Duties relating to a regulated television selection service
362ARIssuing a code of practice
(1)
Before issuing a code of practice under section 362AP, OFCOM—
(a)
must publish a draft of the code or (as the case may be) a draft of the revisions of the existing code;
(b)
must consult the following about the draft—
(i)
the Secretary of State;
(ii)
public service broadcasters;
(iii)
such persons who appear to OFCOM to represent providers of regulated television selection services;
(iv)
such other persons as OFCOM consider appropriate;
(c)
may make such alterations to the draft as OFCOM consider appropriate following the consultation.
(2)
Subsection (1) does not apply in relation to revisions of the code of practice if—
(a)
OFCOM give the Secretary of State a draft of the revisions of the existing code, and
(b)
the Secretary of State agrees that it is not necessary for subsection (1) to apply in relation to the revisions.
