id="section-74-8-a"><Pnumber>a</Pnumber><P3para><Text>provides for pay after the end of the protected period, but</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/2010/15/section/74/8/b" IdURI="http://www.legislation.gov.uk/id/ukpga/2010/15/section/74/8/b" id="section-74-8-b"><Pnumber>b</Pnumber><P3para><Text>does not provide for it to be subject to an increase to which it would have been subject had she not been on maternity leave,</Text></P3para></P3><Text>is modified so as to provide for it to be subject to the increase.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/2010/15/section/74/9" IdURI="http://www.legislation.gov.uk/id/ukpga/2010/15/section/74/9" id="section-74-9"><Pnumber>9</Pnumber><P2para><Text>Maternity-related pay is pay (other than statutory maternity pay) to which a woman is entitled—</Text><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/2010/15/section/74/9/a" IdURI="http://www.legislation.gov.uk/id/ukpga/2010/15/section/74/9/a" id="section-74-9-a"><Pnumber>a</Pnumber><P3para><Text>as a result of being pregnant, or</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/2010/15/section/74/9/b" IdURI="http://www.legislation.gov.uk/id/ukpga/2010/15/section/74/9/b" id="section-74-9-b"><Pnumber>b</Pnumber><P3para><Text>in respect of times when she is on maternity leave.</Text></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/2010/15/section/74/10" IdURI="http://www.legislation.gov.uk/id/ukpga/2010/15/section/74/10" id="section-74-10"><Pnumber>10</Pnumber><P2para><Text>A reference to the protected period is to be construed in accordance with section
