<NumberedPara id="paragraph-18" DocumentURI="http://www.legislation.gov.uk/ukpga/2001/12/notes/paragraph/18" IdURI="http://www.legislation.gov.uk/id/ukpga/2001/12/notes/paragraph/18"><Pnumber>18</Pnumber><Para>
<Text><Emphasis>Subsection (<CitationSubRef id="c00043" URI="http://www.legislation.gov.uk/id/ukpga/2001/12/section/3/1" CitationRef="c00041" SectionRef="section-3-1">1</CitationSubRef>)</Emphasis> creates the offence of engaging in conduct for which a licence is required (“licensable conduct”) when not in possession of an appropriate licence.  The penalty for the offence - as set out in <Emphasis>subsection (<CitationSubRef id="c00045" URI="http://www.legislation.gov.uk/id/ukpga/2001/12/section/3/6" CitationRef="c00041" SectionRef="section-3-6">6</CitationSubRef>)</Emphasis>– is, on conviction in a magistrates’ court, up to six months’ imprisonment or a fine up to £5,000, or both. <Emphasis>Subsection (<CitationSubRef id="c00047" URI="http://www.legislation.gov.uk/id/ukpga/2001/12/section/3/2" CitationRef="c00041" SectionRef="section-3-2">2</CitationSubRef>)</Emphasis> and<Emphasis><CitationSubRef id="c00049" URI="http://www.legislation.gov.uk/id/ukpga/2001/12/schedule/2" CitationRef="c00001" SectionRef="schedule-2">Schedule 2</CitationSubRef></Emphasis> together spell out what constitutes licensable conduct.  <Emphasis>Subsection (<CitationSubRef id="c00051" URI="http://www.legislation.gov.uk/id/ukpga/2001/12/section/3/3" CitationRef="c00041" SectionRef="section-3-3">3</CitationSubRef>)</Emphasis> defines “designated activities” of a security operative as those designated by the Secretary of State, who can designate different activities in relation to different types of licensable conduct.</Text>

<Text>The following categories of people will need to have licences:</Text>

<Text>security contractors, directors of security companies and partners of security firms;</Text>
</Para>
</ListItem>
<ListItem>
<Para>
<Text>employees of security contractors, security companies and security firms;</Text>
</Para>
</ListItem>
<ListItem>
<Para>
<Text>agency operatives, whether they are directors or partners of the agency, employees of the agency or individuals who work for the agency on a contract basis;</Text>
</Para>
</ListItem>
<ListItem>
<Para>
<Text>employees who manage or supervise security operatives supplied under contract by a security contractor, a security company or a security firm or by an agency;</Text>
</Para>
</ListItem>
<ListItem>
<Para>
<Text>agency-supplied managers or supervisors of security operatives supplied under contract;</Text>
</Para>
</ListItem>
<ListItem>
<Para>
<Text>directors of security companies and partners of security firms who do not themselves carry out designated activities;</Text>
</Para>
</ListItem>
<ListItem>
<Para>
<Text>in-house door supervisors and wheelclampers and their employers, managers and supervisors;</Text>
</Para>
</ListItem>
<ListItem>
<Para>
<Text>others who wheelclamp vehicles on private land against a release fee.</Text>
</Para>

<Text><Emphasis>Subsection (<CitationSubRef id="c00053" URI="http://www.legislation.gov.uk/id/ukpga/2001/12/section/3/4" CitationRef="c00041" SectionRef="section-3-4">4</CitationSubRef>)</Emphasis> indicates that persons employed in companies using security services supplied under a contract for service are not themselves subject to regulation by virtue of their assuming management or supervisory responsibilities in relation to those security staff.</Text>
