        </Number><Title>Legal aid and other payments for legal services</Title><Pblock DocumentURI="http://www.legislation.gov.uk/ukpga/2009/25/part/6/crossheading/regulation-of-certain-agreements" IdURI="http://www.legislation.gov.uk/id/ukpga/2009/25/part/6/crossheading/regulation-of-certain-agreements" NumberOfProvisions="2" RestrictStartDate="2009-11-12" id="part-6-crossheading-regulation-of-certain-agreements"><Title><Emphasis>Regulation of certain agreements</Emphasis></Title><P1group RestrictStartDate="2009-11-12"><Title>Damages-based agreements relating to employment matters</Title><P1 DocumentURI="http://www.legislation.gov.uk/ukpga/2009/25/section/154" IdURI="http://www.legislation.gov.uk/id/ukpga/2009/25/section/154" id="section-154"><Pnumber PuncAfter="">154</Pnumber><P1para><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/2009/25/section/154/1" IdURI="http://www.legislation.gov.uk/id/ukpga/2009/25/section/154/1" id="section-154-1"><Pnumber>1</Pnumber><P2para><Text>The Courts and Legal Services Act 1990 (c. 41) is amended as follows.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/2009/25/section/154/2" IdURI="http://www.legislation.gov.uk/id/ukpga/2009/25/section/154/2" id="section-154-2"><Pnumber>2</Pnumber><P2para><Text>After section 58A insert—</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/2009/25/section/154/58AA" IdURI="http://www.legislation.gov.uk/id/ukpga/2009/25/section/154/58AA" id="section-154-58AA"><Pnumber>"58AA</Pnumber><P2para><BlockAmendment TargetClass="unknown" TargetSubClass="unknown" Context="unknown" Format="default"><P1group><Title>Damages-based agreements relating to employment matters</Title><P1><Pnumber PuncAfter="">58AA</Pnumber><P1para><P2><Pnumber>1</Pnumber><P2para><Text>A damages-based agreement which relates to an employment matter and satisfies the conditions in subsection (4) is not unenforceable by reason only of its being a damages-based agreement.</Text></P2para></P2><P2><Pnumber>2</Pnumber><P2para><Text>But a damages-based agreement which relates to an employment matter and does not satisfy those conditions is unenforceable.</Text></P2para></P2><P2><Pnumber>3</Pnumber><P2para><Text>For the purposes of this section—</Text><P3><Pnumber>a</Pnumber><P3para><Text>a damages-based agreement is an agreement between a person providing advocacy services, litigation services or claims management services and the recipient of those services which provides that—</Text><P4><Pnumber>i</Pnumber><P4para><Text>the recipient is to make a payment to the person providing the services if the recipient obtains a specified financial benefit in connection with the matter in relation to which the services are provided, and</Text></P4para></P4><P4><Pnumber>ii</Pnumber><P4para><Text>the amount of that payment is to be determined by reference to the amount of the financial benefit obtained;</Text></P4para></P4></P3para></P3><P3><Pnumber>b</Pnumber><P3para><Text>a damages-based agreement relates to an employment matter if the matter in relation to which the services are provided is a matter that is, or could become, the subject of proceedings before an employment tribunal.</Text></P3para></P3></P2para></P2><P2><Pnumber>4</Pnumber><P2para><Text>The agreement—</Text><P3><Pnumber>a</Pnumber><P3para><Text>must be in writing;</Text></P3para></P3><P3><Pnumber>b</Pnumber><P3para><Text>must not provide for a payment above a prescribed amount or for a payment above an amount calculated in a prescribed manner;</Text></P3para></P3><P3><Pnumber>c</Pnumber><P3para><Text>must comply with such other requirements as to its terms and conditions as are prescribed; and</Text></P3para></P3><P3><Pnumber>d</Pnumber><P3para><Text>must be made only after the person providing services under the agreement has provided prescribed information.</Text></P3para></P3></P2para></P2><P2><Pnumber>5</Pnumber><P2para><Text>Regulations under subsection (4) are to be made by the Lord Chancellor and may make different provision in relation to different descriptions of agreements.</Text></P2para></P2><P2><Pnumber>6</Pnumber><P2para><Text>Before making regulations under subsection (4) the Lord Chancellor must consult—</Text><P3><Pnumber>a</Pnumber><P3para><Text>the designated judges,</Text></P3para></P3><P3><Pnumber>b</Pnumber><P3para><Text>the General Council of the Bar,</Text></P3para></P3><P3><Pnumber>c</Pnumber><P3para><Text>the Law Society, and</Text></P3para></P3><P3><Pnumber>d</Pnumber><P3para><Text>such other bodies as the Lord Chancellor considers appropriate.</Text></P3para></P3></P2para></P2><P2><Pnumber>7</Pnumber><P2para><Text>In this section—</Text><UnorderedList Decoration="none" Class="Definition"><ListItem><Para><Text>“<Term>payment</Term>” includes a transfer of assets and any other transfer of money's worth (and the reference in subsection (4)(b) to a payment above a prescribed amount, or above an amount calculated in a prescribed manner, is to be construed accordingly);</Text></Para></ListItem><ListItem><Para><Text>“<Term>claims management services</Term>” has the same meaning as in Part 2 of the Compensation Act 2006 (see section 4(2) of that Act).</Text></Para></ListItem></UnorderedList></P2para></P2><P2><Pnumber>8</Pnumber><P2para><Text>Nothing in this section applies to an agreement entered into before the coming into force of the first regulations made under subsection (4).</Text></P2para></P2></P1para></P1></P1group></BlockAmendment></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/2009/25/section/154/3" IdURI="http://www.legislation.gov.uk/id/ukpga/2009/25/section/154/3" id="section-154-3"><Pnumber>3</Pnumber><P2para><Text>In section 120(4)
