id="section-78-2"><Pnumber>2</Pnumber><P2para><Text>A person to whom this section applies commits an offence if his ability to carry out his duties is impaired because of drink or drugs.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/2003/20/section/78/3" IdURI="http://www.legislation.gov.uk/id/ukpga/2003/20/section/78/3" id="section-78-3"><Pnumber>3</Pnumber><P2para><Text>A person to whom this section applies commits an offence if the proportion of alcohol in his breath, blood or urine exceeds the prescribed limit.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/2003/20/section/78/4" IdURI="http://www.legislation.gov.uk/id/ukpga/2003/20/section/78/4" id="section-78-4"><Pnumber>4</Pnumber><P2para><Text>For the purposes of this section a master, pilot or seaman is professional if (and only if) he acts as master, pilot or seaman in the course of a id="section-78-5-a"><Pnumber>a</Pnumber><P3para><Text>he took the drug for a medicinal purpose on, and in accordance with, medical advice, or</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/2003/20/section/78/5/b" IdURI="http://www.legislation.gov.uk/id/ukpga/2003/20/section/78/5/b" id="section-78-5-b"><Pnumber>b</Pnumber><P3para><Text>he took the drug for a medicinal purpose and had no reason to believe that it would impair his ability to carry out his duties.</Text></P3para></P3></P2para></P2></P1para></P1></P1group><P1group RestrictStartDate="2004-03-30"><Title>Professional staff off duty</Title><P1 DocumentURI="http://www.legislation.gov.uk/ukpga/2003/20/section/79" IdURI="http://www.legislation.gov.uk/id/ukpga/2003/20/section/79" id="section-79"><Pnumber PuncAfter=""><CommentaryRef Ref="key-b3ff505ce2eabd86517ac669eec54f1a"/>79</Pnumber><P1para><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/2003/20/section/79/1" IdURI="http://www.legislation.gov.uk/id/ukpga/2003/20/section/79/1" id="section-79-1"><Pnumber>1</Pnumber><P2para><Text>This section applies to a professional seaman in a ship at a time when—</Text><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/2003/20/section/79/1/a" the event of an emergency he would or might be required by the nature or terms of his engagement or employment to take action to protect the safety of passengers.</Text></P3para></P3></P2para></P2><P2 to whom this section applies commits an offence if his ability to take the action mentioned in subsection (1)(b) is impaired because of drink or drugs.</Text></P2para></P2><P2 IdURI="http://www.legislation.gov.uk/id/ukpga/2003/20/section/80/1" id="section-80-1"><Pnumber>1</Pnumber><P2para><Text>This section applies to a person who—</Text><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/2003/20/section/80/1/a" IdURI="http://www.legislation.gov.uk/id/ukpga/2003/20/section/80/1/a" id="section-80-1-a"><Pnumber>a</Pnumber><P3para><Text>is on board a ship which is under way,</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/2003/20/section/80/1/b" IdURI="http://www.legislation.gov.uk/id/ukpga/2003/20/section/80/1/b" id="section-80-1-b"><Pnumber>b</Pnumber><P3para><Text>is exercising, or purporting or attempting to exercise, a function in connection with the navigation of the ship, and</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/2003/20/section/80/1/c" IdURI="http://www.legislation.gov.uk/id/ukpga/2003/20/section/80/1/c" id="section-80-1-c"><Pnumber>c</Pnumber><P3para><Text>is not a person to whom section 78 or 79 applies.</Text></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/2003/20/section/80/2" IdURI="http://www.legislation.gov.uk/id/ukpga/2003/20/section/80/2" id="section-80-2"><Pnumber>2</Pnumber><P2para><Text>A person to whom this section applies commits an offence if his ability to exercise the function mentioned in subsection (1)(b) is impaired because id="section-80-3"><Pnumber>3</Pnumber><P2para><Text>A person to whom this section applies commits an offence if the proportion of alcohol in his breath, blood or urine exceeds the prescribed limit.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/2003/20/section/80/4" IdURI="http://www.legislation.gov.uk/id/ukpga/2003/20/section/80/4" id="section-80-4" connection with the navigation of a ship.</Text></BlockText></P><P><BlockText><Text> <Addition ChangeId="key-8f7c06b0c584513c94e7ebd780f99951-1489576449025" id="section-83-2-b"><Pnumber>b</Pnumber><P3para><Text>to add, remove or amend a modification (whether or not in connection with an amendment of a provision specified in the table).</Text></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/2003/20/section/83/3" IdURI="http://www.legislation.gov.uk/id/ukpga/2003/20/section/83/3" id="section-83-3"><Pnumber>3</Pnumber><P2para><Text>For the purpose of the application by subsection (1) of a provision listed in the table in that subsection—</Text><P3 requires, as including a reference to the provision as applied.</Text></P3para></P3></P2para></P2></P1para></P1></P1group><P1group RestrictStartDate="2004-03-30"><Title>Detention pending arrival of police</Title><P1 DocumentURI="http://www.legislation.gov.uk/ukpga/2003/20/section/84" IdURI="http://www.legislation.gov.uk/id/ukpga/2003/20/section/84" id="section-84"><Pnumber PuncAfter=""><CommentaryRef Ref="key-8edca242d0002ad7f78e057416e42166"/>84</Pnumber><P1para><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/2003/20/section/84/1" IdURI="http://www.legislation.gov.uk/id/ukpga/2003/20/section/84/1" id="section-84-1"><Pnumber>1</Pnumber><P2para><Text>A marine official may detain a ship if he reasonably suspects that a person who is or may be on board the ship—</Text><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/2003/20/section/84/1/a" IdURI="http://www.legislation.gov.uk/id/ukpga/2003/20/section/84/1/a" id="section-84-1-a"><Pnumber>a</Pnumber><P3para><Text>is committing an offence under section 78, 79 or 80, or</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/2003/20/section/84/1/b" IdURI="http://www.legislation.gov.uk/id/ukpga/2003/20/section/84/1/b" id="section-84-1-b"><Pnumber>b</Pnumber><P3para><Text>has committed an offence under section 78, 79 or 80.</Text></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/2003/20/section/84/2" IdURI="http://www.legislation.gov.uk/id/ukpga/2003/20/section/84/2" id="section-84-2"><Pnumber>2</Pnumber><P2para><Text>The power of detention under subsection (1)—</Text><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/2003/20/section/84/2/a" IdURI="http://www.legislation.gov.uk/id/ukpga/2003/20/section/84/2/a" id="section-84-2-a"><Pnumber>a</Pnumber><P3para><Text>is conditional upon the marine official making a request, either before the detention or as soon as possible after its commencement, for a constable in uniform to attend, and</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/2003/20/section/84/2/b" IdURI="http://www.legislation.gov.uk/id/ukpga/2003/20/section/84/2/b" id="section-84-2-b"><Pnumber>b</Pnumber><P3para><Text>lapses when a constable in uniform has decided whether or not to exercise a power by virtue of section 83 and has informed the marine official of his decision.</Text></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/2003/20/section/84/3" IdURI="http://www.legislation.gov.uk/id/ukpga/2003/20/section/84/3" id="section-84-3"><Pnumber>3</Pnumber><P2para><Text>In this section  “<Term id="term-marine-official">marine official</Term>” means—</Text><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/2003/20/section/84/3/a" IdURI="http://www.legislation.gov.uk/id/ukpga/2003/20/section/84/3/a" id="section-84-3-a"><Pnumber>a</Pnumber><P3para><Text>a harbour master, or an assistant of a harbour master, appointed by a harbour authority,</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/2003/20/section/84/3/b" IdURI="http://www.legislation.gov.uk/id/ukpga/2003/20/section/84/3/b" id="section-84-3-b"><Pnumber>b</Pnumber><P3para><Text>a person listed in section 284(1)(a) to (d) of the Merchant Shipping Act 1995 (c. 21)(detention of ship), and</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/2003/20/section/84/3/c" IdURI="http://www.legislation.gov.uk/id/ukpga/2003/20/section/84/3/c" id="section-84-3-c"><Pnumber>c</Pnumber><P3para><Text>a person falling within a class designated by order of the Secretary of State.</Text></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/2003/20/section/84/4" IdURI="http://www.legislation.gov.uk/id/ukpga/2003/20/section/84/4" id="section-84-4"><Pnumber>4</Pnumber><P2para><Text>In construing section 284(1)(b) of the Merchant Shipping Act 1995 (detention by person authorised by Secretary of State) for the purpose of subsection (3)(b) above, the reference to authorisation to exercise powers under that section shall be taken as a reference—</Text><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/2003/20/section/84/4/a" IdURI="http://www.legislation.gov.uk/id/ukpga/2003/20/section/84/4/a" id="section-84-4-a"><Pnumber>a</Pnumber><P3para><Text>to general authorisation to exercise powers under that section, and</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/2003/20/section/84/4/b" IdURI="http://www.legislation.gov.uk/id/ukpga/2003/20/section/84/4/b" id="section-84-4-b"><Pnumber>b</Pnumber><P3para><Text>to general or particular authorisation to exercise powers under this section.</Text></P3para></P3></P2para></P2></P1para></P1></P1group><P1group RestrictStartDate="2004-03-30"><Title>Arrest without warrant</Title><P1 DocumentURI="http://www.legislation.gov.uk/ukpga/2003/20/section/85" IdURI="http://www.legislation.gov.uk/id/ukpga/2003/20/section/85" id="section-85"><Pnumber PuncAfter=""><CommentaryRef suspects that the person—</Text><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/2003/20/section/85/1/a" IdURI="http://www.legislation.gov.uk/id/ukpga/2003/20/section/85/1/a" id="section-85-1-a"><Pnumber>a</Pnumber><P3para><Text>is committing an offence under section 78(2), 79(2) or 80(2), or</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/2003/20/section/85/1/b" IdURI="http://www.legislation.gov.uk/id/ukpga/2003/20/section/85/1/b" id="section-85-1-b"><Pnumber>b</Pnumber><P3para><Text>has committed one of those offences and is still under the influence of drink or drugs.</Text></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/2003/20/section/85/2" IdURI="http://www.legislation.gov.uk/id/ukpga/2003/20/section/85/2" id="section-85-2"><Pnumber>2</Pnumber><P2para><Text>But a person may not be arrested under this section while he is at a hospital as a patient.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/2003/20/section/85/3" IdURI="http://www.legislation.gov.uk/id/ukpga/2003/20/section/85/3" id="section-85-3"><Pnumber>3</Pnumber><P2para><Text>In subsection (2)
