(1)The [F4Secretary of State] must, in performing [F5functions under this Part], have regard to the needs of persons with [F6special educational needs] to whom this section applies.

(2)This section applies to—

(a)persons who are aged 19 or over, other than persons aged under 25 [F7for whom an EHC plan is maintained], and

(b)persons who are subject to adult detention.
