6(1)This paragraph applies where an application to transfer a premises licence is granted under section 44 in a case where a chief officer of police gave a notice under section 42(6) [F1or the Secretary of State gave a notice under section 42(8)] (which [F2, in either case,] was not withdrawn).E+W
(2)The chief officer of police [F3or the Secretary of State, as the case may be,] may appeal against the decision to grant the application.
