<Text>This section makes it an offence to manufacture, import or sell a realistic imitation firearm. It includes a power to make regulations to provide for exceptions, exemptions and defences to the new offence. Realistic imitation firearms are defined by section 38.</Text>

<Text><Emphasis>Subsection (<CitationSubRef id="c00513" URI="http://www.legislation.gov.uk/id/ukpga/2006/38/section/36/1" CitationRef="c00511" SectionRef="section-36-1">1</CitationSubRef>)</Emphasis> applies the offence to a person who:</Text>

<Text>manufactures or sells a realistic imitation firearm;</Text>

<Text>modifies an imitation firearm to become a realistic imitation firearm; or</Text>

<Text>imports, or causes to be imported, an imitation firearm.</Text>
</Para>

<Text><Emphasis>Subsection (<CitationSubRef id="c00515" URI="http://www.legislation.gov.uk/id/ukpga/2006/38/section/36/2" CitationRef="c00511" SectionRef="section-36-2">2</CitationSubRef>)</Emphasis> applies defences in Section 37 to the offence. These defences allow for the continuing availability of realistic imitation firearms for certain specific legitimate purposes.</Text>

<NumberedPara id="paragraph-235" DocumentURI="http://www.legislation.gov.uk/ukpga/2006/38/notes/paragraph/235" IdURI="http://www.legislation.gov.uk/id/ukpga/2006/38/notes/paragraph/235"><Pnumber>235</Pnumber><Para>
<Text><Emphasis>Subsection (<CitationSubRef id="c00517" URI="http://www.legislation.gov.uk/id/ukpga/2006/38/section/36/3" CitationRef="c00511" SectionRef="section-36-3">3</CitationSubRef>)</Emphasis> allows the Secretary of State to make regulations to provide for exceptions and exemptions to the offence, and to provide for further defences in respect of the offence. <Emphasis>Subsection (<CitationSubRef id="c00519" URI="http://www.legislation.gov.uk/id/ukpga/2006/38/section/36/4" CitationRef="c00511" SectionRef="section-36-4">4</CitationSubRef>)</Emphasis> allows for exceptions, exemptions and defences to be based on the giving of approvals or consents, either for particular cases or for types of cases.  <Emphasis>Subsection (<CitationSubRef id="c00521" URI="http://www.legislation.gov.uk/id/ukpga/2006/38/section/36/5" CitationRef="c00511" SectionRef="section-36-5">5</CitationSubRef>)</Emphasis> requires the regulations to be set out in a statutory instrument and to be subject to the negative resolution process in Parliament.</Text>

<NumberedPara id="paragraph-236" DocumentURI="http://www.legislation.gov.uk/ukpga/2006/38/notes/paragraph/236" IdURI="http://www.legislation.gov.uk/id/ukpga/2006/38/notes/paragraph/236"><Pnumber>236</Pnumber><Para>
<Text><Emphasis>Subsections (<CitationSubRef id="c00523" URI="http://www.legislation.gov.uk/id/ukpga/2006/38/section/36/7" CitationRef="c00511" SectionRef="section-36-7">7</CitationSubRef>) and (<CitationSubRef id="c00524" URI="http://www.legislation.gov.uk/id/ukpga/2006/38/section/36/8" CitationRef="c00511" SectionRef="section-36-8">8</CitationSubRef>)</Emphasis> provide <Acronym Expansion="Her Majesty">HM</Acronym> Revenue &amp; Customs with a power to seize items imported into Great Britain in contravention of this section.</Text>

<Text><Emphasis>Subsection (<CitationSubRef id="c00526" URI="http://www.legislation.gov.uk/id/ukpga/2006/38/section/36/9" CitationRef="c00511" SectionRef="section-36-9">9</CitationSubRef>)</Emphasis> makes the offence a summary offence with a maximum penalty of 51 weeks imprisonment or a £5,000 fine, or both. <Emphasis>Subsection (<CitationSubRef id="c00528" URI="http://www.legislation.gov.uk/id/ukpga/2006/38/section/36/10" CitationRef="c00511" SectionRef="section-36-10">10</CitationSubRef>)</Emphasis> sets the maximum term of imprisonment to 6 months but this will increase to 51 weeks in England and Wales after the commencement of the sentencing provisions in section 281(5) of the Criminal Justice Act 2003.</Text>
