incidental, supplemental, consequential and transitional provision as the person making the order thinks necessary or expedient.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/2000/37/section/88/6/2016-05-21" IdURI="http://www.legislation.gov.uk/id/ukpga/2000/37/section/88/6" id="section-88-6"><Pnumber>6</Pnumber><P2para><Text>The power of the Secretary of State or the National Assembly for Wales by an order under section 86(1) or (10) to make incidental, supplemental, consequential or transitional provision includes power for any incidental, supplemental, consequential or, as the case may be, transitional purpose—</Text><P3 id="section-88-6-a"><Pnumber>a</Pnumber><P3para><Text>to apply with or without modifications,</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/2000/37/section/88/6/b/2016-05-21" IdURI="http://www.legislation.gov.uk/id/ukpga/2000/37/section/88/6/b" id="section-88-6-b"><Pnumber>b</Pnumber><P3para><Text>to extend, exclude or modify, or</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/2000/37/section/88/6/c/2016-05-21" IdURI="http://www.legislation.gov.uk/id/ukpga/2000/37/section/88/6/c" id="section-88-6-c"><Pnumber>c</Pnumber><P3para><Text>to repeal or revoke with or without savings,</Text></P3para></P3><Text>any board, or</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/2000/37/section/88/7/b/2016-05-21" IdURI="http://www.legislation.gov.uk/id/ukpga/2000/37/section/88/7/b" id="section-88-7-b"><Pnumber>b</Pnumber><P3para><Text>otherwise has the effect of transferring functions from one person to another or of providing for functions to become exercisable concurrently by two or more persons or to cease to be so exercisable,</Text></P3para></P3><Text>includes provision for the transfer of property, rights and liabilities from one person to another.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/2000/37/section/88/8/2016-05-21" IdURI="http://www.legislation.gov.uk/id/ukpga/2000/37/section/88/8" id="section-88-8"><Pnumber>8</Pnumber><P2para><Text>The power of the Secretary of State or the National Assembly for Wales under section 86(1) or (10) to provide by order for the transfer of any property, rights or liabilities, or to make transitional provision in connection with any such transfer or with any order by which functions become or cease to be exercisable by any conservation board, includes, in particular, power to provide—</Text><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/2000/37/section/88/8/a/2016-05-21" IdURI="http://www.legislation.gov.uk/id/ukpga/2000/37/section/88/8/a" id="section-88-8-a"><Pnumber>a</Pnumber><P3para><Text>for the management and custody of any transferred property (whether real or personal);</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/2000/37/section/88/8/b/2016-05-21" IdURI="http://www.legislation.gov.uk/id/ukpga/2000/37/section/88/8/b" id="section-88-8-b"><Pnumber>b</Pnumber><P3para><Text>for any liabilities transferred to include liabilities under any enactment;</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/2000/37/section/88/8/c/2016-05-21" IdURI="http://www.legislation.gov.uk/id/ukpga/2000/37/section/88/8/c" transferred or, as the case may be, any board or other authority by whom any functions are to become exercisable;</Text></P3para></P3><P3 exercisable as, for some or all purposes, the same person in law as the person from whom the transfer is made or the authority by whom the functions have previously been
