(1)In this Act “Welsh public authority” means—
(a)any public authority which is listed in Part II, III, IV or VI of Schedule 1 and whose functions are exercisable only or mainly in or as regards Wales, other than an excluded authority, or
[F1(b)any public authority which is—
(i)a subsidiary of the Welsh Ministers (as defined by section 134(4) of the Government of Wales Act 2006), or
(ii)a subsidiary of the Assembly Commission (as defined by section 139(4) of that Act).]
(2)In paragraph (a) of subsection (1) “excluded authority” means a public authority which is designated by the [F2Secretary of State] [F3or the [F4Minister for the Cabinet Office]] by order as an excluded authority for the purposes of that paragraph.
(3)Before making an order under subsection (2), the [F2Secretary of State] [F5or the [F6Minister for the Cabinet Office]] shall consult [F7the First Minister for Wales].
