			(testing for drink or drugs) substitute—</Text><BlockAmendment TargetClass="primary" TargetSubClass="unknown" Context="main" Format="default"><P1group><Title>Power to administer preliminary tests</Title><P1><Pnumber PuncAfter="">6</Pnumber><P1para><P2><Pnumber>1</Pnumber><P2para><Text>If any of subsections (2) to (5) applies a constable may require a person to co-operate with any one or more preliminary tests administered to the person by that constable or another constable.</Text></P2para></P2><P2><Pnumber>2</Pnumber><P2para><Text>This subsection applies if a constable reasonably suspects that the person—</Text><P3><Pnumber>a</Pnumber><P3para><Text>is driving, is attempting to drive or is in charge of a motor vehicle on a road or other public place, and</Text></P3para></P3><P3><Pnumber>b</Pnumber><P3para><Text>has alcohol or a drug in his body or is under the influence of a drug.</Text></P3para></P3></P2para></P2><P2><Pnumber>3</Pnumber><P2para><Text>This subsection applies if a constable reasonably suspects that the person—</Text><P3><Pnumber>a</Pnumber><P3para><Text>has been driving, attempting to drive or in charge of a motor vehicle on a road or other public place while having alcohol or a drug in his body or while unfit to drive because of a drug, and</Text></P3para></P3><P3><Pnumber>b</Pnumber><P3para><Text>still has alcohol or a drug in his body or is still under the influence of a drug.</Text></P3para></P3></P2para></P2><P2><Pnumber>4</Pnumber><P2para><Text>This subsection applies if a constable reasonably suspects that the person—</Text><P3><Pnumber>a</Pnumber><P3para><Text>is or has been driving, attempting to drive or in charge of a motor vehicle on a road or other public place, and</Text></P3para></P3><P3><Pnumber>b</Pnumber><P3para><Text>has committed a traffic offence while the vehicle was in motion.</Text></P3para></P3></P2para></P2><P2><Pnumber>5</Pnumber><P2para><Text>This subsection applies if—</Text><P3><Pnumber>a</Pnumber><P3para><Text>an accident occurs owing to the presence of a motor vehicle on a road or other public place, and</Text></P3para></P3><P3><Pnumber>b</Pnumber><P3para><Text>a constable reasonably believes that the person was driving, attempting to drive or in charge of the vehicle at the time of the accident.</Text></P3para></P3></P2para></P2><P2><Pnumber>6</Pnumber><P2para><Text>A person commits an offence if without reasonable excuse he fails to co-operate with a preliminary test in pursuance of a requirement imposed under this section.</Text></P2para></P2><P2><Pnumber>7</Pnumber><P2para><Text>A constable may administer a preliminary test by virtue of any of subsections (2) to (4) only if he is in uniform.</Text></P2para></P2><P2><Pnumber>8</Pnumber><P2para><Text>In this section—</Text><P3><Pnumber>a</Pnumber><P3para><Text>a reference to a preliminary test is to any of the tests described in sections 6A to 6C, and</Text></P3para></P3><P3><Pnumber>b</Pnumber><P3para><Text>“<Term>traffic offence</Term>” means an offence under—</Text><P4><Pnumber>i</Pnumber><P4para><Text>a provision of Part II of the Public Passenger Vehicles Act 1981 (c. 14),</Text></P4para></P4><P4><Pnumber>ii</Pnumber><P4para><Text>a provision of the Road Traffic Regulation Act 1984 (c. 27),</Text></P4para></P4><P4><Pnumber>iii</Pnumber><P4para><Text>a provision of the Road Traffic Offenders Act 1988 (c. 53) other than a provision of Part III, or</Text></P4para></P4><P4><Pnumber>iv</Pnumber><P4para><Text>a provision of this Act other than a provision of Part V.</Text></P4para></P4></P3para></P3></P2para></P2></P1para></P1></P1group><P1group><Title>Preliminary breath test</Title><P1><Pnumber PuncAfter="">6A</Pnumber><P1para><P2><Pnumber>1</Pnumber><P2para><Text>A preliminary breath test is a procedure whereby the person to whom the test is administered provides a specimen of breath to be used for the purpose of obtaining, by means of a device of a type approved by the Secretary of State, an indication whether the proportion of alcohol in the person’s breath or blood is likely to exceed the prescribed limit.</Text></P2para></P2><P2><Pnumber>2</Pnumber><P2para><Text>A preliminary breath test administered in reliance on section 6(2) to (4) may be administered only at or near the place where the requirement to co-operate with the test is imposed.</Text></P2para></P2><P2><Pnumber>3</Pnumber><P2para><Text>A preliminary breath test administered in reliance on section 6(5) may be administered—</Text><P3><Pnumber>a</Pnumber><P3para><Text>at or near the place where the requirement to co-operate with the test is imposed, or</Text></P3para></P3><P3><Pnumber>b</Pnumber><P3para><Text>if the constable who imposes the requirement thinks it expedient, at a police station specified by him.</Text></P3para></P3></P2para></P2></P1para></P1></P1group><P1group><Title>Preliminary impairment test</Title><P1><Pnumber PuncAfter="">6B</Pnumber><P1para><P2><Pnumber>1</Pnumber><P2para><Text>A preliminary impairment test is a procedure whereby the constable administering the test—</Text><P3><Pnumber>a</Pnumber><P3para><Text>observes the person to whom the test is administered in his performance of tasks specified by the constable, and</Text></P3para></P3><P3><Pnumber>b</Pnumber><P3para><Text>makes such other observations of the person’s physical state as the constable thinks expedient.</Text></P3para></P3></P2para></P2><P2><Pnumber>2</Pnumber><P2para><Text>The Secretary of State shall issue (and may from time to time revise) a code of practice about—</Text><P3><Pnumber>a</Pnumber><P3para><Text>the kind of task that may be specified for the purpose of a preliminary impairment test,</Text></P3para></P3><P3><Pnumber>b</Pnumber><P3para><Text>the kind of observation of physical state that may be made in the course of a preliminary impairment test,</Text></P3para></P3><P3><Pnumber>c</Pnumber><P3para><Text>the manner in which a preliminary impairment test should be administered, and</Text></P3para></P3><P3><Pnumber>d</Pnumber><P3para><Text>the inferences that may be drawn from observations made in the course of a preliminary impairment test.</Text></P3para></P3></P2para></P2><P2><Pnumber>3</Pnumber><P2para><Text>In issuing or revising the code of practice the Secretary of State shall aim to ensure that a preliminary impairment test is designed to indicate—</Text><P3><Pnumber>a</Pnumber><P3para><Text>whether a person is unfit to drive, and</Text></P3para></P3><P3><Pnumber>b</Pnumber><P3para><Text>if he is, whether or not his unfitness is likely to be due to drink or drugs.</Text></P3para></P3></P2para></P2><P2><Pnumber>4</Pnumber><P2para><Text>A preliminary impairment test may be administered—</Text><P3><Pnumber>a</Pnumber><P3para><Text>at or near the place where the requirement to co-operate with the test is imposed, or</Text></P3para></P3><P3><Pnumber>b</Pnumber><P3para><Text>if the constable who imposes the requirement thinks it expedient, at a police station specified by him.</Text></P3para></P3></P2para></P2><P2><Pnumber>5</Pnumber><P2para><Text>A constable administering a preliminary impairment test shall have regard to the code of practice under this section.</Text></P2para></P2><P2><Pnumber>6</Pnumber><P2para><Text>A constable may administer a preliminary impairment test only if he is approved for that purpose by the chief officer of the police force to which he belongs.</Text></P2para></P2><P2><Pnumber>7</Pnumber><P2para><Text>A code of practice under this section may include provision about—</Text><P3><Pnumber>a</Pnumber><P3para><Text>the giving of approval under subsection (6), and</Text></P3para></P3><P3><Pnumber>b</Pnumber><P3para><Text>in particular, the kind of training that a constable should have undergone, or the kind of qualification that a constable should possess, before being approved under that subsection.</Text></P3para></P3></P2para></P2></P1para></P1></P1group><P1group><Title>Preliminary drug test</Title><P1><Pnumber PuncAfter="">6C</Pnumber><P1para><P2><Pnumber>1</Pnumber><P2para><Text>A preliminary drug test is a procedure by which a specimen of sweat or saliva is—</Text><P3><Pnumber>a</Pnumber><P3para><Text>obtained, and</Text></P3para></P3><P3><Pnumber>b</Pnumber><P3para><Text>used for the purpose of obtaining, by means of a device of a type approved by the Secretary of State, an indication whether the person to whom the test is administered has a drug in his body.</Text></P3para></P3></P2para></P2><P2><Pnumber>2</Pnumber><P2para><Text>A preliminary drug test may be administered—</Text><P3><Pnumber>a</Pnumber><P3para><Text>at or near the place where the requirement to co-operate with the test is imposed, or</Text></P3para></P3><P3><Pnumber>b</Pnumber><P3para><Text>if the constable who imposes the requirement thinks it expedient, at a police station specified by him.</Text></P3para></P3></P2para></P2></P1para></P1></P1group><P1group><Title>Arrest</Title><P1><Pnumber PuncAfter="">6D</Pnumber><P1para><P2><Pnumber>1</Pnumber><P2para><Text>A constable may arrest a person without warrant if as a result of a preliminary breath test the constable reasonably suspects that the proportion of alcohol in the person’s breath or blood exceeds the prescribed limit.</Text></P2para></P2><P2><Pnumber>2</Pnumber><P2para><Text>A constable may arrest a person without warrant if—</Text><P3><Pnumber>a</Pnumber><P3para><Text>the person fails to co-operate with a preliminary test in pursuance of a requirement imposed under section 6, and</Text></P3para></P3><P3><Pnumber>b</Pnumber><P3para><Text>the constable reasonably suspects that the person has alcohol or a drug in his body or is under the influence of a drug.</Text></P3para></P3></P2para></P2><P2><Pnumber>3</Pnumber><P2para><Text>A person may not be arrested under this section while at a hospital as a patient.</Text></P2para></P2></P1para></P1></P1group><P1group><Title>Power of entry</Title><P1><Pnumber PuncAfter="">6E</Pnumber><P1para><P2><Pnumber>1</Pnumber><P2para><Text>A constable may enter any place (using reasonable force if necessary) for the purpose of—</Text><P3><Pnumber>a</Pnumber><P3para><Text>imposing a requirement by virtue of section 6(5) following an accident in a case where the constable reasonably suspects that the accident involved injury of any person, or</Text></P3para></P3><P3><Pnumber>b</Pnumber><P3para><Text>arresting a person under section 6D following an accident in a case where the constable reasonably suspects that the accident involved injury of any person.</Text></P3para></P3></P2para></P2><P2><Pnumber>2</Pnumber><P2para><Text>This section—</Text><P3><Pnumber>a</Pnumber><P3para><Text>does not extend to Scotland, and</Text></P3para></P3><P3><Pnumber>b</Pnumber><P3para><Text>is without prejudice to any rule of law or enactment about the right of a constable in Scotland to enter any place.</Text></P3para></P3></P2para></P2></P1para></P1></P1group></BlockAmendment></P1para></P1><P1 DocumentURI="http://www.legislation.gov.uk/ukpga/2003/20/schedule/7/paragraph/2" IdURI="http://www.legislation.gov.uk/id/ukpga/2003/20/schedule/7/paragraph/2" id="schedule-7-paragraph-2" RestrictStartDate="2004-03-30"><Pnumber PuncAfter=""><CommentaryRef Ref="key-31f5f390e3b0a5e58a63469c31dab613"/>2</Pnumber><P1para><Text>In section 7(3) of that Act (provision of specimen for analysis) after the word  “or” after subsection (bb) insert—</Text><BlockAmendment TargetClass="primary" TargetSubClass="unknown" Context="main" Format="default"><P3><Pnumber>bc</Pnumber><P3para><Text>as a result of the administration of a preliminary drug test, the constable making the requirement has reasonable cause to believe that the person required to provide a specimen of blood or urine has a drug in his body, or</Text></P3para></P3></BlockAmendment><AppendText>.</AppendText></P1para></P1><P1 DocumentURI="http://www.legislation.gov.uk/ukpga/2003/20/schedule/7/paragraph/3" IdURI="http://www.legislation.gov.uk/id/ukpga/2003/20/schedule/7/paragraph/3" id="schedule-7-paragraph-3" RestrictStartDate="2004-03-30"><Pnumber PuncAfter=""><CommentaryRef Ref="key-f14e49d9ac41faf1252fe6c8cdf956ff"/>3</Pnumber><P1para><Text>In section 9(1) of that Act (protection for hospital patients)—</Text><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/2003/20/schedule/7/paragraph/3/a" IdURI="http://www.legislation.gov.uk/id/ukpga/2003/20/schedule/7/paragraph/3/a" id="schedule-7-paragraph-3-a"><Pnumber>a</Pnumber><P3para><Text>for  “to provide a specimen of breath for a breath test” substitute <InlineAmendment>“
                  to co-operate with a preliminary test
                ”</InlineAmendment>, and</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/2003/20/schedule/7/paragraph/3/b" IdURI="http://www.legislation.gov.uk/id/ukpga/2003/20/schedule/7/paragraph/3/b" id="schedule-7-paragraph-3-b"><Pnumber>b</Pnumber><P3para><Text>in paragraph (a), for  “it shall be for the provision of a specimen at the hospital” substitute <InlineAmendment>“
                  it shall be for co-operation with a test administered, or for the provision of a specimen, at the hospital
                ”</InlineAmendment>.</Text></P3para></P3></P1para></P1><P1 DocumentURI="http://www.legislation.gov.uk/ukpga/2003/20/schedule/7/paragraph/4" IdURI="http://www.legislation.gov.uk/id/ukpga/2003/20/schedule/7/paragraph/4" id="schedule-7-paragraph-4" RestrictStartDate="2004-03-30"><Pnumber PuncAfter=""><CommentaryRef Ref="key-bf4a1a04bfe9d262d5caec06662ffec2"/>4</Pnumber><P1para><Text>In section 10(1) of that Act (detention of persons affected by alcohol or drugs) in subsection (1) after  “a person required” insert <InlineAmendment>“
              under section 7 or 7A
            ”</InlineAmendment>.</Text></P1para></P1><P1 DocumentURI="http://www.legislation.gov.uk/ukpga/2003/20/schedule/7/paragraph/5" IdURI="http://www.legislation.gov.uk/id/ukpga/2003/20/schedule/7/paragraph/5" id="schedule-7-paragraph-5" RestrictStartDate="2004-03-30"><Pnumber PuncAfter=""><CommentaryRef Ref="key-7e37d81cec63e42affa9547a88dd3444"/>5</Pnumber><P1para><Text>In section 11 of that Act (interpretation)—</Text><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/2003/20/schedule/7/paragraph/5/a" IdURI="http://www.legislation.gov.uk/id/ukpga/2003/20/schedule/7/paragraph/5/a" id="schedule-7-paragraph-5-a"><Pnumber>a</Pnumber><P3para><Text>in subsection (2), omit the definition of  “breath test”, and</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/2003/20/schedule/7/paragraph/5/b" IdURI="http://www.legislation.gov.uk/id/ukpga/2003/20/schedule/7/paragraph/5/b" id="schedule-7-paragraph-5-b"><Pnumber>b</Pnumber><P3para><Text>in subsection (3) for  “A person does not provide a specimen of breath for a breath test or for analysis unless the specimen” substitute <InlineAmendment>“
                  A person does not co-operate with a preliminary test or provide a specimen of breath for analysis unless his co-operation or the specimen
