362AZ3Confirmation decisions: penalties

(1)

This section applies where a confirmation decision imposes one or more penalties (see section 362AZ1(8)).

(2)

In relation to each penalty imposed, the notice must—

(a)

give OFCOM’s reasons for their decision to impose the penalty,

(b)

specify each notified duty to which the penalty relates,

(c)

give OFCOM’s reasons for the amount of the penalty, including any aggravating or mitigating factors that OFCOM have taken into account,

(d)

specify a reasonable period within which the penalty must be paid, and

(e)

contain information about the consequences of not paying the penalty (including information about the kinds of enforcement action that it would be open to OFCOM to take).

(3)

The period specified under subsection (2)(d) for the payment of a penalty must be at least 28 days beginning with the day on which the confirmation decision is given.
