F1Further duty to review tariffs

72CDuty to review certain tariffs that are not universal service tariffs

(1)

It is the duty of OFCOM—

(a)

to keep under review qualifying service tariffs, other than—

(i)

universal service tariffs; or

(ii)

tariffs available only to end-users who are carrying on a business; and

(b)

to monitor changes to those tariffs.

(2)

The reference in subsection (1) to qualifying service tariffs is a reference to the tariffs used by the providers of qualifying services.

(3)

In this section—

“qualifying services” means—

(a)

broadband services at a fixed location;

(b)

telephone services at a fixed location; and

(c)

mobile services, as defined by section 65(2BB)(a);

“tariff” includes a pricing structure.
