Section 124 is amended as follows.

In subsection (1) (entitlement to income support), after paragraph (a) (claimant must be 16 or over) insert—

he has not attained the qualifying age for state pension credit;

In that subsection, after paragraph (f) (claimant must not be entitled to jobseeker’s allowance etc) insert
; and
g
if he is a member of a married or unmarried couple, the other member of the couple is not entitled to state pension credit.
