F137Prohibition on employment of police in fire-fighting

(1)

No member of a police force may be employed by a fire and rescue authority or a relevant chief constable for the purpose of—

(a)

extinguishing fires, or

(b)

protecting life and property in the event of fires.

(2)

Subsection (1) does not prevent the exercise of functions under section 7 (fire-fighting) by—

(a)

a relevant chief constable, or

(b)

a deputy chief constable to whom such functions have been delegated by a relevant chief constable.

(3)

In this section “relevant chief constable” means the chief constable of a police force for a police area to whom F2

(a)

functions of a fire and rescue authority have been delegated under an order under section 4HF3, or

(b)

functions of a fire and rescue authority which are exercisable by the mayor of a combined authority have been delegated under an order under section 107EA(2) of the Local Democracy, Economic Development and Construction Act 2009.
