26 Meaning of “appropriate judicial officer” and “competent court” U.K.

[(1)] For the purposes of this Part—

• “appropriate judicial officer” means—

  (a)

  (b)

  a District Judge (Magistrates’ Courts) designated for the purposes of this Act [F2 by the Lord Chief Justice of England and Wales after consulting the Lord Chancellor] , or

  (c)

  the Sheriff of Lothian and Borders; and

• “competent court” means a court consisting of an appropriate judicial officer.

[F3 (2) The Lord Chief Justice may nominate a judicial office holder (as defined in section 109(4) of the Constitutional Reform Act 2005) to exercise his functions under this section.]
