68Deliberate interference

A person commits an offence if he uses apparatus for the purpose of interfering with wireless telegraphy.

This section applies—

a

whether or not the apparatus in question is wireless telegraphy apparatus;

b

whether or not it is apparatus specified in regulations under section 54;

c

whether or not a notice under section 55 or 56 has been given with respect to it, or, if given, has been varied or revoked.

A person who commits an offence under this section is liable—

a

on summary conviction, to imprisonment for a term not exceeding F1the general limit in a magistrates’ court or to a fine not exceeding the statutory maximum or to both;

b

on conviction on indictment, to imprisonment for a term not exceeding two years or to a fine or to both.

In the application of subsection (3) to Scotland or Northern Ireland the reference to 12 months is to be read as a reference to six months.
